RE: APPROVE USE BY SPECIAL REVIEW FOR A CHURCH IN AN AREA ZONED
R-1 (LOW DENSITY RESIDENTIAL) - CHRIST' S CHRISTIAN CHURCH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute -and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 13th day of May, 1987 , at the hour of 2: 00 p.m. in
the Chambers of the Board for the purpose of hearing the
application of Christ' s Christian Church, c/o Howard Dillon, 20816
Northmoor Drive , Johnstown , Colorado 80534 , for a Use by Special
Review for a church in an area zoned R-1 (Low Density -Residential)
on the following described real estate, to-wit:
Part of lot 7 of the SEa SW4, Section 9 ,
Township 5 North , Range 65 West of the 6th
B.M. , Weld County, Colorado
WHEREAS , said applicant was represented by Gerald McRae,
Engineer, and Howard Dillon, Elder, and
WHEREAS , Section 24. 4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and , having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Weld County
Comprehensive Plan in that it permits urban
development in or adjacent to existing
-municipalities and in accordance with the
municipalities ' adopted comprehensive plans , goals,
and policies .

b. The proposed use is consistent with the intent of
the R-1 (Low Dens-ity Residential) District. The
R-1 District is intended to accommodate
non-residential land uses that are both accessory
to and compatible with the surrounding land uses .
The proposed use is permitted as a Use by Special
Review in the R-1 Zone District.
c. The use es proposed will be compatible with future
development as projected by the Weld County and the
City of Greeley Comprehensive Plans.
d. No overlay districts affect the site.
e. Use by Special Review Development Standards will
provide adequate protection of the health, safety
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for on the hereinabove described parcel of
land be, and hereby is , granted subject to the following
conditions:
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the use
by Special Review plat prior to recording the plat.
2. The Use by Special Review activity shall not occur nor
shall any building or electrical permits be issued on
the property until the Use by Special Review plat has
been delivered to the Department of Planning Services
Office and the plat is ready to be recorded -in the
office of the Weld County Clerk and Recorder.
3. Prior to the approval of building permits for
construction of the church, the applicant shall submit a
satisfactory storm water drainage and management plan to
the Department of Planning Services.

DEVELOPMENT STANDARDS
Christ' s Christian Church
USR-785: 87: 10
1. The Use by Special Review permit is for a church in an area
zoned R-i (Low Density Residential) as submitted in the
application materials on file in the Department of Planning
Services and subject to the Development Standards stated
herein.
2. The area designated as landscaping -on the property shall not
be less than 25% of the total site.
3 . Landscaping materials shall be utilized as a buffer south,
west, and east of the building site.
4 . The western edge of the parking area site shall be fenced or
landscaped.
5. The parking lot shall not be located within 15 feet of the
future right-of-way of Balsam Avenue.
6 . Any substantial parking expansion shall be reviewed by the
City of Greeley.
7. All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
8. The property owner or operator shall be responsible for
complying with the Design Standards of Section 24. 5 of the
Weld County Zoning Ordinance.
9. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24. 6 of the
Weld County Zoning Ordinance.
10 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations .

11 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations . Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services .
12. The property owner or operator shall be responsible for
complying with all of the foregoing Standards . Noncompliance
with any of the foregoing Standards may be rea-son for
revocation of the permit by the Board of County
Commissioners.

A public hearing was conducted on May 13, 1987, at 2:00 P.M. , with the
following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 29, 1987, and
duly published April 30, 1987, in the Johnstown Breeze, a public
hearing was conducted to consider the request of Christ's Christian
Church for a Use by Special Review for a church in an area zoned R-1
(Low Density Residential) . Lee Morrision, Assistant County Attorney,
made this matter of record. Rod Allison, Planning Department
representative, read the favorable recommendation of the Planning
Commission, which is subject to two Conditions and twelve Development
Standards, into the record. Jerry McRae, engineer, came forward to
represent the applicant. He stated that the church has no problem with
the proposed Development Standards. Howard Dillon, an elder of the
church, also came forward to answer questions of the Board. Jack
Fetig, a nearby property owner, explained to the Board that this parcel
of ground lies in a low area and, during the irrigation season, it is
under water. He asked questions concerning the advisability of
allowing the proposed church to operate on a septic system, the access
to the property, and the proposed parking. Mr. Allison explained that
any septic system will have to be approved by the Weld County Health
Department. Mr. McRae stated that the building will be adequately
elevated and there will be one access from Balsam Avenue. Mr. Dillon
responded that the parking lot will initially be gravel, and paved as
funds become available. Viola White, owner of adjacent property, made
comments concerning the water situation and expressed that she is
unhappy about the proposed use of a septic system on this parcel,
stating that their property is on the City of Greeley sewer system.
Considerable discussion centered around the problem of water drainage
in the area. (Tape Change #87-35) Commissioner Kirby moved to approve
the request for a Use by Special Review, subject to the Conditions and
Development Standards proposed by the Planning Commission, with the
addition of a Condition requiring that a satisfactory drainage plan be
presented and approved before any building permits are granted. The
motion was seconded by Commissioner Johnson and carried unanimously.
REPLAT OF LOT 7, UNION COLONY, WELD COUNTY, COLORADO - ELLIOTT &
ELLIOTT, INC: (This matter was heard in conjunction with the above
hearing.) Prior to the Use by Special Review hearing, the Board
considered this request from Elliott and Elliott, Inc. for the replat
of part of Lot 7, Union Colony. Mr. Allison read the favorable
recommendation of the Planning Commission, which is subject to three
Conditions, into the record. Mr. McRae represented the applicant, and
stated that this replat, creating the Elliott East Subdivision, creates
two parcels, with the smaller parcel being the proposed church site.
No public comment was made concerning this request. Commissioner
Brantner moved to approve the request for this replat, subject to the
Conditions recommended by the Planning Commission. The motion,
seconded by Commissioner Johnson, carried unanimously.

