RE: APPROVAL OF USE BY SPECIAL REVIEW FOR HORSE TRAINING AND
BOARDING FACILITY - BRYAN AND CLAUDIA SHAHA
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 27th day of February, 1985 , at the hour of 2 : 00
o' clock p.m. in the Chambers of the Board for the purpose of
hearing the application of Bryan and Claudia Shaha, 19637 Weld
County Road 39 , La Salle, Colorado 80645 , for a Use by Special
Review for a horse training and boarding facility on the following
described real estate , to-wit:
Part of the NE;, Section 30 , Township 4 North,
Range 65 West of the 6th P.M. , Weld County,
Colorado
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall he approved for the following reasons :
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe on
continued agricultural use in the vicinity or
County. The proposal does not appear to have any
adverse impacts on the agricultural interest of the
County or the environment.

b. The proposal is consistent with the intent of the
Agricultural Zone District and is provided for as a
Use by Special Review.
c. The activities proposed will be compatible with
existing agricultural uses , as well as with the
future projected development in the immediate area.
The future uses are intended to remain agricultural.

significant traffic or noise impacts.
d. No overlay districts affect the site.
e. Use by Special Review Operation and Design
Standards provide adequate protection of the
health, safety and welfare of the neighborhood and
County.
NOW, THEREFORE, BF IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a horse training and boarding facility
on the hereinabove described parcel of land be, and hereby is,
granted subject to the following conditions:
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . No :ouildi_ng or electrical permits shall be issued for
the Use by Special Review Permit area until the
Standards for the Use by Special Review have been placed
on the Use by Special Review plat and the plat has been
delivered to the Department of Planning Services office.
3 . Prior to recording the mylar plat for USR-662 : 84 : 58 , the
applicant shall submit an approved erosion and sediment
control plan and drainage plan as per the
recommendations of the Platte Valley Soil Conservation
District to the Department of Planning Services .
4 . Prior to recording the mylar plat for USR-662 : 84 : 58 , the
applicant shall submit evidence of an adequate septic
system as per the requirements of the Weld County Health
Department to the Department of Planning Services .

OPERATION STANDARDS

USR-662 :84 : 58
1 . The uses permitted shall be a horse training and hoarding
facility as described in the application materials on file
in the office of the Department of Planning Services.
2 . The applicant shall comply with the design standards for
the Use by Special Review, Section 24 . 5 et seq. , of the
Weld County Zoning Ordinance .
3 . The applicant shall implement and maintain the approved
erosion and sediment control plan and drainage plan
recommended by Platte Valley Soil Conservation District .
4 . The applicant shall comply with the Operation Standards for
Uses by Special Review, Section 24 . 6 et seq. , of the Weld
County Zoning Ordinance .
5 . Representatives or members of the Weld County Health
Department and Weld County Department of Planning Services
shall he granted access onto the site at any reasonable
time in order to insure the operations carried out on the
site comply with the Operation Standards stated hereon and
all applicable Weld County Regulations .
6 . The Use by Special Review area shall be limited to the
plans shown hereon and governed by the Standards as stated
above and all applicable Weld County Regulations. Any
material deviations from the plans and/or Standards as
shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning
Commission and the Board of County Commissioners before
such changes from the plans and/or Standards are permitted .
Any other changes shall be filed in the office of the
Department of Planning Services.
7 . The property owner and/or operator of this operation shall
be responsible for complying with all of the above stated
Standards. Noncompliance with any of the above stated
Standards may be reason for revocation of the Permit by the
Board of County Commissioners.

A public hearing was conducted on February 27, 1985, at 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 13, 1985, and
duly published February 14, 1985, in the La Salle Leader, a public
hearing was conducted to consider the request of Bryan and Claudia
Shaha for a Use by Special Review for a horse training and hoarding
facility. Before the hearing commenced, Chairman Pro-Tem Brantner
explained that this matter requires at least three votes for a decision
and because only four Commissioners were present, if a tie vote results
the absent Commissioner would then listen to the tape and cast the
deciding vote, The applicants chose to continue with the hearing
today. Lee Morrison, Assistant County Attorney, made this matter of
record. Jim Mayerl , representing the Planning Department, read the
favorable recommendation of the Planning Commission, which is subject
to four conditions and eight Operation Standards, into the record.
Bryan Shaha , applicant, came forward to make his presentation. Mr.
Shaha addressed those concerns which had been voiced at the Planning
Commission meeting by surrounding landowners. Mr. Shaha also requested
that Operation Standard #2 be amended to include the sentence:
"Activity may be conducted outside subject site with permission of
affected property owner. " Corky Shaha, applicant, came forward to
answer questions of the Board. She explained the aspects of the
training which she intends to conduct at this site. There was some
discussion about the addition of another Operation Standard concerning
the installation of a wood fence and whether there should be a time
limit for such installation. Mr. Shaha said that because of the
expense, installing a wood fence would be hard to do in a short period
of time. Adolph Bohlander and Fred Betz, adjacent neighbors , came
forward to make comments.

