RE: GRANT MOBILE HOME PERMIT NO. 1000 - THOMAS C. AND CONNIE L.
McAVENEY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, on the 17th day of April, 1985 , considered the request
of Thomas C. and Connie L. McAveney for a mobile home to be used
as a principal dwelling, and
WHEREAS, said mobile home is to be occupied in an
A-Agricultural Zone District on a parcel of land being more
particularly described as follows :
Part of the Ek SEa , Section 21 , Township 2
North, Range 67 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, the Board of County Commissioners, having heard the
testimony, finds that said request should be granted subject to
the following conditions: 1) The applicant shall apply for a
building permit for the mobile home within thirty days from the
date of approval by the Board of County Commissioners; 2) The
mobile home shall not be occupied until such time that the
applicant has complied with the above mentioned condition; and 3)
The applicant shall locate the mobile home no closer than 27 . 5
feet from the center of Bull Canal.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of Thomas
C. and Connie L. McAveney for permission to place a mobile home to
be used as a principal dwelling on the above described parcel of
land, which was found to be in compliance with Section 43 of the
Weld County Zoning Ordinance, be, and hereby is, granted subject
to the hereinabove listed conditions.

Location: Less than two (2) miles east of Firestone; north of Weld County
Road 18 and west of Weld County Road 19.
The Department of Planning Services staff has reviewed this request and
recommends that the request be approved for the following reasons:
WILL WILL NOT
X Be compatible with the Weld County Comprehensive
Plan.
X Be compatible with the surrounding area.
X Be in harmony with the character of the
neighborhood.
X Adversely affect the immediate area.
X Be adequately served by water and sewage disposal
facilities.
X Adversely affect the general health, safety and
welfare of the inhabitants of the area and the
County.
COMMENTS:
The Department of Planning Services has received two objections to this
request.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant applying for a building permit for the mobile home within
thirty (30) days from the date of approval by the Board of County
Commissioners.
2. The mobile home shall not be occupied until such time that the
applicant has complied with Condition 1 above.
3. The applicant shall locate the mobile home no closer than 27.5 feet
from the center of Bull. Canal.

COMMENTS:

easements on the property to accommodate gas pipelines, an oil well and
storage tank. Stanley Ditch runs across the site from west to east. There
are 4 residences within 1/4 mile.

Due to the fact that the Tri-Area Planning Commission was not
notified or did not receive any information to officially discuss
this issue we , therefore , do not recommend approval .

Dear Sirs:
We have received a letter regarding "surrounding Prot 3tt tommissiod,
referencing case #ZPMH-1000 and are unable to attend "fie �Ciearig
April 17th regarding this matter.
We, Gilbert C. Evans and Diana L. Evans would like to go on record
for this hearing as opposed to the issuance of the permit for the
following reasons:
1. Mobile Homes are not common to the area. The area consists
of single family farms of standard type construction and
no mobile homes.
2. Weld County planning regulations require at least 180 acres
dry land or 80 acres irrigated land to issue a permit to
construct a home unless there is a "recorded exemption"
on the parcel, and we are unaware of an exemption being
issued on the proposed parcel referenced.
3. The application for permit did not proceed through proper
regulations since it was not presented before the TRI-TOWN
PLANNING COMMISSION" as required for an application within
a 3 mile radius of the TRI-TOWN area.
4 . A Mobile Home is considered a "TEUPOnARY" type of housing
and if a permit should be issued for this type of housing
restrictions should be put within this permit regarding
length of time this type of housing can be used or requiring
foundation, etc.
5. We feel that this permit should not be issued based on agri-
cultural needs as the parcel is plowed ground with no pasture
and only produced $190.00 in income from wheat in 1984, thus
not justifying sufficient income potential to support an
agricultural operation.
6. Thomas C. and Connie L. McAveney are utilizing the property
as a "hobby farm", a use not consistant with the area, and
a use inconsistent with the zoning (agricultural) of the
area.
7. We feel that issuing a permit for this mobile home voilates
the basic WELD COUNTY PLANNING GOALS. A permit
uld be
in basic disregard for the purpose that the regulations were
outlined for - to provide for controlled growth and not
random, uncontrolled sub-dividing.

8. The petitioners have expressed their intentions to locate
two (2) mobile homes on the parcel. The 2nd mobile will
be the residence of Connie McAveney's parents who assisted
Thomas and Connie McAveney with the purchase of the property
and have an interest in the property.
We feel the above reasons outlined are sufficient to deny the zoning
permit for the mobile home and request the Weld County Board of County
Commissioners to deny this request on this basis.
We await your reply in regard to this matter.
