RE: APPROVE EXTENSION OF TERMINATION DATE OF CERTAIN PEST CONTROL
DISTRICTS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, petitions were presented to the Board of County
Commissioners requesting an extension of the termination date of
certain pest control districts , which presently expire December
31 , 1987 , and
WHEREAS, a hearing was held before the Board on the 14th day
of December, 1987 , at 9 : 30 a.m. , concerning the extension of said
termination dates for the following pest control districts located
in Weld County, Colorado, to-wit:
Eaton-Ault Pest Control District
Platte Valley Pest Control District
Southeast Weld Pest Control District
WHEREAS , it was determined by the Board, after hearing the
evidence presented, that it is in the best interest of Weld County
to extend the termination date for each of the above named pest
control districts to December 31 , 1992 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that pursuant to Section
35-5-104 (7) , CRS, the termination date of the above named pest
control districts in Weld County be, and hereby are, extended from
December 31 , 1987 , to December 31 , 1992 .

A public hearing was conducted on December 16, 1987, at 9:30 A.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 2, 1987, and
duly published December 3, 1987, in the Johnstown Breeze, a public
hearing was conducted to consider the petitions for extension of
termination dates for the Eaton-Ault; Platte Valley; and Southeast Weld
Pest Control Districts. Tom David, County Attorney, made this matter
of record, and stated that the petitions request that the termination
date of the above named districts be extended from December 31, 1987,
through December 31, 1992. David Kreps, representing the Eaton-Ault
Pest Control District, and Clyde Abbett, representing the Platte Valley
Pest Control District, came forward to offer comments concerning this
matter. Ron Broda, representing the Extension Service, also made
comments. Commissioner Kirby moved to approve the extension of the
termination date to December 31, 1992, for the Eaton-Ault; Platte
Valley; and Southeast Weld Pest Control Districts. Commissioner
Yamaguchi seconded the motion and it carried unanimously.
This Certification was approved on the 16th day of December, 1987.

Pursuant to Section 35-5-104 (7) , Colorado Revised Statutes, as
amended, notice is hereby given that a hearing will be held before
the Board of County Commissioners of Weld County, Colorado, on the
14th day of December, 1987 , at or about 9 :30 A.M. , in the First
Floor Hearing Room, Weld County Centennial Center, 915 10th
Street, Greeley, Colorado, at which time the Board will hear the
evidence upon the petitions presented by the Advisory Committees
for the Eaton-Ault Pest Control District; Platte Valley Pest
Control District; and Southeast Weld Pest Control District. The
petitions request extension of the termination date for the above
named districts beyond December 31 , 1987.
All interested persons should appear at said hearing and give
testimony as to whether or not the termination dates should be
extended.

RE: SET HEARING DATE TO CONSIDER PETITIONS FROM VARIOUS PEST
CONTROL DISTRICTS TO EXTEND THEIR TERMINATION DATES
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board has received petitions from three pest
control districts requesting that a public hearing be held to
determine if the termination date should be extended, said
districts are:
Platte Valley Pest Control District
Eaton-Ault Pest Control District
Southeast Weld Pest Control District

Subject:
The Board has received petitions for the extension of termination
dates from three Pest Control Districts. The Districts are:
Platte Valley, Eaton-Ault, and Southeast Weld. The current
termination date for each of the Districts is December 31 , 1987.
The Board is to set a hearing to consider the petitions . We would
recommend that this hearing be scheduled for Monday, December 14 ,
at 9 :30 A.M.

Extension of Termination Dates for Pest

The Board has received written petitions for the extension of the
termination dates from three different pest control districts .
Those districts include: The Platte Valley, Eaton-Ault, and
Southeast Weld Pest Control Districts. The current termination
dates for each of these districts is December 31 , 1987.
Section 35-5-104 (7) , C.R.S. , states that the District Advisory
Committees for pest control districts may petition the Board of
County Commissioners and request extensions of the termination
dates for the districts. The Board then sets a hearing on the
extensions and publishes notice of the hearing at least ten (10)
days and no more than thirty (30) days prior to the hearing.
In order to extend the termination dates for the districts, the
Board must determine that such extensions are advisable and are
needed for adequate pest control in the districts . The statute
does not list anything more that the Board must find, nor does it
say what is "advisable and needed for adequate pest control. " I
would suggest that the Board determine whether the insects and
weeds for which the districts were established to eliminate are
still present within the districts and need to be controlled. I
will ask Ron Broda to supply the Board with a list of the pests
which each district was established to eliminate and to state
which of those pests are still within the district and are likely
to be present over the next few years.
Section 35-5-104 , C.R.S. , does not put a time limit on any
extension of the district termination date. In the past, the
Board has extended the termination dates of various other
districts by five (5) years at a time. Ron and I would suggest
that the Board extend the termination dates for each of the
districts by five (5) years. Thus, the termination dates for each
of these districts will be extended to December 31 , 1992 .

Dear Weld County Commissioners,
There are three (3) Pest District Advisory Boards that have
petitioned to extend the termination dates of their pest control
districts. The Districts that will terminate on December 31, 1987,
are: Platte Valley, Eaton-Ault, and Southeast Weld Pest Control
Districts.
The Pest Districts were originally established to control Canada
Thistle, Field Bindweed, Leafy Spurge and Russian Knapweed. In 1986,
Musk and Bull Thistle and Whitetop were added to the Southeast Weld
Pest District and Whitetop and Wild Proso Millet were added to the
Eaton-Ault District.
Over the past few years the Pest and Weed Department has gained
ground in getting control of these weeds; however, much more work is
needed. I would request that the County Commissioners consider
extending the termination date of these districts.