Following considerable discussion, the Board agreed to delete #2 from
the Operation Standards. Commissioner Lacy moved to approve the Use by
Special Review for Bryan and Claudia Shaha for a horse training and
boarding facility with the deletion of #2 from the Operation Standards.
The motion, seconded by Commissioner Yamaguchi , carried unanimously.

February 5, 1985
A regular meeting of the Weld County Planning Commission was held on
February 5, 1985, at 1:30 p.m. in the County Commissioners' Hearing Boom. ,
915 Tenth Street, Greeley, Colorado. The meeting was called to order by the
chairman, Bob Ehrlich.

The Summary of the last regular meeting of the Weld County Planning
Commission held on January 22, 1985, was approved as distributed.

APPLICANT: Bryan and Claudia Shaha
REQUEST: Use by Special Review Permit for a Horse Boarding and Training
Facility
LEGAL DESCRIPTION: Part of the NE„ Section 30, T4N, R65W of the 6th
P.M. , Weld County, Colorado.
LOCATION: Four (4) miles east of Gilcrest; south of Weld County Road
42 and west of Weld County Road 39.
APPEARANCE:
Corky (Claudia) Shaha, property owner and applicant, stated this is a
teaching and training facility and they will be boarding horses for students
and horses that she is training. The barn has twenty—one stalls, but there
is room for about ten more horses so the maximum amount of horses that would
be stabled on this property is approximately thirty. The indoor and outdoor
arenas will be used for training. Her youngest student is six and her
oldest student is seventy years old. Not all of her students have their own
horses and she owns horses which they ride. Eventually they hope to have
post and rail fences around the perimeter of the pasture. Not all horses
are put into the pasture each day. This is done on a rotation basis. They
do not depend on the land for feed. All feed is brought in and they try to
accommodate the local farmers and businesses.

The Chairman asked Mrs. Shaha if she had reviewed the recommendations,
conditions, and operation standards , as outlined by the Department of
Planning Services staff. She stated she has and agrees with them.
The Chairman called for discussion from the audience.
Adolph Bohlender, adjacent property owner and board member of the Farmer's
Reservoir and Irrigation Company, reported there is a one hundred thirty
foot right-of-way for the ditch company and the applicants have already
built their horse barn on the ditch company right-of-way. Forces and riders
from this facility have been using the ditch bank and his fields to ride the
horses on. Therefore , he doubted that seventeen acres was large enough to
accommodate thirty horses. This area is agricultural in nature and he
wished to make sure agricultural endeavcrs, i.e. , aerial crop ousting, oil
and gas well activities, etc. , would be able to be carried on without
special notification of the applicants. He also felt overgrazing and land
erosion was a possibility with this many horses on only seventeen acres.
Ted Oster, surrounding property owner, spoke in opposition of this request.
Cie e Schmidt, surrounding property owner, spoke of possible problems
that --.:-.dy be encountered when urban residents move into an agricultural are:
Lee Morrison explained the liability to residents of the area would probably
be no greater than any ether surrounding property owner except for the more
extensive use.

The Chairman asked James Mayer]. to read the recommendations, conditions, and
operation standards, as amended by the Department of Planning Services staff

MOTION:
Paulette Weaver moved Case Number USR-662:84:58 for Bryan and Claudia Shaha
for a Use by Special Review Permit for a Horse Boarding and Training
Facility he forwarded to the Board of County Commissioners with the Planning
Commission's recommendation for approval based upon the recommendations,
conditions, and operation standards as amended, and the testimony heard by
the Planning Commission. Motion seconded by Louis Rademacher.

