HomeMy WebLinkAbout860247.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT NO. 1138 - DONALD AND DELORES HORTON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 5th day of March, 1986 , considered the request of Donald and Delores Horton for a mobile home to be used as a principal dwelling, and WHEREAS, said mobile home is to be occupied in an A-Agricultural Zone District on a parcel of land being more particularly described as the 51 NW', Nh SWa, and part o₹ the 5' 5W4, Section 4 , Township 7 North, Range 58 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the Board of County Commissioners , having heard the testimony, finds that said request should be granted subject to the following condition: 1) Within thirty days from the date of approval by the Board of County Commissioners , the applicant shall apply for a new well permit to replace the expired well permit. One mobile home would serve as the principal residence for Mr. ana Mrs. Donald Horton, and the other a temporary residence for Mr. Dave Horton who must maintain his residence nearby due to health reasons. 'Both mobile homes would share a well (permit no. 100811) . Our records show that well permit no. 100811 expired on August 8, 1980. It appears the permit expired due to the lack of a well log report being filed by the expiration date. As long as there are no other wells on the 35 acres designated in well permit 100811 , the applicants could apply and obtain a new domestic well permit for the well which allows the proposed use. Interest, benefit and equity of redemption of the part i e S of the first part, their heirs and assigns therein and shall recite the sum or sums for which the said property was sold and shall refer to the power of sale therein contained, and to the sale or sales made by virtue thereof; and in ease of an assignment of such certificate or certificates of purchase, or in ease of the redemption of such property, by a subsequent encumbrancer, such assignment or redemption shall also be referred to in such deed or deeds: but the notice of sale need not be set out in such deed or deeds: and the said Public Trustee shall, out of the proceeds or avails of such sale, after tint paying and retainingaill fees, charges and costa of making said sale, pay to the beneficiary hereunder or the legal holder of said note---the principal and interest due on said not.——according to the tenor and effect thereof, and all moneys advanced by each beneficiary or legal holder of said note--—for Insurance, taxes and assessments, with interest thereon at—1-2—per cent per annum. renderings the ovetoias, if any,unto the said part i e a the first part•the i kgai representatives or assigns; which sale or sales and said deed or deeds so made shall be a perpetual bar, both in law and equity, against the said part l e S of the first part, their--- heirs and assigns. and au other persons claiming the said property. or any part thereof, by, from. through or under said parti e S— of the first part. or any of them. The holder or holders of said note or notes may purchase said property or any part thereof; and it shall not be obligatory upon the purchaser or purchasers at any such sale to see to the application of the purchase money.
