' sl ll ee ° L RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT FOR EXPANSION OF A DAIRY OPERATION (900 HEAD) - CORPORATION OF THE PRESIDING BISHOP OF THE CHURCH OF JESUS CHRIST OF LATTER-DAY SAINTS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 20th day of July, 1988 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter-Day Saints, c/o Roswell Checketts, Manager, 50 East North Temple, Salt Lake City, Utah 84150 , and 3421 Weld County Road 31 , Fort Lupton, Colorado 80621 , for a Site Specific Development Plan and amended Special Review Permit for expansion of a dairy operation (900 head) on the following described real estate , to-wit: Part of the N} SE* , Section 16 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS , said applicant was represented by Elvis Tippets , of E.H. Tippets Company, and WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 .2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan ' s Urban Growth Boundary Area � PC0 /s/�} 880691 T""Y rZ, 'Y� Page 2 RE: AMENDED USR - LATTER-DAY SAINTS Goals and Policies. This proposal is not an urban type of development and does not appear to have an effect on the future growth of the City of Fort Lupton. b. The proposed use is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The proposed uses are compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted in the A (Agricultural) Zone District. Property surrounding this proposal is being used for crop production and pasture. d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and amended Special Review Permit for expansion of a dairy operation (900 head) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 2. Within 90 days of approval by the Board of County Commissioners , the applicant shall provide evidence to the Department of Planning Services that the property is in compliance with the Colorado Guidelines for Feedlot Runoff and Containment. 3 . Within 30 days of approval by the Board of County Commissioners, the applicant shall submit a copy of a soil erosion control plan approved by Platte Valley Soil Conservation District. 880691 Page 3 RE: AMENDED USR - LATTER-DAY SAINTS 4 . Prior to recording the Special Review plat: a. The Development Standards shall be adopted and placed on the Special Review plat. b. The applicant shall provide evidence to the Department of Planning Services ' staff that the State Division of Water Resources has approved a water supply sufficient in capacity for the dairy operation. c. The plat shall be amended to show all the proposed holding lagoons . 5 . The Special Review plat shall be ready to be recorded in the office of the Weld County Clerk and Recorder within 60 days of approval by the Board of County Commissioners. The Special Review Permit is for a Site Specific Development Plan and an Amended Special Review Permit for an expansion of a dairy operation (900 head) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . The applicant shall remove, handle, and stockpile manure from the livestock confinement area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors , flies or insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4 . The facility shall be maintained at all times in compliance with the Colorado Guidelines for Feedlot Runoff Containment. 5 . The applicant shall comply with all State Health Department requirements for construction and operation of a dairy. 6 . Waste oil, waste paints, stains, treatments, spent drug containers, empty livestock dip containers, anti-freeze, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 7 . No permanent disposal of wastes shall be permitted at this site. 8 . Fugitive dust shall be confined on this site. 9 . The property shall be maintained at all times in compliance with the approved Soil Erosion Control Plan. 880691 Page 2 DEVELOPMENT STANDARDS - LATTER-DAY SAINTS 10 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 11 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 12 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 13 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 14 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 15 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Lupton, CO., scheduled for hearing April 19, 1988. Aside from being concerned about the significant amount of water that the larger dairy is using and the resulting effect on the water table from which I draw my domestic water, I am particularly worried about the offensive waste odors associated with large concentrations of animals. To help you understand my concern with the odor I have enclosed three pictures numbered consecutively and a simple map showing my location relative to the dairy. The pictures have a two-fold purpose; 1. to help you visualize our location, and; 2. to document a past problem with the dairy. An extension of the ditch running out the bottom of picture #1 would run right through my back yard. My property lies in a natural drainage at an elevation lower than the dairy and at night odors seep naturally downhill right through my property normally starting to be noticeable around 1:00AM but sometimes starting as early as 8:00PM. The pictures enclosed were taken in the spring of 1987 and were taken at the time to document the effluent run-off from the dairy in discussion. Picture *2 shows the pollutants entering the Fulton Ditch which also runs through my property. Picture 4'._i, shows a pond which was completely filled with run-off from the dairy. It took one full year for the Colorado Health