The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Paulette Weaver - yes; Doug Graff - yes;
Lydia Dunbar - yes; Stephen Hamilton - yes; Bill McMurray - yes; Louis
Rademacher - yes; Jack Holman - No, because there appears to be problems
with the applicants not abiding with the ditch company right--of-way and
testimony heard from the surrounding property owners in opposition to this
request. Sharon Linhart - yes; Bob Ehrlich - yes. Motion carried with
eight voting for the motion and one voting against the motion.

LOCATION: Approximately 2.5 miles southwest of Kersey; north of Weld
County Road 50 and east of Weld County Road 51
APPEARANCE:
James Mayerl reported the applicant delivered a letter to the Department of
Planning Services this morning asking that this request be continued until
the regular°.y scheduled meeting of the Planning Commission to be held on
March 5, 1985, at 1:30 p.m. The applicant indicated verbally, although it
is not stated in the letter, that they need an extension of time to obtain
legal counsel.
The Chairman asked James Mayerl to read the request of the applicant into
the record.
The Chairman asked if anyone present in the audience was present to hear
this case. There were several members of the audience raised their hands.
The Chairman asked that they leave their name, address, and phone number
with the current planner so they could be notified if there were another
request for continuation. He apologized for any inconvenience this may have
caused to the audience, but the Planning Commission cannot listen to
testimony without an applicant or representative present.

We have the following comments on this request.
Soils: Most of the area covered by the Plot Plan is irrigated land but not
prime agricultural land. Most of the area south of the Plot Plan is prime
agricultural land. This is according to the Important Farmland Map of
Weld County, Colorado. The soil for this entire area has a moderate ➢ imitation
for roads due to low strength of the soil . For recreation development it has
a moderate limitation due to the sandy condition of the soil and the dust
created by trampling. Soils are susceptible to wind erosion, especially on
large bare areas.
Drainage: Provisions should be made to care for water runoff on hard surfaced
areas.
Erosion and Sediment Control : Large bare areas are susceptible to wind erosion.
Plans should be made to take care of this potential problem.

a. Proposed use of the area is for a sporting and
training facility, horse breeding program, and
developing rider skills in the area of dressage
and hunter/jumper training. The proposal is
consistent with a plan for Weld County , in that
the present and future inhabitants will be pro-
vided with services that are inadequately pro-
vided in the County. The intended supervisor
and developer of the facility, Corky Shaha is
nationally known as a rider, teacher, & judge
in athletic sport horse activities .
b. The property is in an agricultural area south of
LaSalle , Colorado. There is a sub-irrigated
alfalfa field, which is part of the property, and
may be used as a horse pasture during areas of
non-production. The nearest neighbors ' home is
approximately one-quarter of a mile away to the
south and to the north-east. The nearest residence
to the northwest is approximately one-half males ,
and to the west approximately one mile . The nro--
posal. of a horse training and boarding facility is
consistent with the intent of the district in which
the use is located.
c. The existing land uses adjacent to the property
are all of an agricultural nature.
d. Upon information and belief, the proposal is not
located within any overlay district area.
e. The proposed area is a small sub-irrigated farm,
and most of the proposed structures will be placed
on the property at the locations that are not in
crops .
f. There is no foreseeable danger to the health, safety ,
and welfare of the inhabitants of the neighborhood,
in that the closest neighbor is one-quarter cf a
mile away. The use would not endanger other in-
habitants of the County

a . The type of use proposed is a horse training and.
boarding facility. Additionally, space will be
set aside for the breeding and foaling of selected
mares .
b. The proximity to residential structures is approxi-
mately 150 feet . Residential structure is the family
home of the individuals proposing the use .
c . The number of shifts to be worked is one , and the
maximum number of employees presently is two , with
a plan for future growth. The maximum growth appears
to be no more than four employees , mostly working in
the daytime hours .
d. The average number of users , patrons , members , buyers ,
or employees , at present , is ten at any given time , sub-
ject to change with growth. There may be additional
persons at clinics or group classes that nay be given
from time to time .
e . Types of animals on the site will be horses , and the
maximum number to be concentrated on the site at any
one time are approximately 25 , subject to change with
growth. Anticipated growth will not exceed 30 animals .
f. The present proposed structures are as follows : riding
arenas , a planned indoor arena, a shed with outdoor runs
for horses , and a barn to board additional horses . The
existing structures would be converted to a tack room for
storing saddles and bridles and a small storage shed.
g. The vehicular traffic and access routes that will be
utilized: any and all types of passenger vehicles and
some horse trailers using the facilities during business
hours. Access to the facilities will be gained via the
