RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR OIL AND GAS PIPELINE BUSINESS - JOHN R. REINHOLDT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 12th day of June, 1985 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of John R. Reinholdt, 1179 Aspen, Broomfield, Colorado 80020 , for a Use by Special Review for an oil and gas pipeline business on the following described real estate, to-wit: Part of the W1, Section 33 , Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or the County. The proposal does not appear to have any adverse impacts on the agricultural interest of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. 850789 PLINIO Page 2 RE: USR - REINHOLDT c. The Town of Erie has reviewed this request and recommends approval. d. No overlay districts affect the site. e. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an oil and gas pipeline business on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The prescribed Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the subject property until the Use by Special Review plat has been delivered to the Department of Planning Services office and the plat has been recorded in the office of the Weld County Clerk and Recorder. 3 . The applicant and/or operator shall be required to obtain all applicable building or electrical permits for USR-674 : 85 : 13 . 4 . The applicant shall submit to the Department of Planning Services an erosion control plan that has been approved by the Boulder Valley Soil Conservation District. 5 . The applicant shall submit a revised mylar plat showing the elimination of the access to State Highway 7 . 6 . The applicant shall submit a plan for landscaping the storage equipment area to the Department of Planning Services for approval. The purpose of the landscaping shall be to visually screen the storage area from State Highway 7 and Weld County Road 5 . The permitted use shall be an oil and gas pipeline construction business as described in the application materials on file with the Department of Planning Services. 2 . The applicant and/or operator shall implement and maintain the approved soil erosion control plan. 3 . The equipment storage area shall be located north of the shop and warehouse buildings on Parcel B, as shown on the mylar plat for USR-674 : 85 : 13. The applicant shall implement and maintain the approved landscape plan for the equipment storage area. 4. The Use by Special Review area shall be limited to two access points on Weld County Road 5. An eighteen inch (18") minimum diameter culvert sixty feet (60 ' ) in length shall be installed at both points of ingress and egress to the subject site. 5 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. 6 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 et seq. , of the Weld County Zoning Ordinance. 7. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 8 . The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 9 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards . Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners . Barker Planning Department representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated May 29, 1985, and duly published May 30, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the request of John R. Reinholdt for a Use by Special Review for an oil and gas pipeline business. Bruce Barker, Assistant County Attorney, read this request into the record. Rod Allison, Planning Department representative, read the favorable recommendation of the Planning Commission into the record, stating that nine Operation Standards have been proposed for this operation. Mr. Allison also said that the applicant has complied with Conditions 4, 5 and 6. Ray Milhellin came forward to represent the applicant. Chairman Johnson inquired about plans for screening this area and members of the Board were presented with plats showing the proposed screening. Mr. Milhellin assured members of the Board that the trees used for screening will be maintained and replaced as necessary. Following discussion, Commissioner Lacy moved to approve the Use by Special Review for an oil and gas pipeline business for John R. Reinholdt, subject to the conditions and Operation Standards recommended by the Planning Commission. The motion was seconded by Commissioner Brantner and carried unanimously. They own eighty acres, but only sixteen acres will be used for the Use by Special Review area. There are some commercial uses in the area, but they are not asking for a change of zone. They will employ twenty to twenty-five people on a full-time basis. The Chairman asked if they had reviewed the recommendations, conditions, and operation standards as outlined by the Department of Planning Services staff. He stated they have and there has been an access onto Highway 7 for many years for agricultural purposes. They would like to use this for a vehicle access, but would not use it for truck access. They would also rather have a tree line than a wooden fence to screen the area. Rod Allison stated the staff is in agreement with the applicant that a six foot high wooden fence will not adequately screen the facility from Highway 7. The staff is in agreement that a tree line would be more attractive and screen the property better. Carlson, adjacent property owner, is opposed to this request because they feel this type of business will change the character of the area and decrease the value of the other properties in the area. Highway 7 is now a major thoroughfare for local and tourist traffic and this will detract from the beauty of the scenery in the area. This type of business would be better in a commercial area rather than in an agriultural area. This type of a development is not beneficial to the surrounding land owners. USR-674:85:13, was reviewed and the following comments are P.O.BOX5,0 presented for the County's consideration FIRE DEPT. 1. Traffic Related - Since the recent paving of Road 5 828-3152 and the addition of a second landfill in the area, the intersection of Road 5 and Highway 7 has become very busy and potentially dangerous. In addition to normal car and truck traffic there are 250 plus trash trucks going through that intersection each day. Some close calls related to trucks not stopping for stop signs or slow moving trucks entering fast moving traffic have already been reported. For these reasons the Planning Commission recommends that ingress and egress areas to the Reinholdt site be limited to Road 5 only. It is also recommended that the County work with the State Highway Department for the purpose of installing flashing yellow warning signals at each end of the intersection. 2. Limited Size - The Planning Commission was impressed with the limited size of the operation (in land area) in relation to the size of the entire parcel. The Conunission supports the premise that the permit be applicable only to the land area that would be utilized immediately and not applicable to area planned for future expansion. The Adams County Planning Department classifies an oil and gas construction operation as a heavy industrial use. The area immediately south of the proposed case is designated by the Adams County Comprehensive Plan for agricultural land use. One-quarter mile east of this area, the Adams County Comprehensive Plan designates the area for mixed use urbanization, which is generally for medium density residential use (5-15 d.u.a.' s) with some commercial use. The existing zoning in this area of Adams County is Agriculture- 3, which is not compatible with heavy industrial use. Thus, the proposed use is not compatible with Adams County's Comprehensive Plan, agricultural zoning, and existing land use. For these reasons, Adams County requests you to consider recommending a denial of this case. If this case is approved, the Planning Department requests that the following issues be considered and addressed: 1 . Highway 7 is a high speed major arterial highway. In order to meet Adams -County Transportation standards and insure the design speed can be maintained, access should be restricted to the site from Weld County Road 5. 2. The County requests that the proposed fence be a solid wood screen fence to screen the operation from the surrounding agricultural area and future residential area. Reinholdt Dear Mr. Mullen: The John Reinholdt proposed land development site is on Ulm clay loam. The Ulm soil series is prime farmland. These soil series have severe limitations. The main limitation is a high shrink-swell potential which causes problems with houses with or without basements, small commercial buildings and shallow excavations. These soils also have a rocky layer which may cause construction problems. High clay containing soils tend to corrode steel quickly, but doesn't appear to effect concrete. Septic tanks and sewage lagoons also have severe limitations because of the slow percolation of the clay. The water table is greater than six feet deep and according to the Weld County Soil Survey the land development site does not flood. Roadway widening will be required for speed change lanes, left turn lanes and will include Highway signing and striping. We recommend that all access to this site be limited to Weld County Road 5 and not to State Highway 7. There is a significant grade difference between the Highway and the natural ground at the proposed access point. If the developer insists on access to Highway 7 we will consider a request only if the access is approximately 550 feet east of Weld County Road 5. Install or extend any drainage structures or storm sewers that may be assoc- iated with the development. Storm drainage now sheet flows down and away from the Highway and should continue to do so.
