RESOLUTION RE: APPROVE CONTINUANCE OF HEARING CONCERNING USE BY SPECIAL REVIEW FOR AN OPEN-CUT SAND AND GRAVEL OPERATION - FRONT RANGE SAND AND GRAVEL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on October 23 , 1985 , a hearing was conducted to consider the request of Front Range Sand and Gravel for a Use by Special Review for an open-cut sand and gravel operation, and WHEREAS, the Board, after hearing the testimony, deems it advisable to continue said hearing to November 13 , 1985 , at 2 :00 p.m. , at which time information from the State Highway Department regarding the feasibility of acceleration-deceleration lanes and information from the Platte Valley Soil Conservation District regarding the reclassification of Parcel "B" will be heard, and WHEREAS , the Board deems that it shall be the responsibility of the applicant to submit said information for the Board' s consideration, and WHEREAS, the Board deems it advisable that only testimony concerning the aforementioned issues will be heard at said hearing. Kirby - Excused Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Director of Planning Services, Chuck Cunliffe Planning Department representative, Gloria Dunn Shorthand Reporter, Valerie Antuna The following business was transacted: I hereby certify that pursuant to a notice dated September 30, 1985, and duly published October 10, 1985, in the Johnstown Breeze, a public hearing was conducted to consider a Use by Special Review for an open-cut sand and gravel operation for Front Range Sand and Gravel. Chairman Johnson explained that because only four Commissioners were present, in case of a tie vote, Bill Kirby, the absent Commissioner, would listen to the tapes, review the record, and cast the deciding vote. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, Planning Department representative, read the unfavorable recommendation of the Planning Commission into the record. This recommendation was not based upon the mining plans, but out of concern for the safety and welfare of the residents of the area due to the increased traffic on Colorado Highway 52. Jerry McRae, Engineer representing the applicant, came forward to make his presentation. At this time, Chairman Johnson noted for the record that all of the Commissioners had conducted an on-site visit of the property. Jerry Rhea, President of Front Range Sand and Gravel, made his presentation. Mr. Rhea commented on the proposed ingress and egress onto Highway 52, saying that a double width bridge will be constructed for safety factors. He said the State Highway Department had advised him that because of the vision which is offered by the proposed route, as shown on the map, decel and accel lanes will not be required. (TAPE CHANGE #85-92) Mr. Rhea concluded his presentation and answered questions of the Board regarding turning lanes and other concerns about increased truck traffic. Mr. McRae came forward to answer questions of the Board concerning the number of years this operation will be in existence. Doug Rames, Engineer for the State Department of Highways, answered questions of the Board regarding traffic on Highway 52. He said the access permit which would be issued by the State would stipulate a maximum number of vehicles per day. Glenn Salmons, Vice-President of Front Range Sand and Gravel, made comments concerning dust control. He said this is a wet operation, but water equipment will be kept on-site to help control the dust. At this time, Ted Frahm submitted a petition favoring the operation. Ms. Dunn advised the Board that the Planning staff's recommendation for denial on Parcel B was based on the fact that the Brighton Soil Conservation Service had classified this site as prime agricultural soil and the staff felt that this area should be left in farming. Mr. Salmons said the owner of the property says there are approximately 26 acres of farmable land. Gerald Dreiling, property owner, came forward to make comments. He said the Soil Conservation Service has indicated that they will re-test the soil on Parcel B and may change the classification. Bill McQueary came forward to offer Page 2 RE: CERTIFICATION - FRONT RANGE SAND AND GRAVEL comments in favor of the proposal. Those speaking in opposition were: Jay Belden; David W. Pehr, Attorney representing Alice and William Pehr, Al Dechant and Robert Wagland; Dick Hein; Franklin Zadel; Tammie Taylor; Frances Wieland; Chip Arnold; Anthony Duran; Alvin Stalder; Alvin Dechant; Tony Bueno; and Bill Pehr. Vincent Phelps, Attorney representing Freda Dreiling and Myrna Slabaszewski, made comments favoring the proposal. Jerry Rhea and Glenn Salmons made their summary statements and answered questions of the Board. (TAPE CHANGE #85-93) Doug Rames came forward to answer further questions concerning accel and decel lanes on Highway 52 from the proposed site and also changing the speed limit in this area. He said the recommendation to lower the speed limit could be submitted to the State Highway Department and they would conduct a traffic engineering study and, depending on the outcome of this study, the speed limit may or may not be lowered. Mr. Rhea again commented on the accel and decel lanes, saying he does not think they are feasible. Chairman Johnson reviewed the findings to be considered for a Use by Special Review. Mr. Morrison made comments concerning the policies in the Comprehensive Plan and the Mineral Resource Plan. (Let the record reflect that a short recess was called at this time.) Discussion followed concerning the distance of the city limits from the proposed site. Mr. Cunliffe said the closest boundary is approximately three-quarters of a mile away. Commissioner Brantner said he understood, from the letter submitted by the City of Ft. Lupton, that the site entrance was one-quarter of a mile away from the