HomeMy WebLinkAbout890447.tiff RESOLUTION RE: APPROVE PARTIAL RELEASE OF DEED OF TRUST FOR PARKLAND HOMEOWNERS ASSOCIATION, INC. , AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on October 17 , 1984 , the Board of County Commissioners approved a Deed of Trust for Parkland Estates, said document being recorded at Book 1049 , Reception No. 1988865 , of the records of the Weld County Clerk and Recorder, and WHEREAS, the Board has been presented with a request from Parkland Homeowners Association, Inc. , for a Partial Release of Deed of Trust for Lot 1 , Block 1 , Parkland Estates, and WHEREAS, after review the Board deems it advisable to approve said Partial Release, a copy being attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Partial Release of Deed of Trust for Parkland Homeowners Association, Inc. , concerning Lot 1, Block 1 , Parkland Estates, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign said Partial Release and any other necessary documents concerning this matter. Barker, Assistant County Attorney subject: Purchase of Lot 1 , Block 1 , Parkland Estates On May 18 , 1989 , I received a letter from Jack Henderson on behalf of Parkland Estates. Mr. Henderson' s letter stated that the Parkland Homeowners Association had entered into a contract to sell Lot 1 , Block 1 , Parkland Estates, to Robert M. Mesaros. The letter asked for a partial release of the Deed of Trust for that lot. On May 24 , 1989 , I had the Board of County Commissioners authorize the Chairman' s signature on the release of the Deed of Trust. I then held on to it with the idea that Mr. Henderson would be contacting me for a closing date. I received a telephone call from Mr. Henderson on May 30 , 1989 . He stated that the contract for the sale of the lot had fallen through. Apparently Mr. Mesaros wanted to purchase a different lot. I decided to wait thirty (30) days before asking the Board to rescind the Resolution which authorized the release of the Deed of Trust. I asked Mary Reiff not to record the Resolution and release until I was absolutely certain that the sale would not indeed take place. On Monday, July 10 , 1989 , the Board of County Commissioners rescinded the Resolution dated May 24 , 1989 . Thus, the release of the Deed of Trust is void and Lot 1 , Block 1 , is still in the Deed of Trust. C r� uce T. O COLORADO June 17, 1988 Mark Williams Secretary/Treasurer Parkland Homeowner's Association 4732 Sylvia Lane Erie, Colorado 80516 Dear Mr. Williams: As indicated in my letter of December 22, 1987, the Weld County Engineering Department inspected RUE-de-TRUST prior to accepting it for maintenance. During the visual inspection, a large, heavily aligatored area was found, as well as, several stretches along the edge of the pavement that were badly broken. Inspection of the area that was aligatored showed the pavement thickness to be less than one inch. The minimum paving thickness called for in the plans is two inches. Four cores have been taken of the asphalt at different locations along RUE-de-TRUST. The thicknesses were: 2 1/4", 2", 1 1/2", and 1". Based on the fact the road shows severe distress in less than two years, and the cores taken by Weld County show pavement thicknesses less than required, I cannot recommend to the Board of Weld County Commissioners that they accept maintenance of RUE-de-TRUST. Since the paving thicknesses are not consistent, and since we have found pavement one inch thick, I see only one way to correct the problem. All the distressed areas should be excavated and repaired by placing the eight inches of base course and two inches of pavement called for in the plans.
