RE: SERVICE PLAN - PINE LAKE SANITATION DISTRICT
A public hearing was conducted ou December 1, 1986, at 10:00 A.M. , with the
following present:
Commissioner Jacqueline Johnson, Chairman
Commissioner Gordon E. Lacy, Pro-Tem
Commissioner Gene Brantner
Commissioner C.W. Kirby
Commissioner Frank Yamaguchi
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Director of Planning Services, Chuck Cunliffe
Director of Finance and Administration, Donald D. Warden
The following business was transacted:
I hereby certify that pursuant to a notice dated October 20, 1986, and duly
published October 23 and 30, and November 6, 1986, in the Johnstown Breeze, a
public hearing was conducted to consider the Service Plan for the proposed Pine
Lake Sanitation District. Lee Morrison, Assistant County Attorney, made this
matter of record, stating that this hearing was continued from November 12.
Chuck Cunliffe, Director of Planning Services, explained that this hearing was
continued so the applicants could submit certain financial documents for
review. After reviewing the documents, Don Warden, Director of Finance and
Administration, submitted a memo to the Board indicating that adequate
financial capability exists to fulfill the financial commitments outlined in
the Service Plan. Tom Hellerich, attorney, came forward to represent the
proposed district. Vern Nelson, of Nelson Engineers, spoke about the various
steps involved in this project, stating that the best way to handle wastes for
a project of this nature is through a sanitation district, which becomes a
public agency. Considerable discussion was held about the proposal. Mr.
Warden stated that if problems should arise, the district could create a debt,
but this was seen to be a major change in the Service Plan, requiring approval
of an amendment. Mr. Hellerich agreed that page 6 of the Service Plan should
be amended to refer to the partners of the Heritage Park Partnership, rather
than the owner of the Pine Lake Village Mobile Home Park. No public comment
was offered concerning this matter. After further discussion, Commissioner
Lacy moved to approve the Service Plan for the Pine Lake Sanitation District,
with page 6 being amended to refer to Donald J. Carlson, Patricia A. Carlson,
Hallet W. Walston, and Diane D. Walston, partners in the Heritage Park
Partnership. The motion was seconded by Commissioner Kirby. On a roll call
vote, the motion carried 3-2, with Commissioner Yamaguchi and Chairman Johnson
voting nay.
This Certification was approved on the 8th day of December, 1986.