park. Pam Dickey-Kunzman said the site is one-half mile from the park. Mr. Rhea said he had measured this with a roll tape and the site entrance is 3,300 feet from the driveway of the park. Commissioner Lacy moved to approve the Use by Special Review for Front Range Sand and Gravel for an open-cut sand and gravel operation, subject to the recommended conditions and Development Standards, with the addition of Development Standards which address concerns regarding acceleration and deceleration lanes, and the reclassification of Parcel B. Commissioner Brantner seconded the motion. Following considerable discussion, Commissioner Lacy moved to continue this matter to November 13, 1985, at 2:00 p.m. , to allow the applicant time in which to contact the State Highway Department concerning the acceleration and deceleration lanes, and the Soil Conservation Services concerning the reclassification of Parcel B, with testimony concerning the aforementioned issues only to be considered on that date. The motion was seconded by Commissioner Brantner. After discussion, the motion carried unanimously. This Certification was approved on the 30th day of October, 1985. Box 8 Fort Lupton , Colorado 80621 10/22/85 To the Weld County Commissioners: I regret not being able to attend this hearing in person to voice my concerns due to my job committments My friend , Mr. Stalder was kind enough to bring this letter to you as my representative. I have some real concerns about the plans to put in the gravel pit West of Fort Lupton on Hwy 52. I hope that the commissioners will consider these concerns, as I 'm sure they have been voiced before. While I am a school bus driver, I am voicing my concerns as an individual , not as a school employee. My concerns are as follows: 1 ) Traffic: I do drive a bus on that stretch of highway , and am concerned with the volume of traffic already on it. While I as aware of the company' s plans to run as many of their trucks as they can onto highway 85, and avoid using highway 52, I am concerned about the trucks that will use highway 52 from the West. I am already concerned about the buildup of traffic volume at the intersection of 85 8 52. It is my opinion that this intersection is already over- used. 2) My next concern is safety due to the speed of traffic in that area along highway 52. I feel the speed limit is too fast for the truck traffic to enter the highway safely. The speed limit in such an area should be no greater than 40 due to the slow speed the trucks pull onto the highway at. 3) Bus safety: Even though I am expressing these concerns as a private citizen, I must state my concern for the safety of the school busses that use that portion of highway . There are at least 4 school buses that use that highway that I personally know of. They use that highway for the most part before and after school , and it has been my experience that those are high traffic volume times of day along there. I do have several stops along highway 52, and am concerned for the safety of my own passengers. 4) Landscape: While it is not a major thing, I have been offended at the way the landscape at other pits in the area have been ruined by gravel pits, namely South of Brighton. I don' t want to see our surroundings ruined by piles of gravel . I ' m sorry, but, I have too much pride in my community to stand by and let someone damage the scenery in the name of "progress" . Consulting Engineer Electrical - Mechanical FRONT RANGE SAND AND GRAVEL PROPOSED GRAVEL PLANT, FORT LUPTON , COLORADO NOISE ASSESSMENT PREPARED BY : B . HEMMAT, P. E. INTRODUTION Front Range Sand And Gravel company is proposing to construct a gravel producing plant adjacent to the South Platte River , at the intersection of U .S . Highway 85 and State Highway 52 , where river bottom deposites have been established The proposed plant is to have an initial prodution capacity of 200 , 000 tons per year , increased to 500, 000 ton annual capacity within 8 to 10 years after the start of operation . The gravel deposite is estimated to sustain the above operation for 18 years . The proposed plant machineries are to consist of drag line , screen , crusher , conveyors , feeders , front-end loaders and bulldozers . In addition , the plant will have machineries such as pumps , air compressor and trucks to provide for gravel washing process as well as other support systems such as maintanance and repairs . The above plant machineries will be operating simultaneousely during the entire operating shift . MACHINERY NOISE Like any other materials handling and processing plants , the proposed P.O. Box 231, Route 2 • Golden, Colorado 80403 • (303) 642.7561 2 gravel plant will generate machinery and operating noises .The intent of this report is to isolate and evaluate the magnitude of the anticipated noise impact associated with the proposed plant on the neighboring homesites . The noise generated by each machinery varies depending on the loading , state of maitenance and weather conditions . The rated noise level of a given machinery , published by manufacturer , is measured at a distance of 1 meter from the machinery . The actual machinery noise level perceived at locations away from the plant area , like for example inside of the property line of a nearby homeowner , can be calculated using standard noise propagation equations . In calculating the noise propagation , however , one must take into account the factors such as the near-region field effects , reflecting surfaces , etc . The noise level perceived by nearby residences located some distance away from the plant area is the primary importance in evaluating _. the noise level impact of the proposed plant operation . It is to be understood that prediction of noise impacts on the nearby residences is extremely complicated and often involves arbitary or at least highly subjective assumptions . The physical characteristics of sound and its propagation are well understood , but the number of relevent parameters and variables usually make exact calculations impossible . Moreover , even when caculations can be done , the perceived impacts and annoyance levels , will be difficult to predict . With regard to physical characteristics of sound , one can in principles calculate the expected intensities at nearby homesites if the pit noise sources are given. However , these intensities will be profoundly affected by meterorological conditions . Wind and temperature profiles can produce a considerable reduction in the topographical shielding around the gravel pit . 