Dept. to effect a clean up their operation. The odors from the dairy waste at that time were enough to awaken my wife at night and to bring on severe headaches and nausea. We propose to continue the use of the dairy farm as is . The dairy is a 430 Low operation. This include: 230 milking cows and 50 dry cows . The dairy raises the replacement heifers and sells all bull and steer calves . There are approximately 64 baby heifer calves , 30 steer baby calves , 82 heifer calves , 130 yearlings , 111 mature heifers and 10 mature bulls . Therefore , the dairy .consists 430 cows plus 426 animals as a supporting count totaling 356 head of animals . Maximum number of animals will not exceed 300 head. There are six building structures that provide homes for the six families that reside and wor k on the dairy . The milking barn is a double-eight Herringbone . Sixteen cows are milked at one time . 3{80 cows are milked in eight hours , three times a day. One to two people milk on an eight hour shift . The milking cows are housed in a big shed . Here they have individual stalls and feed bunks for each pen . There are four pens inside this shed . Each pen accommodates between 70-30 c Dws . There is a fifth pen of milking cows north of the barn , which accommodates 120 cows . The dement feed bunk consists of self lock up stanchions . They have an open front shed for their shelte. . The younger calves -have open front sheds for shelter as do the dry cows . We raise most of our replacement heifers . From time to time the dairy purchases bred heifers from various cattle buyers in Weld County , such as Bob Wardlaw and Ralph Casey . Baby calves are -housed in individual hutches , that consist of a pen half covered with a roof . Occasionally, baby bull calves are sold to individual buyers as replacement calves for new born-s or to raise as beef . After being weaned they are moved to another pen. Every month or so they are moved to different pens according to size. Most of the weaned bull calves are sold to Bob Wardlaw, who in turn raises them as feeder steers . After fifteen months the heifers are bred , either artificially or by 1 B80691 bull , and in nine months are ready to freshen. All feed is purchased locally, either through a feed broker or feed business . The dairy feeds a variety of commodities , such as ; rolled barley, ground ear corn, Coors pellets , soy bean meal , wheat mids , beet pulp pellets , cotton seed , depending upon availability and price. Our ground hay, corn silage, baled hay , oat hay are purchased from local farmers . The Kersey LDS farm raises all its ' hay and corn for the dairy. Also , the Pierce LDS farm provides the dairy with alfalfa and oat hay. We purchase several tons of hay and silage from farmers such as ; Phil and Jim Gable , Myrtle Satterfield , Dale Schroeder , Russell Hause , Dean and George Whittman, Tom Sasaki , Ray Olin . Dave Sarchet , Norm Moser , and Kevin Willard . Mineral , calf grain, powdered milk , barley are purchased from Manna Pro in Ft . Lupton . The dairy works with feed brokers such as Agri Sales , Golden K Feed and Seed , Con Agra , Platteville Elevators , FMA , Colorado Commodities , and Permagreen . The commodities and minerals are store4 in a big open front shed with a cement floor and dividing walls . Silage is stored in a cement pit behind the commodity shed . Loomix is stored in a tank south of the milk barn . Steve Foust handles the account for Loomix and calculates our feed rations . Baled straw and sawdust are stored for bedding the animals , especially during the winter months . All supplies and feed are trucked in . The dairy doesn ' t have the equipment or manpower to do this task . A milk truck from WDCI picks up the milk daily . During the winter when the wind and snow have arrived the dairy helps keep road #10 open in order for the milk truck to get through. Other trucks come on a regular basis in order to keep up the supply of feed . An average of 10 trucks a week deliver supplies and feed . Most of the utilities are run by propane . Green Brothers ' in Brighton delivers the propane . Gray 's Oil delivers gasoline and diesel fuel about twice a month . Union REA furnishes our electricity. Neb Electric handles all electrical work on the dairy . Sorensen's Dairy Equipment does all service on the milking equipment . They also deliver all milking supplies . A service man may be here once a month and the delivery truck once a month , also . The Animal Clinic in Ft . Lupton handles the veterinarian accounts . The veterinarian is here usually three or four times a month, providing a regular health program and service calls . All medicine for the herd health care is purchased through this clinic . Harlen Gartrel , a neighbor who owns and operates heavy equipment , 880691 does most of our maintenance and service. He provides gravel , packs the silage pit during corn season, scrapes corals , cleans the retention ponds , clears roadways in winter etc . . .His hired man takes care of a lot of maintenance on our equipment . The dairy raises about twenty-five acres of corn, which is put into silage. Then approximately twenty-five acres are used for pasture a short time in the summer . Mostly the cows are kept in corrals , where balanced feed rations are fed . Explanation of need for use. The Ft . Lupton LDS Dairy farm plays a very important part in many peoples ' lives within our community and beyond . The actual purpose of the dairy is quite different from that of other dairies . Since it is