Dear Mr . Mullen :
In connection with the Weld County Commissioners ' approval
in December , 1984 of the Waldbaum Company' s rezoning applica-
tion for an expansion of its egg production , processing , and
shipping facility, a substitute water supply plan was approved
by Jeris Danielson, the Colorado State Engineer . Because the
Waldbaum Company ' s shallow tributary well, Permit No. 7289R,
was decreed only for irrigation use, the State Engineer
approved a temporary limit of 480 ,000 on the number of chickens
in the egg production operation until a change of use for this
well was decreed by the Water Court. This temporary limit was
later expanded to 600 ,000 chickens by letter dated August 8 ,
1985.
The Waldbaum Company has now obtained a Decree approving
the change in use of its tributary well from irrigation to
commercial and other purposes . I have enclosed a copy of the
decree entered December 26 , 1985 in Case No . 85CW050 for your
review. The entry of this Decree fulfills the State Engineer ' s
condition of approval of the requested rezoning expansion to
750 , 000 chickens . The Waldbaum Company contemplates that full
expansion will be achieved.

9 . The lands associated with the historical irrigation use
of the subject water right have been removed from irrigation
with the exception of a • small amount cf landscape irrigation.
In no case will land outside of the E-Z, Section 35 be
irrigated with water withdrawn from Gates Cyclo Well No. 7239 ,
unless such us is decreed in a subsequent change of water
right proceeding.
10. The proposed change in use will not re ure a change in the
point of diversion of the subject water right and applicant
will continue to withdraw water for the proposed new uses
through Gates Cyclo Veil No. 7289 .
