RE : GRANT MOBILE HOME PERMIT NO. 1319 - HERBERT P. AND M. MARIE
WATSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, on the 22nd day of July, 1987 , considered the request of
Herbert P. and M. Marie Watson for a mobile home to be used as a
principal dwelling, and
WHEREAS , said mobile home is to be occupied in an
A-Agricultural Zone District on a parcel of land being more
particularly described as follows :
Lot 8 , Block 10 , Aristocrat Ranchettes
Subdivision, Weld County, Colorado
WHEREAS , the Board of County Commissioners , having heard the
testimony, finds that said request should be granted subject to
the following conditions : 1) The applicant shall apply for a
building permit for the mobile home within thirty days from the
date of approval by the Board of County Commissioners; 2) After
the mobile home is occupied, the Quonset hut on the lot shall not
be used on any basis as a dwelling or as overnight or temporary
housing for any person; and 3) Prior to the issuance of a building
permit, the owner shall submit evidence that the water tap is
supplying water in such a manner as to be adequate in quality,
quantity and dependability for the proposed use.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of
Herbert P. and M. Marie Watson for permission to place a mobile
home to be used as a principal dwelling on the above described
parcel of land, which was found to be in compliance with Section
43 of the Weld County Zoning Ordinance , be, and hereby is , granted
subject to the hereinabove listed conditions.

This request is for one mobile homes) to be used as -a principal dwelling.
Legal Description of Parcel: Lot 8, Block 10, Aristocrat Ranchettes
Subdivision, Weld County, Colorado
Location: One mile northeast of the Town of Fort Lupton.
The Department of _Planning Services staff has reviewed this request and
recommends that the request be approved for the following reasons:
WILL WILL NOT
X _ Be compatible with the Weld County
Comprehensive Plan.
X Be compatible with the surrounding area.
X Be in harmony with the character of the
neighborhood.
__ X Adversely affect the immediate area.
X Be adequately served by water and sewage
disposal facilities.
X Adversely affect the general health, safety
and welfare of the inhabitants of the area and
the County.
COMMENTS:
The applicants are currently living in a Quonset hut on this parcel. They
plan to move into the mobile home when it is moved onto the lot. The
President of Aristocrat Ranchette Water Project, Incorporated, has stated
that the applicants will be allowed one water service connection only for
one household on the lot.
The _applicant submitted a petition with 15 valid signatures. Sixteen valid
signatures were required to meet the 70% requirement of surrounding -property
owners.
No objections have been received from surrounding property owners.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1 . The applicant applying for a building permit for the mobile home
within thirty (39) days from the date of approval by the Board of
County Commissioners.
2. After the mobile home is occupied, the Quonset hut on the lot
shall not be used on any basis as a dwelling or as overnight or
temporary housing for any person.
3. Prior to the issuance of a building permit, the owner shall submit
evidence that the water tap is supplying water in such a manner as
to be adequate in quality, quantity, and dependability for the
proposed use.

ARTICLE I
Name , Objects , Purposes and Principal Place
of- Business
The corporate name , the objects and purposes and the princi-
pal place of business of this Association shall be as stated in
and provided by the Certificate of Incorporation of the Association
heretofore filed in the Office of the Secretary of State and the
Office of the County Clerk and Recorder of Weld County, Colorado ,
as required by the Laws of the State.
ARTICLE II
Seal
The seal of this Association shall have inscribed thereon
the name of the Association, the year of its organization and the
words "Corporate Seal . "
ARTICLE III
Membership
Section 1 . Persons who own property within the limits of
the area to be served by the ARWP, as described by the Certifi-
cate of Incorporation, and considering the needs of users who may
already be members, for whom the ARWP has an adequate supply of
water, and can serve without undue hardship in such convenience
and form as provided by the ARWP. (And upon payment of the appli-
cable tap-fee as determined by the Board of Directors . )
Section 2 . Service Connections
a. Each Membership shall be entitled to one (1) water
service connection and no more than one such connec-
tion shall be allowed upon an acre within the system.
Any person desiring more than one service connection
shall be required to apply for and secure a member-
ship for each such connection as provided in Article
III , Section 1 .

b . No membership shall be allowed , nor service connection
approved , to serve an unoccupied or unimproved lot .

More than one household per service connection shall
not be allowed.
i . EXCEPTION: In a medical hardship situation ,
where the applicant can provide supporting
documentation from the Weld County Health De-
partment and upon approval of a majority of
the Board of Directors .
ii . EXCEPTION: In situations where more than one
household per service connection existed prior
to June 6 , 1984 .
Note : Notwithstanding any thing herein to
the contrary, the exception ii . herein shall
terminate upon the sale , gift , conveyance ,
alteration or change of title , or any transfer
of title , rights, ownership , or possession
whatsoever of the property on which such
situation exists .
iii. DEFINITION: "Household" shall be deemed to be
any permanent structure , mobile home regis -
tered with the County of Weld or the State of
Colorado , or any motor home , camper ar other
recreational vehicle occupied on site for more
than three (3) months .
d. Each service connection to the system will be piped to
the nearest practical point on the property line of the
lot to be served at the expense of the ARWP, Inc . Any
piping within said served lots will be at the owner ' s
expense .
e . The ARWP , Inc . will be responsible for all maintenance
of the system up to the point of connection at lot
property lines as described in Article III , Section 4d
above. Maintenance beyond that point is the responsi-
bility of the lot owner.
Section 3 . All applications for membership shall be passed on
by the Board of Directors . Said application shall be addressed to
the Board of Directors of said Association accompanied by a check
for the membership fee and said Directors shall have authority to
grant or deny such application in accordance with its judgment and
determination as to whether the supply and capacity of the water system
is adequate to serve said application in addition to supplying the
needs of the existing members of said Association. Said Board shall
have authority to impose conditions upon which an application may
be granted.
Section 4 . Membership Fees : The Board of Directors shall
determine membership fees . Payment of the membership fee shall
entitle that member to one (1) service connection.