owned by the Church of Jesus Christ of Latter-Day Saints , the Mormons , it has a very special purpose. It is a welfare farm within the Church's system. The farm serves two purposes . ( 1 ) This farm not only provides work for the present employees , but provides opportunities for work. for those people that may need to receive church assistance. Instead of church members receiving welfare from county and state levels , it gives those people an opportunity to donate labor on the farm in return for food , clothing or whatever their needs might be, which the Church will provide. This in turn lets the members feel good about themselves during a difficult time of their life. It helps them to regain their self respect and self confidence. This dairy provides that opportunity for any member of the Church in this Denver region. These matters are handled by local priesthood leaders in the area . (2) The second purpose of the Ft . Lupton LDS Dairy is to fulfill its ' part in the Church 's welfare system. Each welfare farm, such as the Kersey LDS and Pierce LDS farms provide food for storage for the Church ' s welfare storehouse. The dairy provides the money for the welfare system to buy commodities that the system cannot produce itself. In this manner the store house can provide food in times of need for those in this region . The Ft . Lupton LDS Dairy , as you can see, provides jobs and assistance to many people in the whole area . For the families residing on the dairy it provides a healthy environment to raise a family. In such a way that it teaches our children responsibility , integrity, and to work hard for the things they enjoy and to care about those around them . The dairy does not intend to expand anymore than the present facility, but just to maintain its ' present state. Apparently, a permit for a special use was applied for years back. Through changes in managers and so on, it was not recognized that an amendment must be made in order to have the expansions made, which was an increase in cows. Starting with the property that borders the dairy south is in pastureland and owned by John J . , John J . Jr . , and Robert T. Stamm. The property bordering north of the dairy is mainly a corn field and a small portion is in pastureland and owned by Howard Binder . On the northeast corner of the dairy , across from the road is in alfalfa and owned by Dale and Sandy Schroeder . On the east side across from the road is in alfalfa and owned by Myrtle Satterfield . 4 . The distance of the proposed use to residential structures in each direction . North of the dairy is 2640 feet , Dale Schroeder ; east is 530 feet , Myrtle Satterfield ; south is 1056 feet, Mark Laskoski and west is 2112 feet , Sam Schaefer . • 5. The maximum number of users patrons,, members and buyers. The maximum is approximately 40-45 a month . This consists of feed salesmen, employees , vet , repairmen, calf buyers , inspectors , delivery men, maintenance people, milk truck driver , feed truck drivers , milk tester , and supervisors . 6 . The number of employeess number of shiftss and hours of operation. The dairy employs 7 full time employees and 3 part time employees . We run 3 eight-hour shifts per day for the 3 milkers . In other words , one milker milks far eight hours each day six days a week. Two relief milkers milk on the seventh day. One employee mixes feed and feeds it to the cows , scrapes pens and maintains equipment . He does this from 7 : 00 AM to 5 : 00 PM, which consists of 10 hours , six days a week . Another employee feeds calves and cows , lays out mineral , beds down the animals , cleans stalls and other various jobs from 7 : 00 AM to 5 : 00 PM, which, also consists of 10 hours six days a week . A relief man handles each job when that particular individual is off . There is a part time relief milker , who works eight hours a week . A part time person cleans the office and laboratory 2 to 3 hours each week . Record keeping on employees and livestock and any correspondence is done by a part time employee. This consist of 4 to 6 hours a week. There is an employee in the milk barn at least twenty-four hours a day milking cows . 7. The types and maximum number of animals to be concentrated on the area at any one time. 880691 The type of animals on the dairy are holstein cattle. The dairy is a 430 cow operation. This includes 380 milking cows and 50 dry cows . The dairy raises the replacement heifers and sells all bull and steer calves . There are approximately 64 baby heifer calves , 30 steer baby calves , 82 heifer calves , 130 yearlings , 111 mature heifers and 10 mature bulls . Therefore, the dairy consists of 430 cows plus 426 animals as a supporting count totaling 856 head of animals . The maximum number of animals to be concentrated on the area at any one time is 850-900 . 13. Explanation of type and size of any wastes stockpile or storage areas associated with the use. Whenever any animal dies the Weld County Bi Products is notified and here within 24 hours , usually less . Any waste from the barn, such as paper towels , empty plastic jugs , card board boxes etc . . . are disposed of in a dumpster . All of the used paper towels are put into plastic trash bags before they are put in the dumpster . Once a week Brit 'n Best empties the dumpster and hauls it away . The dumpster is also used by the families on the dairy to dispose of their trash. There are trash cans placed in, various places on the dairy to catch discarded bottles , used medical supplies and so on. Manure is cleaned daily from the pens in the big barn. It is scraped outside, where it dries and is hauled off by farmers or John Farr , who uses it commercially. Some of it is used for the fields on the dairy. The remaining corrals and pens are scraped and cleaned two to three times a month. 