Box 169 Sterling, CO 80751 Dear Mr. Cervi: A recent inspection of your brine water disposal site, east of Roggen, Colorado, by Jeff Stoll Environmental Health Specialist of this office, revealed a number of problems. There is a significant amount of spillage around the receiving area and an apparent intentional discharge of liquid waste onto the surface of the ground on the north side of the skim-tank battery. There also appears to be a change in the water quality in the groundwater table below the facility. A copy of the monitoring well test results and the inspector's report are included for your information. It is suggested that you direct your technical staff to evaluate operations and conditions at the site as soon as possible, and to respond to this notice within 30 days of receipt. Please be advised that Colorado Revised Statutes Title 30, Article 20, Section 113 states: "ENFORCEMENT - CIVIL PENALTY. Any solid wastes disposal site and facility found to be abandoned or that is operated or maintained in a manner so as to violate any of the provisions of this part 1 or any rule or regulation adopted pursuant thereto shall be deemed a public nuisance, and such violation may be enjoined by a district court of competent jurisdiction in any action brought by the department, the board of county commissioners of the county wherein the violation occurred, or the governing body of the municipality wherein the violation occurred." Please be advised that Section 112 of the above cited statute states: "REVOCATION OF CERTIFICATE. The board of county commissioners, after reasonable notice and public hearing, shall temporarily suspend or revoke a certificate of designation that has been granted by it for failure of a site and facility to comply with all applicable laws, resolutions, and ordinances or to comply with the provisions of this part 1 or any rule or regulation adopted pursuant thereto." -PL-041 I i , Mike Cervi November 3, 1987 Page 2 • If we may assist you in any way, or should you have questions related to this notice, please do not hesitate to contact this office at 353-0635. Dept. of Health EORRI1DU wine Wes Potter October 15, 1987 To Date COLORADO From Jeff Stoll 7jY Subject: Cervi Disposal Inspection In my inspection of the Cervi Disposal site, I found the following conditions to be sources of potential problems: 1. Evidence of spillage around tanks. Operator said that they do not use a bucket to catch drainage at hook-ups. 2. Evidence of intentional discharge onto the surface of the ground behind tanks. This does not appear to be a chronic practice as the surface is permeated with oil only to a depth of about an inch. The extent of brine water discharge onto the surface at this point is unknown. Operator, James Mask, said that he did not know what happened and that it was in that condition when he began employment there in August 1987. The previous operator did not contact the department when this major spillage occurred. The disposal's records are thorough and kept current on a daily basis. 3. The depth marker in pond B was not easily readable. 4. The lining of pond B has a severly eroded six inch gulley running down the bank beside the inlet. 5. There is some black residual along the edges of Pond B, but no evidence of an oil film on the surface. 6. Samples taken from the ground water monitoring wells reveal a noticable change in water quality at one monitoring well. Further site evaluation is certainly indicated at this time. JF/bks Hello