LOCATION: Approximately .5 miles east of Greeley; north of 20th Street and
west of Balsam Avenue
APPEARANCE:
Jerry McRae, P.E., McRae and Short, Inc. , represented the applicant. The
church will be a one story building with a full basement. The plans for
this are not yet final.
Howard Dillon, Board Member, Christ's Christian Church, stated the building
will be less 1,500 square feet or else they will have to install an
automatic sprinkler system. He met with the Planning Department last
Tuesday and twenty-five percent of the land will be landscaped.

LOCATION: Approximately one mile east of the Town of Frederick
APPEARANCE:
Fred Hamilton, applicant, stated they plan to use the structures that are
already on the property and do not intend to do any further building. Their
business has grown larger than they had originally intended to. They do
park some trailers and tractors on the property. An existing house is used
as an office, and one house is a residence. The repairs are done at a
garage in Commerce City. There are several gas plants in the area with
heavy truck traffic. They haul food products, potatoes, onion, processed
meat, etc. He has 16 tractors and 25 trailers licensed in the State of
Colorado. Six trucks are owner operated and not owned by him. Under ICC
laws any truck leased by him must be licensed by him. He owns eleven trucks
and most are not parked on this property.

This is a forty acre parcel of land and he has had tractor and trailer
combinations on this property for about twelve years. They do not want to
go to a metropolitan area because their office and residence are here and it
makes it easy and convenient to operate their business. The premises are
neat and clean. His ICC license does not allow him to haul any hazardous
materials. There are a total of sixteen employees with his partner who is
half owner of the business. The maximum number of tractors he expects to
have is fourteen and the maximum number of trailers is twenty-eight. They
do not haul live animals nor do they intend to have any livestock on the
property. They intend to tear down the corrals to allow fcr additional
parking. They have a five hundred gallon underground oil storage tank for
used oil and they will comply with the recommendations of the Weld County
Health Department.

3.A. (Continued).
All objections to a church building have been given an opportunity for expression
and a general attitude of approval by surrounding neighbors is quite obvious.
B. While the area is mainly agricultural , we would be providing Bible training
just as the East Memorial School is providing education.
C. It is quite obvious we can't farm corn and also provide spiritual facilities on
one acre.
D. The building would meet Weld County Code for public use buildings.
E. The prcposed church will be compatible with the elementary school . The small
size of the church will be compatible with the surrounding residences.
F. Future development of the area will see an increase in residential density and
associated uses. Balsam Avenue has been designated as a future arterial street
and 20th Street is anticipated to be a collector street.
G. The site does not lie in any known Flood Plain, Geological Hazard or Overlay
District.
H. Water supply: Letter attached.

The group known as Christ 's Christian Church branched off
the Greeley Christian Church and for the last three and
one-half years has been renting the basement facilities of
the Seventh Day Adventist Church . In a sense , we are a
pioneering group in that we have no paid ministry or clergy
and the self supporting Elders do the preaching and act as
Pastors .
One-half of the offerings are divided among missionary
groups; Cookson Hills Christian Ministries, Campus Ministry
4 in Greeley and Fort Collins , Women's Place ( for battered
women ) and Bill Lofts in the Dominican Republic . The other
one-half goes for current expenses, rent , and a building
fund which now amounts to about $26 , 000 .
We do not feel that we are realizing our greatest potential
3 as there are at least six churches within a half mile of
our present location . We surveyed outlying areas without
church facilities or programs . It was decided to hold a
' trial ' Daily Vacation Bible School in East Greeley . We
rented the East Memorial School building for the school
last July . After getting favorable response by the area
children from the nearby housing, we approached the School
Board for permission to rent the school building for
regular Worship Services. We were informed that this could
be arranged provided we were in the process of building our
own building. The rent would be nearly double our present
rent and would be limited to two hours on Sunday morning.

With this , we started looking for suitable land. The Twin
Rivers Realty agreed to sell the Church one acre at the
corner of East 20th and Balsam. We then asked Mr . Fred
Otis, lawyer , to check the property and we were told that
our proposed protect was ' feasible' in regards to zoning,
area and subdividing regulations . He directed us to McCrae
& Short for survey , re-plat and necessary paperwork
required by the Planning Commission and later by the
Special Use Committee .
We are trying to avoid any pre-conceived notions as to what
is the Lord' s will in regard to our present endeavor . We
are moving ahead with this protect in obedience to the
Great Commission of Jesus. Even the Apostle Paul had a
change of plans when He wanted to go and preach in Bithynia
but was directed to Macedonia (Acts 16 : 7) .
If our present plan for a building lot is rejected, the
contingency clause of the counter proposel will cancel all
groundwork up to date . In this case we will have no choice
but to shoulder our financial loss and keep looking for our
'Macedonia' .
