RESOLUTION
RE: APPROVE SPECIAL REVIEW PERMIT FOR AN AGRICULTURAL SERVICE
ESTABLISHMENT (CROP DUSTING FACILITY) AND AN AIRSTRIP - CROP
AIR, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 9th day of December, 1987 , at the hour of 2 : 00 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Crop Air, Inc. , P.O. Box 1175 , Eaton, Colorado
80615 , for a Special Review permit for an agricultural service
establishment (crop dusting facility) and an airstrip on the
following described real estate, to-wit:
Part of the SWj , Section 3 , Township 6 North,
Range 65 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, said applicant was represented by Dana Gustafson,
and
WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4 .2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Weld County
Comprehensive Plan as outlined in Agricultural Goal
Number 3 which is to promote the development of
commercial uses directly dependent upon the
agricultural industry.

b. The subject site is located within the Town of
Eaton' s Urban Growth Boundary Area. The Special
Review activity complies with the Urban Growth
Boundary Goals and Policies because the use is an
agricultural support activity, and the Town
recommended no objections in a phone conversation
on October 20 , 1987 . The Special Review site is
located on the eastern edge of the Town' s Urban
Growth Boundary and no urban development is planned
in this area. The Special Review activity will not
cause significant impacts nor require additional
public facilities and services .
c. The proposal is consistent with the intent of the
Agricultural District. No adverse effects on
agricultural production will be caused by the
proposed use on surrounding properties.
d. The proposed use which would be permitted will be
compatible with the existing surrounding land uses.
The surrounding land uses are agricultural.
e. The proposed use which would be permitted will be
compatible with the future development of the
surrounding area as permitted by the existing
zoning and with the future development as projected
by the Weld County Comprehensive Plan and the
master plan of affected municipalities . The Town
of Eaton has indicated that no urban development is
planned for this area. The zoning surrounding the
site is agricultural. The future development of
the area should remain agricultural.
f. No overlay districts affect the site.
g. The applicant has demonstrated that a diligent
effort has been made in the conservation of
productive agricultural land in the location of the
proposed uses .
h. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
i. No objections have been received from surrounding
property owners .

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Special Review permit for an agricultural service establishment
(crop dusting facility) and an airstrip on the hereinabove
-described parcel of land be , and hereby is, granted subject to the
following conditions:
1 . The attached Development Standards for the Special
Review permit be adopted and placed on the Special
Review plat prior to recording the plat.
2 . The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat has been
delivered to the Department of Planning Services Office
and the plat is ready to be recorded in the office of
the Weld County Clerk and Recorder.
3 . Within thirty days of approval by the Weld County Board
of County Commissioners, the existing septic system
shall be reviewed for the existing use , and for the
proposed changes, by a Colorado Registered Professional
Engineer, and a copy of that review shall be submitted
-to the Weld County Health Department before the required
i .S.D.S . Evaluation can be performed.
4 . The applicant shall submit a supplement to the
application materials concerning the mechanical shop,
storage of private planes, and airstrip.

DEVELOPMENT STANDARDS
Crop Air, Inc.
USR-S 14
1 . The Special Review permit is for an agricultural service
establishment (crop dusting facility) and airstrip as
submitted in the application materials on file in the
Department of Planning Services and subject to the
Development Standards stated herein.
2 . Waste oil, pesticides , herbicides, antifreeze, and other
associated liquid and solid wastes shall be stored and
removed for final disposal in a manner that protects against
surface and groundwater contamination.
3 . No permanent disposal of wastes shall be permitted at this
site.
4 . All construction on the property shall be in accordance with
the requirements of the Weld County -Building Code Ordinance.
5 . The property owner ar operator shall be responsible for
complying with the Design Standards of Section 24 . 5 of the
Weld County Zoning Ordinance.
6 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 of the
Weld County Zoning Ordinance.
7 . Personnel from the Weld County Health Department and lgeld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated -herein and all applicable
Weld County Regulations.
8 . The Special Review area shall to limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services .
9 . The property owner or operator shall be responsible for
complying with all of the foregoing Standards. Noncompliance
with any of the foregoing Standards may -be reason for
revocation of the Permit by the Board of County
Commissioners .

The following tusiness was transacted:
I hereby certify that pursuant to -a notice dated November 23, 1987, and
duly published November 26, 1987, in the Johnstown Breeze, a public
hearing was conducted to Consider the request of Crop Air, Incorporated
for a Special Review permit for an agricultur-al service establishment
(crop dusting facility) and an airstrip. The matter was made of record
by Lee Morrison, Assistant County Attorney. Brian Bingile, Planning
Department representative, entered the favorable recommendation of the
Planning -Commission into the record -of this hearing. Dana Gustafson,
owner of Crop Air, Inc., tame forward to answer questions of the Board.
He said he has no objection to the four Conditions and nine Development
Standards contained 3n the Planning Commission'-s recommendation. No
public comment was received concerning this request. Commissioner
Brantner moved to approve the request of Crop air, Incorporated for a
Special Review permit, subject to the Conditions and Development
Standards proposed by the Planning Commission. The motion, seconded by
Commissioner Yamaguchi, carried unanimously.
This Certification was approved on the 14th day of December, 1987.

