HomeMy WebLinkAbout871412.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1056 - CURTIS STRONG WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS , as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 1056 , does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 1056 was submitted by Curtis Strong for property which is located in part of the NW* , Section 23 , Township 3 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request is to divide the property into parcels estimated to be approximately 15 acres and 5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The parcel of land on which this request is being made is described as Lot B of RE-293; part of the NW} of Section 23, T3N, R66W of the 6th P.M., Weld County, Colorado. The property is located approximately 3.5 miles east of the Town of Platteville, on Weld County Road 32. The parcel under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into two parcels of 15.0 acres and and 5.0 acres, more or less. There is an existing residence and other improvements on the 5 acre parcel. The Weld County Health Department and Central Weld County Water District have reviewed the application materials and have no objections to the request. The Division of Water Resources has also reviewed the application and has recommended approval if certain conditions are complied with. The staff has concerns whether adequate water will be available for the potential uses of this property if the Division of Water Resources' conditions of approval are met. The Division of Water Resources' conditions are identified in its letter of October 8, 1987. The staff also has concerns whether this proposal is compatible with the existing surrounding land uses. Adjacent parcels range from 40 acres to 320 acres and are primarily in natural vegetation or pasture. Also of concern to the staff is whether this proposal is consistent with efficient and orderly development. This 20 acre parcel is Lot B of RE-293 which was approved in December 1977. RE-293 created a 40 acre parcel and this 20 acre parcel. The subject site is approximately 3.5 miles from an incorporated municipality and is surrounded by parcels of land at least twice the size of this parcel. The further subdivision of this parcel in the A (Agricultural) zone district, outside of the urban growth boundary area, is not consistent with orderly development and evades the intent of the Weld County Subdivision Regulations. 871412 Board of County Commissioners November 4, 1987 Page 2 The Agricultural zone district was established to maintain and promote agriculture as an essential feature of Weld County. It is intended to provide areas for the conduct of agricultural activities without the interference and encroachment of other more intensive land uses. The request, if approved, will allow for the potential of an additional residence not currently allowed under the existing land-use regulations. Scattered residential development in rural areas necessitates an increased demand for education facilities, roads and bridges, utilities, police and fire protection, and other services. Rural residential development, at some point in time, reaches a level where it begins to interfere with and encroach upon the agricultural activities in an area. The staff recommends that the Board of County Commissioners consider this request and determine if the standards of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision Regulations have been met. (e) Proposed Parcel A is a rural residence and will remain as such. 6) This proposal is consistent with the Agricultural Zone District because the farmland will remain as farmland and the farmstead will remain as a rural residence. If a new residence is constructed on Proposed Parcel B, the Building Permit and Code will require modern construction. The uses of proposed Parcel A or B will neither interfere with nor be incompatible with the neighboring Agricultural Zone for the above reasons . 7) The uses of proposed Parcel A (a rural residence) will remain the same as it has been for decades . The use of proposed Parcel B will remain farmland which is the same as land to the north, south and west of subject property. This is a possibility but it is not a probable situation because the end of the existing service line is about three miles from the subject property. The cost to the Applicant would be prohibitive. Therefore, water is not currently avail- able to the proposed larger parcel which the seller intents to retain ownership and does not need a water source. Domestic well may be an alternative because all of the neighbors have domestic wells. Another alternative would be for Proposed Lot A and B to share the existing well . The proposed 5-acre lot would be served by a well (permit no. 20190 or 7607) . The conditions of approval do not prohibit the issuance of an additional permit. We could issue an additional household use only well for the proposed 14.94-acre tract. Since a well permit would be available, we can recommend approval. The availability of a well permit and our recommendation for approval is subject to the following conditions: 1 .