3 Annoyance levels are most difficult to predict . In the first place , loudness and annoyance are not synonymous . There are a great variability among subjects regarding the perceiving annoyance of a given sound . Furthermore , the degree of annoyance depends strongly upon individual attitudes toward the source of noise and its operator . In Colorado , sound levels in excess of 55 DB ( night ) is considered PRIMA FACIE evidence of a public nuisance in residential neighborhoods . However , sound levels as low as 40 DB can cause annoyance under certain circumistances . Relaxed conversation at a distance of 5 meters in a quite residential neighborhood , is disturbed by this background sound level . The thershold for annoyance , complaints and community reaction depend upon normal ambient levels . PROPOSED PLANT MACHINERIES ( First year ) Extracting from the filed documents with the Board of Commissioners of Weld County , the following process equipment are to be installed . Each equipment is listed with the corresponding rated noise level typical for that type of machinery , based on available manufacturer ' s information . The collective total sound level from the machinery in operation at the same time is tabulated based on the principles ; of adding two or more unequal sound levels shown on the attached charts . The effective sound level perceived at a distance of about 1000 feet is 67 DB. This level of noise exceeds the State allowed noise level by 12 DB or 22% . However , the actual pressure level perceived by human ear is in excess of 400% . PROPOSED PLANT MACHINERIES ( 5 to 10 years ) As indicated in the Front Range Sand And Gravel Company mining plan , the company is planning to increase the plant production capacity to 500 ,000 ton per year , or about 250% of the initial capacity . This increase of production capacity will be associated with a corresponding increase in the quantity of plant machineries and mobile equipment . Table below lists the projected number of machineries and equipment required after the plant expansion . This level of nose exceeds the allowed 55 DB by 22 DB, which is about 40% . However , the actual pressure level perceived by the human ear is in excess of 1000% . This is because for every 6 DB change in the ambient noise , the pressure level perceived is double . GRAVEL HAULING TRUCKS The proposed access road for the haulage of gravel is designated to be along side of the area marked "A" . It is anticipated that as many as 30 trucks will be entering the plant site during the day , in the first phase of operation , and about 75 trucks in the final phase . Assuming 100 DB average noise level for each truck, and 3 trucks on the road at the same time , the noise level imposed on the nearby house will be 67 DB . This level of noise exceeds the maximum allowed noise by 12 Db , or about 400% greater pressure level than allowed . NOISE A HEALTH PROBLEM The idea that people get used to noise is a myth. Even when we think we have become accustomed to noise , biological changes still taking place inside of us , preparing us for physical activity if necessary . Noise does not have to be loud to bring on these responces . Noise below the level usually associated with hearing damage can cause regular and predictable changes in the body . 6 In studies dating back to the 1930 ' s , researchers noted that workers chronically exposed to noise developed marked digestive changes which were thought to lead to ulcers . Cases of ulcers in certain noisy industries have been found to be up to five times as numerous as what normally would be expected . From a study done with animals , researchers concluded that noise may be a risk factor in lowering people ' s resistance to disease and infection . Noise can cause regular and perdictable stress in the human body . People do not get used to noise-- the body continues to react . CONCLUSION The proposed gravel plant to be located at the intersection of U. S . Highway 85 and State Highway 52 , in Fort Lupton , Colorado , will generate machinery and operation noises . Although , the perceived impacts and annoyance levels will be difficult to predict , the life styles of the residences of the nearby community will certainly be affected . The background noise level of the nearby residential community is estimated to be about 35 DB . This low background noise level dictates a lower maximum allowed noise level than that which is established by the state of Colorado , 55 DB at night in residential neighborhoods . No effective noise control can be employed by the plant operator which would prevent a nosy environment , as the nature of the operation of gravel plants requires open , moible and outdoor activities . When unwanted sounds intrudes into our environment , noise exists . We have all experienced to varing degree the annoyance and irritation caused by noise . Sometimes this annoyance is brought about by distruption of our sleep . At other times , it may be because we have to raise our voices over background noise to be heard . The operation of the proposed grvel plant would conceivably