80% or the manure is hauled away and disposed of commercially. 10% is left for fertilization on the dairy. The retention ponds are cleaned once a year or as they need it . This is required by the health department . Now that the lounging shed is not flushed by water , but only scraped , the ponds do not fill very rapidly . The size of the manure piles are approximately from 20 to 50 feet long and 20 feet wide by 6 feet high depending upon the size of corral . These are hauled out within a month. These are cleaned out to comply with state health codes . A storage area for wastes cleaned from ponds is 400 ' x 60 ' . 14 . Explanation of storm water retention facility associated with the use. The holding ponds also take care of any storm water. Refer to forms labeled "feedlot wastewater discharge" . 15. On occasions old equipment and old used vehicles are picked up by junk yard dealers . All trash cans from the dairy are dumped into the dumpster. All trash is picked up on a weekly basis . The pasture has grass that helps prevent erosion. There are two fields in front that we keep planted with grasses such as sedan grass or occasionally oat hay. The field west of the barn is kept planted with corn or some type of feed. We don ' t keep any land bare. We try to keep grass of some type growing in open areas . 17. Reclamation of procedures to be employed upon cessation. If upon cessation the retention facilities will be returned to natural vegetation. 18 . Retention ponds have been provided in order to keep surrounding waters from being contaminated in anyway. These ponds collect any and all run-off from the barns and corrals . They are cleaned yearly. This facility has been inspected by the Water Quality Control Division of the Colorado Health Department . During the summer and fall months fly control is watched . Two to three times a week measures are taken to keep down the fly population . Rodents are not a a big problem, but when necessary, bait is set out . This helps control the situation. Dust from the roads doesn ' t seem to be a problem because the soil is very sandy . However , during corn silage season, when the truck traffic is more we have hoses to wet down the road to help control the dust . We maintain our fences to keep our stock from wandering off . The corrals are all of metal pipe and sucker rod. The perimeter fences are of five strand barbed wire. S . The agricultural zone district is intended to preserve prime agricultural land and to provide areas for agricultural activities and uses dependent upon agriculture without the interference of incompatible residential, commercial, and industrial land uses. I 2,/�Agricultural businesses and industries will be encouraged to locate in / areas that minimize the removal of prime agricultural land from [ production. 3. Conversion of agricultural land to residential, commercial, and industrial development shall be discouraged when the subject site is located outside of a municipality's comprehensive plan area, urban growth boundary area, or 1-25 mixed-use development area and activity centers . This policy is intended to promote conversion of agricultural land in an orderly manner that is in harmony with the phased growth [ plans of a municipality and the County. It is intended to minimize the incompatibilities that occur between uses in the agricultural l district and districts that allow urban-type uses . In addition, this policy is intended to minimize the costs to Weld County taxpayers of r providing additional public services in rural areas for uses that require services on an urban level. . 4. In the event that residential, commercial, or industrial development desires to locate on non-prime agricultural land outside of an urban growth boundary area or I-25 mixed-use development corridor, the application for such development shall be carefully evaluated to determine if an equally suitable location is available in areas established for such development. The application materials must demonstrate that the proposed use cannot reasonably be located in a municipality, urban growth boundary area, or the I-25 mixed-use development corridor. In addition, the application materials must demonstrate how the adjoining agricultural uses will not be adversely impacted. The land use application materials shall also demonstrate, to the satisfaction of the Board of Commissioners, that maximum efficiency and economy has occurred in providing the needed public services to the proposed development or district. Such application for urban-type development in the unincorporated county must include data and analyses 880691 that adequately project the indirect and direct current public impacts, public costs, potential revenue, and other impacts on the County's tax base. 5 . If it is determined that public facility or service improvements or maintenance are required by a development, the developer will be required to pay for the costs of the public facility and service improvements and maintenance. The methodology for compensation shall be determined during the land-use application review process . The developer shall submit the following: (1) information which accurately identifies all users of the infrastructure improvements and maintenance; (2) a proposal which equitably distributes the costs of infrastructure improvements and maintenance by user share; and (3) a proposal that identifies the appropriate tine that infrastructure improvements and maintenance charges should be applied. This information shall be reviewed by the Board of County Commissioners in determining an equitable means of distributing infrastructure costs among the County at large, direct users, and the developer. 