No oU 0 O BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD u COUNTY, COLORADO, THAT PORTIONS OF ORDINANCES NUMBERS 118-G AND • 118-H ARE AMENDED OR DELETED AS FOLLOWS: a O r� O3 o x WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado Statute and the Weld County Home o Rule Charter, it is vested with the authority of administering the ✓ affairs of Weld County, Colorado, and w re) g4 WHEREAS , the Board of County Commissioners has the power and o authority under the Weld County Home Rule Charter and the Colorado rIZ County Home Rule Powers Act, Article 35 of Title 30 , C.R.S . , as aamended, and in specific, under Section 30-35-201 (7) , C .R.S. , as m o amended , to adopt by Ordinance, personnel policy rules and z regulations for the County of Weld, and O WHEREAS, Weld County Ordinances Numbers 118-C and 118-H, the c)(1) Weld County Personnel Policy Handbook, as amended, became W effective on March 29 , 1988 , and on June 27 , 1988 , respectively, • c4 and Low • Z WHEREAS, the Board of County Commissioners of Weld County N hereby finds and determines that there is a need to amend and delete certain portions of Weld County Ordinances Numbers 118-G w iZ and 118-H, the Weld County Personnel Policy Handbook, as amended, and that such amendments to and deletions from said Ordinances are d 0 for the benefit of the health, safety, and welfare of the people M Lo of Weld County. • r-1 �H q Cu NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Weld County, Colorado, that the following portions of Weld County Ordinances Numbers 118-G and 118-H, the Weld County Personnel Policy Handbook , as amended, are amended or deleted as follows: Amend paragraphs "D. " and "F. " in the Section entitled "Jobs Programs" and found on page 11 of said Handbook, to read as follows : "D. Employment Services of Weld County - The Weld County Department of Human Resources places people /' 891476 Page 2 ORDINANCE 118-I O o u in various programs including in-school and summer youth, diversion or welfare diversion, etc. " N O U "E. Useful Public Service - This program is limited to a individuals required to perform useful public o rAl service in lieu of some other penalty. " voiw Add the following paragraph in the section entitled "Exempt Positions" and found on page 13 of said Handbook: 0 M a "H. The District Attorney for the Nineteenth Judicial District and any and all assistants, deputies, and other employees of said District Attorney. " r-+ x Add the following paragraphs entitled "Drug-Free Workplace" on a J page 13 of said Handbook, after the section entitled "Sexual Harassment. " z H ral DRUG-FREE WORKPLACE k o to In accordance with the DRUG-FREE WORKPLACE ACT OF 1988 , Weld County as a federal grant recipient is w crA required to certify to the granting agency that it will z ensure a drug-free workplace. Failure to comply with this requirement could result in suspension of the grant o payments or termination of the grant payments or both. u a This requirement presents both a necessity and an opportunity to take immediate action to eliminate drug abuse from the workplace. To that end, the following en k.o policy is effective immediately. N N i STATEMENT OF POLICY: mw It is the policy of Weld County to prohibit the unlawful manufacture , distribution, dispensation, possession, or use of a controlled substance during duty hours or on County premises or other work sites where employees may be assigned. Further prohibited is the use, sale, possession, distribution, dispensation, manufacture, or transfer of controlled substances during non-working time to the extent such use impairs an employee ' s ability to perform his/her job or where such use , sale, possession, distribution, manufacture, or transfer affects the reputation of Weld County to the general public or threatens its integrity. Page 3 ORDINANCE 118-I Any employee found in violation of the above-stated policy will be subject to disciplinary action, up to and including termination for a first offense. N- o o o Excluded are prescribed drugs when used in the en o manner, combination and quantity intended, unless job performance could be affected. Employees who must use A an over-the-counter or prescription drug that causes o adverse side effects or may affect their ability to perform work in a safe and productive manner must notify o x his or her supervisor prior to starting work. The `er Exl supervisor or manager, after proper inquiry, will decide 0 if the employee can remain at work and what work restrictions , if any, are deemed necessary. n ^ n Compliance with the above-stated policy is a condition of employment for all employees of Weld County. Further, any employee who is convicted under a a a criminal drug statute for a violation occurring in the mu workplace or who pleads guilty or nolo contendere to z such charges must notify the County within five (5) days w of such conviction or plea . Failure to do so will %DP result in disciplinary action, including termination 0m from employment for a first offense. Employees .y, ] convicted or who plead guilty or nolo contendere to such N• w drug-related violations are subject to termination and/or mandatory attendance and successful completion of • z a drug abuse assistance or similar program as a cv condition of continued employment. u a Change paragraph "P. " in the Section entitled "Conduct" found on page 14 of said Handbook to paragraph "Q. " d' N N ti Amend paragraph "C. " in the Section entitled "Conduct" and found on page 14 to state as follows : Qw "C,. Using, possessing, or selling alcohol or other intoxicants, or controlled substances