impose a background noise level about 400% greater than the nearby community ambient noise level . This is a typical farm and livestock operation with substantial improvements . There are presently existing residential improvements of superior quality probably in the $150 ,000.00 to $175,000.00 range. In order to duplicate the residential improvements the replacement cost would require an expenditure in excess of $150 ,000 .00 . In addition to the residential improvements there are regular farm improvements of good or better quality which are well maintained. In arriving at the present value of the land, one is required to consider the highest and best use the property is best suited. Over 80 acres of the Alice Pehr Farm is flat and running the entire Northerly and Southerly length. The West 40 acres lie along the natural ridge between the lower pasture and the upper 30 acres. This ridge gives an outstanding view of the Platte River bottom with no obstructions. At the present time the land is zoned as agriculture as defined by the Weld County Zoning Ordinance. Mr. Dick Hein, the neighbor to the North, and Mrs. Pehr have made temporary plans and arrangements to annex both properties to the City of Fort Lupton. At the present time the Hein property is contiguous to the City. By annexing, the Hein and Pehr properties, becomes ideal for developing to Country Living residential sites. The highest and best use is for developing into residential lots with the frontage to commercial sites. This zoning must be considered as being probable and most logical. Based on a residential development the acreage has an acre value of $5,000.00 to $6,000.00. Utilizing the $5,000.00 for the entire acreage reflects a total land value of $720 , 000.00 . To this figure there must be added the residential value of the improvements of not less than $150,000.00, making a total value of $870,000.00. If the present proposed mining operation is put into effect what will it do to the present Pehr farm? First of all any residential development will be unwise and practically negated. With no development the land value will deteriorate to an Agricultural Value. On today's market the value will be depreciated 50% to $2,500 .00 per acre. If one considers the value based on Agriculture values another damage should not be overlooked. Applicant has stated that approximately 40 to 100 trucks will be using the passage way, creating a tremendous amount of dust which will be raised. This dust will float onto the Pehr fields making the crops almost unuseable. With this dust upon the pasture and crop lands the production will become worthless. If a sprinkler system was used for irrigation in some of this dust would be washed away. However, the flood system of irrigation in no way would wash this dust away. The Agriculture value of $2,500.00 per acre will be further reduced to the depletion of crop revenue . It is the opinion of your Appraiser that $2, 000.00 per acre would be the highest amount that the land would command . A review of gravel pits in the surrounding counties shows that open gravel pits have not created any enhancement of value of the adjacent properties Most all open pits remain as open ground with the adjoining area becoming weed breeding areas . The remaining water becomes stale and unuseable so no recreation has taken place around their mined pits. Based upon 2,000.00 per acre the after value of the Pehr farm would be as follows: 140 acres @ $2,000.00 per acre $280 ,000.00 Improvements 150 ,000 .00 Total $430,000 .00 This shows an after value loss as follows: Value prior $870 ,000 .00 Value after 430 ,000 .00 Damages after $440 ,000 .00 This $440 ,000.00 shows an alarming amount of damage but following the discussion on what whill happen to the area it is most logical to assume that this amount of damages will accrue to the property. Investigation as to the potential of increasing the land value following the excavation was carefully considered. In investigating the development of open gravel pits from Denver to Fort Lupton not one has had any development take place. Department of Planning Services Side S.H. 52 Weld County 915 10th Street DOH File 45100 Greeley, CO 80631 Dear Ms. Dunn: In our letter of August 20, 1985, we commented on the Front Range Sand and Gravel special use application with regard to future highway right of way and highway access. We reaffirm our comment on the need for additional right of way, and we would like to provide the following additional information at the request of the applicant. As indicated in our previous letter, an Access Permit will be required to obtain access to State Highway 52 for this mining operation. We have evaluated the location and projected traffic impact of this access. The location would allow for sight distance considerably in excess of the required 935 feet for multi-unit trucks. The applicant's projected access traffic volume of 90 truck trips per day (90% to and from S.H. 85 and 10% to and from the west) , would not require turn lanes on S.H. 52. Based on the above information and the fact that there is no other access available to this property, a properly designed access to S.H. 52 would be permitted. The design of this access, including the bridge over the Lupton Bottom Ditch should be coordinated prior to application for the permit. In addition to the above information, we would like to address the safety and capacity of S.H. 52. According to the 1982 Colorado State Highway Condition and Traffic Volume Report, which is the latest available information, the Hazard Index (HI) for this portion of highway is 0 and the Volume to Capacity (V/C) Ration is .50. The HI rating of 0 indicates a lack of any serious accident problems in this area and the .50 V/C ratio suggests that the highway capacity is acceptable.