Should the applicant or any interested party desire the presence of a court
reporter to make a record of the proceedings, in addition to the taped

MOTION:
Ernie Ross moved Case Number USR-813 for Michal Bearson for a Special Review
permit for a single family dwelling on a parcel of land under the minimum
lot size in the Agricultural zone district be forwarded to the Board of
County Commissioners with the Planning Commission's recommendation for
approval based upon the recommendations, conditions, and Development
Standards as set forth by the Department of Planning Services' staff and the
testimony heard by the members of the Planning Commission. Motion seconded
by Paulette Weaver.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission. Jerry -Burnett - yes; Bud Halldorson - no; Ernie Ross - yes;
Ivan Gosnell - yes; LeAnn Reid - yes; Louis Rademacher - yes; Paulette
Weaver - yes; Lynn Brown - yes. Motion carried with seven voting for the
motion and one voting against the motion.

Dana Gustafson, owner, Crop Air, stated he wants to remove some old
buildings on this site and replace them with a new airplane hangar. He owns
three spray planes and one passenger plane. There are some planes stored on

1. Waste oil, pesticides, herbicides, anti-freeze, and other associated
liquid and solid wastes, shall be -stored and removed for final

2. No permanent disposal of wastes shall be permitted at this site.
3. The existing septic system is required to be reviewed for the

Incorporated to establish a hangar at the Crop Air Barnett Airfield.
The Federal Aviation Administration has no objection to the proposal
but we recommend a minimum runway centerline to building separation of
125' .
We also request that Crop-Air update their records with the FAA and I
have enclosed a form for that purpose. Our last correspondence in
1975 indicates their strip is for emergency use only and is named
Thompson Airstrip.

hearing on November 17, 1987.
(1) Crop Air,Inc. has in the past and is currently leasing
one of our buildings to two Independent Aircraft Mechanics. In
addition to performing maintenance on Crop Airs' equipment, they
take in outside aircraft and engine overhaul and repair work.
This practice will probably continue in the future.
(2) Crop air, Inc. has in the past, is currently, and probably
will continue to lease aircraft storage space to a limited number
of individuals who use their aircraft infrequently enough so as
not to affect the efficient operation of Crop Airs' business.

CROP AIR INC .
INTRODUCTION
This property has been used for an agricultural aircraft field for
many years . The use of the property will not change . This special
reveiw process is needed because we are upgrading the hanger
facilities by taking out an old 5000 square foot banger and replacing
it with a new -8000 square foot hanger and at a later date replacing
the old office building with a new structure.
PROPOSED USE
The use of the new structure on the property will be an airplane
hanger to store agricultural aircraft that are now being stored in a
building that is being torn down and als-o to upgrade the office
building at a later date .
NEED FOR USE
This hanger is needed to protect agricultural airplanes used for
crop spraying . The business is needed for agricultural crop spraying .
SURROUNDING PROPERTY USES
The surrounding properties are now agricultural farm land . To the
East there is waste land in weeds , to the West there is alfalfa and
corn, to the North there is beets and sheep pasture and to the South
there is alfalfa and corn.

The property is accessed via county roads 43 and 72 with a
permanent access easement into the property to the east of this

SECTION THREE
The use of this structure is consistent with the Meld County
Comprehensive Plan because Weld County is very agriculturally
intensive and _crop spraying is a very important part -of agriculture .
The proposed use is consistent with the intent of of district
because the site is surrounded by agricultural ground that makes use
of the services generated by this company.
This location has been serving agricultural lands for manyyears
in aerial applications to crops . The property -essentially will not
change other than removing an old building and replacing it with a new
one .
Adequate provision is already made for the protection of health ,
safety and welfare of the inhabitants of the neighborhood and the
_county by using proper storage and maintenance facilities in this
business .
Land uses of the surrounding area include agricultural production .
This business is very compatible with agriculture being a agricultural
service business .
This use will be compatible with future development because of the
nature of the surrounding properties which are agricultural .
This special review is not located in a flood plain, geologic
hazard area and it is not located in the Weld County Airport overlay
District .
The water supply is by domestic well that is adequate for the
intended purpose in supply, quality and dependability and this is
verified by the previous performance of the water supply that has been
dedicated to this business for many years at this location.