during duty hours or on County premises or other work sites where employees may be assigned , or using, possessing, or selling alcohol or other intoxicants, or controlled substances during non-working time in a manner and to an extent which impairs an employee ' s ability to perform his/her job or which affects the reputation of Weld County to the general public or threatens its integrity. " Page 4 ORDINANCE 118-I Add the following new paragraph "P. " in the section entitled o u "Conduct" and found on page 14 of said handbook: v o "P. Loss or suspension of driving privileges in those positions that require a valid driver' s license. " ca 0 3 Delete all of the third full paragraph found on page 22 of said Handbook and add the following: orz "In those positions requiring a driver' s license, an p employee may be suspended without pay upon knowledge by Weld County of an incident in which the license may be en x revoked or suspended. If the employee ' s license is not revoked or suspended, the employee may receive back pay. o If the license is suspended or revoked for any period, upon administrative hearing or upon conviction of a ma traffic offense or if the employee is determined by the mu Board of County Commissioners to be uninsurable, the w z employee will be terminated. " o H • W WE Amend the second full paragraph in the section entitled "Reporting z of Injuries" and found on page 34 of said Handbook to state the d a following: w "To be eligible for worker' s compensation benefits, an °D z employee must be examined and treated initially by the cv < established Weld County Worker' s Compensation primary o > medical care facilities. These medical facilities will w g be designated under separate cover and posted in all work areas. An injured employee should inform the even provider that the billing for the treatment should be N ° submitted to the Weld County Worker' s Compensation Fund. The supervisor will complete an Accident Investigation w w Report and the injured employee will be required to sign it. The Employer' s First Report of Accident form must be submitted to Personnel within 24 hours of the accident. The Accident Investigation Report must be submitted to the Personnel Office within 48 hours of the accident. " Delete all of the section entitled "Alcohol and Drug Abuse" and found on page 35 of said Handbook. Amend the first paragraph in the section entitled "Educational Assistance" and found on page 36 of said Handbook to state the following: Page 5 ORDINANCE 118-I "Weld County will reimburse an employee for tuition expenses up to $90 . 00 per term (quarter/semester) for job related r o courses that have been approved in advance. Funds for this o program are limited to the amount budgeted each year by the County Commissioners . For this reason, reimbursement is on a first come , first serve basis , and must be approved in advance to commit funds to an employee . For an employee to o w receive such reimbursement, the following conditions must be O3 met: " o a Delete all of the paragraphs under the section "Key Elements of o the Pay-for-Performance System" and found on page 45 of said • handbook, and add the following: II a "KEY ELEMENTS OF THE PAY-FOR-PERFORMANCE SYSTEM - Key o a elements of the step approach include: r4 - Five performance levels for employees (entry, qualified, al m v proficient, third-year proficient, and fifth-year proficient) . z H �� - Appraisals to be completed at predetermined time-frames. " om Amend the section entitled "Grandfathering" on page 45 of said • w Handbook to state the following: 0 G. co 2 "GRANDFATHERING - The basic assumption was that no N 4 County employee would receive a decrease in pay due to o conversion to the Pay-for-Performance System. aTherefore , upon conversion, any employee whose base salary was above the job rate was allowed to retain that d base salary upon conversion December 16 , 1982 . The CO LD Board will address grandfathered employees ' pay adjustments annually. " w w Amend the section entitled "E. Special : " found on page 51 of said Handbook to state the following: "E. Special: Special evaluations can be done for praise or reprimand at the discretion of the department head/elected official. " Delete the sections entitled "Pay-for-Performance, " "Bonus Award Elements, " "Procedural Steps for Bonus Award, " and "Bonus Awards for Small Departments" all found on pages 52 , 53 , and 54 of said Handbook. Page 6 ORDINANCE 118-I Amend the first full sentence in the section entitled "Group NO Health Insurance" and found on page 56 of said Handbook to state o `� the following: "Group Health Insurance: All full-time employees are offered comprehensive major o w medical health insurance at the o 3 current deduction rate for o x single or dependent coverage t wn designated by the employee. " Amend paragraph "A. " in the Section entitled "Retirement" and oia found on page 64 of said Handbook to state the following: 0 oLa "A. The employee must call the Personnel Department to '-' schedule an appointment to fill out required forms for retirement. Retirements are effective on the first day of the month following the last day worked. " row Amend the term "Hourly Employees" under the section "General Definitions" and found on page 65 of said Handbook to state the following: "Hourly Employees: Hourly employees do not receive, nor are they eligible for, any County benefits . They are paid for hours worked only. " BE IT FURTHER ORDAINED that this Ordinance 118-I shall become effective 5 days after its final public notice, as provided by Section 3-14 (2) of the Weld County Home Rule Charter.