6. --"A municipality's adopted comprehensive plan goals and policies will be considered when an agricultural business is proposed to be located within an urban growth boundary area. 7. A process that allows a lot in the agricultural district to be divided into two separate lots will be established. The intent of this policy is to: A. Enable the property owner who is retiring an opportunity to live on or sell the existing farm improvements. B. Enable the property owner co sell off agricultural land that is nonproductive for one single family dwelling homesite. C. Enable the property owner to provide a residence for direct members of the farm family and also for workers employed at the • farm. Agricultural districts located outside of an urban growth boundary area or the I-25 mixed-use development corridor are expected to remain predominantly agricultural. Low density single family residential development may be permitted but is not encouraged. These rural 1 homeowners will not have certainty about the future character of the 880691 agricultural districts and will be expected to live with those uses allowed by right and by special review in the agricultural district. Weld County will not provide public sewer or water service. Weld County will provide rural services to the agricultural community such L as gravel road maintenance and police protection. However, because of the limitations placed upon increasing the annual tax levy by the adoption of Article XIV, Section 14-7 of the Home Rule Charter, the rural resident cannot expect urban level services. 8. All mineral resources are fixed in location. The mineral extraction industry is restricted in its operation to those areas where the minerals exist. Extraction of mineral resources shall be encouraged_as_ long as the mining plan preserves or minimizes the removal of prime farm land. In addition, the future use of the mined area as identified in mining reclamation plans must consider the Comprehensive Plan's Agricultural Goals and Policies. f Mining and drilling applications must include information that addresses the occurrence of any adverse impacts on the agricultural indust;y and the environment. The application must provide detailed traffic information about ingress to and egress from the subject site, the haul routes, type and weight of vehicles, and frequency of traffic. The land—use application materials shall demonstrate to the satisfaction of the Board of Commissioners that adequate provisions have been taken to mitigate any impacts created by the proposed operation. Mining and drilling applications shall also be reviewed in accordance with the transportation goals and policies. A municipality's adopted comprehensive plan goals and policies will be considered when the mineral extraction site is determined to be located within a municipality's urban growth boundary area. 9. The County will develop and maintain procedures and guidelines for disposal sites that are operated as a commercial enterprise. This includes, but is not limited to, the disposal of solid, liquid, and wastewater in agricultural zone districts. A disposal site's plan should address preserving or minimizing the removal of prime agricultural land. In addition, any future reclamation plans must consider the Comprehensive Plan's Agricultural Goals and Policies. 880691 Access between public roads and the proposed disposal site shall be granted only after consideration is given to the land uses and traffic patterns in the area of development and the specific site. Internal road circulation, off—street parking, acceleration— deceleration lanes, common access collection points, signalization, and other traffic improvements shall be required wherever necessary to mitigate traffic impacts caused by the development. A municipality's adopted comprehensive plan goals and policies will be considered when the disposal site is determined to be located within a municipality's urban growth boundary area. 10. Public facilities and services such as sewer, water, roads, schools, and fire and police protection must be provided and developed in a timely, orderly, and efficient manner to support the transition of agricultural land to urban development. The expansion of public facilities and services into predominantly rural agricultural areas, when the expansion conflicts with other existing goals and policies, will be discouraged. In evaluating a land—use application, Weld County representatives and the applicant will consider the public facilities and services goals and policies. 11 . The County will require various methods that encourage soil, groundwater, and water aquifer conservation practices and protection. The methods should be consistent with other existing goals and policies. 12. The County will encourage the location of park and recreation areas in flood plains, seep areas, geological fault areas, and other nonproductive agricultural areas. 13. As conditions warrant, the County may consider various methods of transferable development rights.
