RE: APPROVE DISMISSAL OF SHOW CAUSE HEARING TO CONSIDER
REVOCATION OF SPECIAL USE PERMIT #454 ISSUED TO WELD COUNTY
DISPOSAL, INC.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on July 12 , 1989 , a Show Cause Hearing was conducted
to consider revocation of Special Use Permit #454 , issued to Weld
County Disposal, Inc. , due to alleged violations of Development
Standards 4 and 5 of said Special Use Permit, and
WHEREAS, the testimony presented at said hearing indicated
that the facility is no longer in violation of those Development
Standards under consideration, and
WHEREAS , the Board deems it advisable to dismiss said Show
Cause Hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Show Cause
Hearing to consider revocation of Special Use Permit #454 , issued
to Weld County Disposal , Inc. , be , and hereby is , dismissed.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 12th day of
July, A.D. , 1989 .

DISPOSAL
A public hearing was conducted on July 12, 1989, at 10:00 A.M. , with
the following present:
Commissioner C.W. Kirby, Chairman
Commissioner Jacqueline Johnson, Pro-Tem
Commissioner Gene Brantner
Commissioner George Kennedy
Commissioner Gordon E. Lacy
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Director of Planning Services, Chuck Cunliffe
Health Department representative, Wes Potter
The following business was transacted:
I hereby certify that pursuant to a notice dated May 17, 1989, and duly
published June 15, 1989, in The New News, a public hearing was
conducted to consider revocation of Special Use Permit 11454 - Oil field
fluids recycling and disposal site, issued to Weld County Disposal.
Lee Morrison, Assistant County Attorney, made this matter of record.
Chuck Cunliffe, Director of Planning Services said this hearing was
continued from June 23, 1989. He said the Department of Planning
Services recommends that this hearing be dismissed, based upon a memo
from Wes Potter, of the Health Department, stating that the facility is
now in compliance. Commissioner Lacy moved to dismiss the Show Cause
Hearing concerning SUP #454, issued to Weld County Disposal. Seconded
by Commissioner Johnson, the motion carried unanimously.
This Certification was approved on the 17th day of July, 1989.

Subwct WELD COUNTY DISPOSAL
The engineer for the facility has reported that the waste material (oil
soaked weeds and contaminated soil) has been removed from the site as of
the 5th of July. An on site inspection conducted by Lynn Robbio of this
Division confirmed that the material has been removed.
The Division finds that the facility is in compliance with the development
standards at this time and We recommend that the Show Cause action against
the facility be dismissed as discussed at the June 28, 1989 hearing.

Re: Weld County Waste Disposal YIELD C6thIII ILEUM DEPT,
Dear Wes:
This letter is being provided to inform you that the oil soaked weeds
disposed of on the southern portion of the above referenced project have
been removed.
I inspected the site today and found the material to be removed from the
site. The material was removed in accordance to the plan submitted to your
office and approved by yourself. The material and soil was delivered to the
Tower Landfill operated by BFI and approved for the disposal of this
material.
I believe this completes all the requirements discussed in the Show Cause
Hearing of June 28, 1989. Therefore, we anticipate the dismissal of the Show
Cause Hearing as the County Commissioners discussed during the last
hearing. I would like to thank you for your assistance in this matter and
hope the owner will operate the facility within the limits of the Development
Standards in the future. Please contact me if I misunderstood the
requirements and dismissal procedures discussed in the last hearing.
