Q0k� J ti.t . - l W _ - a, , - °e aN _gN In i _ 1 - ' ^ CS - n :G ,1944 - _ --' _ _—J - • 1 01 e byb 9t ., J$ 1 Liii • CZ AA' q RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN ACCESSORY BUILDING WITH A GROSS FLOOR AREA LARGER THAN 1 ,500 SQUARE FEET LOCATED IN THE R-1 (LOW DENSITY RESIDENTIAL) DISTRICT - DAVID PIETRANGELO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 11th day of May, 1988 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of David Pietrangelo, 13801 Elmore Road, Longmont, Colorado 80501 , for a Site Specific Development Plan and Special Review permit for an accessory building with a gross floor area larger than 1 ,500 square feet located in the R-1 (Low Density Residential) District on the following described real estate, to-wit: Lot 6 , Block 2, Seemore Heights Subdivision, part of the NW} , Section 30, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS , said applicant was present, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan. Urban Growth Boundary Goal No. 2 promotes a coordinated effort between the County je 880343 Page 2 RE: USR - PIETRANGELO and the municipality while regulating policies and standards relating to land use, zoning regulations , and other closely related matters. The Town Clerk of Mead indicated that the Town had no objections to this proposal in its referral response dated March 28 , 1988 . b. The proposal is consistent with the intent of the R-1 (Low Density Residential) Zone District. The R-1 District is also intended to accommodate nonresidential land uses that are both accessory to and compatible with residential uses . An accessory building with a gross floor area larger than 1 ,500 square feet in the R-1 Zone District is provided for as a Use by Special Review. c. The proposal will be compatible with the existing surrounding land-uses and with future development of the surrounding areas as permitted by the R-1 (Low Density Residential) Zone District. The design, style, and color of the building is compatible with other accessory buildings in this subdivision. d. The site is not affected by any overlay districts. e. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review permit for an accessory building with a gross floor area larger than 1 ,500 square feet located in the R-1 (Low Density Residential) District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Special Review permit is for the approval of a Site Specific Development Plan and a Special Review permit for an accessory building larger than 1 ,500 square feet in the R-1 (Low Density Residential) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4 . The property owner or operator shall he responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 3 . The property owner shall be responsible for complying with the Design Standards of Section 24 . 6 of the Weld County -Zoning Ordinance. 6 . Personnel from the Longmont Fire Protection District, Weld County Health Department, and the Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 7. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Brian Bingl-e, -representing the Planning Department, entered the favorable -recommendation of the Planning Commission into the record. David Yietrangelo, the applicant, explained that this building has already been constructed on the property. No public comment was offered concerning this matter. Commissioner Lacy moved to approve the request for a Site Specific Development Plan and Special Review permit, subject to the two Conditions and eight Development Standards contained in the planning Commission's recommendation.
