RE: APPROVE CONTINUANCE OF HEARING TO CONSIDER REQUEST OF ERIE
ROAD JOINT VENTURE FOR A USE BY SPECIAL REVIEW FOP AUTO
SALVAGE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 14th day of October, 1987 , at the hour of 2 : 00 p.m.
in the Chambers of the Board for the purpose of considering the
request of Erie Road Joint Venture for a Use by Special Review for
auto salvage, and
WHEREAS, the Board was advised that Robert Marx, Managing
Venturer for Erie Road Joint Venture , had submitted a request that
said hearing be continued to further pursue annexation of the
subject parcel into the Town of Erie , and
WHEREAS , after consideration, the Board deemed it advisable
to continue said hearing to April 13 , 1988 , at 2 : 00 p.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to
consider the request of Erie Road Joint Venture for a Use by
Special Review for auto salvage be , and hereby is , continued to
April 13 , 1988 , at 2 : 00 p.m.
BE IT FURTHER RESOLVED by the Board that the applicant shall
be advised that no further requests to continue this hearing shall
be granted.

RE: USE BY SPECIAL REVIEW FOR AUTO SALVAGE - ERIE ROAD JOINT VENTURE
A public hearing was conducted on October 14, 1987, at 2:00 P.M. , with
the following present:
Commissioner Gordon E. Lacy, Chairman
Commissioner C.W. Kirby, Pro-Tem
Commissioner Gene Brantner
Commissioner Jacqueline Johnson
Commissioner Frank Yamaguchi
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Planning Department representative, Brian Bingle
The following business was transacted:
I hereby certify that pursuant to a notice dated June 15, 1987, and
duly published June 18, 1987, in the Johnstown Breeze, a public hearing
was conducted to consider the request of Erie Road JointVenture for a
Use by Special Review for auto salvage. Lee Morrison, Assistant County
Attorney, made this matter of record and stated that this hearing was
continued from July 1 , 1987. Brian Bingle, representing the Planning
Department, read a letter into the record from the applicant requesting
a six-month continuance of this hearing. Commissioner Kirby moved to
continue this hearing to April 13, 1988, at 2:00 p.m. Commissioner
Brantner seconded the motion which carried unanimously. Following
comments from members of the audience, Commissioner Kirby moved to
reconsider his earlier motion. The motion was seconded by Commissioner
Brantner and carried unanimously. Chairman Lacy asked those members of
the audience wishing to make public testimony to confine their comments
to the request for a continuance. Those who came forward to speak in
opposition to continuing the hearing were: George Ruff; John Cleland;
Nancy Sullivan; and Gary Cleland. The applicant was neither present
nor represented. Chairman Lacy informed those present that it would
not be proper procedure to proceed with this hearing because the
applicant was neither present nor represented. Commissioner Johnson
stated that she does not like delay in hearings, but the Board's policy
is that the applicant be present, and she asked for audience input
regarding the length of time of the continuance. Those speaking
earlier stated that they did not care how long the continuance is; they
do not want this matter to be continued again. Commissioner Kirby
moved to continue this hearing to April 13, 1988, at 2:00 p.m. and
asked that the applicant be advised that this matter will not be
continued again. The motion was seconded by Commissioner Johnson and
carried unanimously.
