HomeMy WebLinkAbout880872.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A RECREATIONAL FACILITY (HOT AIR BALLOON LAUNCH AREA) - SUCKLA FARMS WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 31st day of August, 1988 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Suckle Farms, 4468 Weld County Road 19 , Fort Lupton, Colorado 80621 , for a Site Specific Development Plan and Special Review Permit for a recreational facility (hot air balloon launch area) on the following described real estate, to-wit: Tart of the NW* of the SW} , Section 10 , Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Tom Hellerich, attorney, and WHEREAS , Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a . This proposal is located within the urban growth boundary area of the Town of Dacono and is consistent with the Weld County Comprehensive Plan ' s Urban Growth Boundary Goals and Policies. The Tri-Area Planning Commission, in a letter dated 880872 Page 2 RE: TIER - SUCKLA FARMS July 6 , 14988 , indicated that the proposal is compatible with its Comprehensive Plan. b. The proposal is consistent with the intent of the _Agricultural -Zone District in which the use would be located. The proposed _use is a recreational facility and is provided for as a Use by Special Review in the Agricultural Zone District. c. The uses permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Weld County Comprehensive -Plan. -Uses on surrounding properties include agricultural production, rural residences, grazing areas, and oil and gas production. d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health , safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a recreational facility (hot air balloon launch area) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Blanning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners. 2 . Prior to the Special Review plat being recorded , the following shall occur: a. The applicant shall submit verification of an approved Federal Aviation Form 157 to the Department of Manning Services. b. The Site Specific Development Plan and Special Review Permit is for a recreational facility (hot air balloon launch area) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . The applicant or property owner shall be responsible for the removal of all waste generated on the site . 4 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 5 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .5 of the Weld County Zoning Ordinance. 6 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 7 . Personnel from the Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 8 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Tom Hellerich, Attorney, came forward to represent the applicant. He said this would be an alternate site for a balloon club presently operating in the Tri-Town area, with limited hours and usage. Mr. Hellerich answered questions of the Board. Frank Suckla, the applicant, and Mr. Hellerich answered questions from Robert and Maxine Brown, owners of neighboring property, about the proposed operation. Mr. Morrison entered a copy of Section 13-21-115, CRS, concerning landowners' liability, into the record of this hearing. Commissioner Johnson moved to approve the request of Suckla Farms for a Site Specific Development Plan and Special Review Permit, subject to the three Conditions and nine Development Standards, as recommended. 'Ve/ 890672 The following people called in today saying that they are unable to be at the hearing today, but would like the Board to know they are opposed to the Special Use Permit for Suckla Farms: Ron Haake - He is opposed because of the location, said that when the balloons come down on his property it is a matter of trespass. Nancy Fichter - She is opposed because of the increased traffic and the dust problem. Suckla Farms, Inc. has leased the property described in the application consisting of approximately 8.5 acres to Surey Front Range Ltd. Partnership to be used as a recreational ballooning site for the Colorado Balloon Club. Surey is in turn, leasing the property to Colorado Balloon Club of 2401 15th Street, Suite 230, Denver, Colorado. This particular site will be used to launch hot-air balloons by members of the club. This application is necessitated by the construction of a tower near the present balloon site, which tower was approved in Case No. USR 776: 86: 67. The new location of the balloon launching site is not only necessitated by the proposed construction of the tower, and as a part of Case No. USR 776: 86: 67, but is also desirable and will provide for the safety of the ballooners, and has been previously approved and accepted by the Colorado Balloon Club as an alternate launching site. Upon approval of this site, this location will provide an excellent alternative to the existing launch site located about 2.5 miles northwest of the tower site. The present use of the 8.5 acres and all the surrounding property is in agricultural dry land use, by Suckla Farms, Inc. The distance from the proposed launching site to any residential structure in any direction exceeds 1/2 mile. The maximum number of users, members and patrons, would be approximately 200, and would average only 25 to 30 ballooners at any one time during an event. Historically, the ballooning club has averaged 1 or 2 ballooners during the week, and approximately 10 ballooners on a weekend. There is no anticipated change or increase in the use of the site by balloners. The hours of operation are daily, if anyone desires to show up and operate from the site, any time between daylight to approximately 10:00 a.m. There will be no employees or any laborers involved with the ballooning operation. Access to the site would be off of Weld County Road 19 directly to the west, and all vehicles would be parked on site and off any County roads. Because of the nature of the operation, there will be no particular parking location for the vehicles, as it is necessary to drive the vehicle to an available space in order to unload and launch the hot-air balloon. Typical vehicles involved in the activities would consist of cars, vans, pick-up trucks, and motor homes. It is not anticipated there will be any larger vehicles, nor will there be any particular traffic pattern, other than as explained above, when the ballooners may come to the site. There are no existing structures on the property, and there are no plans to build any structures. All water will be supplied by the parties 880872 bringing their own water in their vans or motor homes, and all sewage disposal will be in the same manner by the parties in their vans or motor homes. There is no anticipated need for any other water source or sewage disposal facility. All trash and debris will likewise be removed by the parties when they leave the premises. Fire protection will be provided by the Fort Lupton Fire District, and all balloons are equipped with a fire extinguisher. Fire protection requirements should be at a very minimum, and as there are no structures. Adequate protection can be provided by the Fort Lupton Fire District, and the fire extinguishers required on all balloons. There will be no animals on the site, and thus no stockpiling or storage areas of waste associated with animals will be required. There are no improvements planned to the site, and therefore no change in run-off from the site, and no storm retention facilities are required. Because there are no changes or improvements planned for the site, there is no proposed landscaping and no reclamation plans necessary. The proposed use is consistent with the agricultural uses and will not interfere in any manner with the surrrounding agricultural uses. The site is not in a prime agricultural ground, but on virtually non-productive farm ground. The use is consistent with the agricultural zone and the comprehensive_ plan and is a use by special review within an agriculturally zoned area as a recreational use and will not interfere with the neighboring agricultural uses or potential uses. Because of the nature of the uses and the fact that no facilities will be constructed, nor will there be any demands on water or sewer system, and because of the limited time frame and numbers of actual users, there are existing adequate protections for health and safety of the neighbors. This particular site selection is not in a designated area of future development of any municipality, and will not interfere with the development of any agricultural activity in the area. The site is not located in a flood plane, geological hazard area, or in an airport overlay district.
