HomeMy WebLinkAbout870175.tiff RESOLUTION RE: ACTION OF THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO, CONCERNING SITE APPLICATION OF PINE LAKE SANITATION DISTRICT AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Color-ado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Pine Lake Sanitation District wishes to construct -a wastewater treatment facility on the following described parcel of land, to-wit: Part of the NW; of Section 17 , Township 7 North , Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Regulations for Site Applications for Wastewater Treatment Facilities require review of the Site Application by the Board -of County Commissioners prior to commencing construction and , further , that various local and State agencies be given the opportunity to review and comment on said Site Application , and WHEREAS, Pine Lake Sanitation District has submitted its Site Application to the Board of County Commissioners of Weld County for review and comments, a copy of said Application being attached hereto and incorporated herein by reference, and WHEREAS , after study and review, the Board finds that said Site Application is compatible with the Veld County Comprehensive Plan and that it is in the best interest of Weld County to recommend approval of said Application , subject to the condition that -monitoring wells around the treatment facility shall be incorporated into the design and shall meet the requirements of the County and the State Health Departments. NOW, -THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the -Site Application of Pine Lake Sanitation District be, and hereby is , recommended favorably to the Colorado Department of Health as being compatible with the Weld County Comprehensive Plan , subject to the hereinabove mentioned condition. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign said Site Application. 870175 ARTICLE 7 AMENDMENTS SECTION 7.1 PROCEDURE These Rules and Regulations may be amended by the Board at any regular or special meeting of the Board on the condition that prior Public Notice is given thereof at least once in a newspaper of general circulation in Weld County, Colorado. That is, the District shall have, but not be limited to, the discretion to determine who may use the sewer, conditions of use, fees to be paid and maintenance. SECTION 5.7 SUBMISSION OF DEVELOPMENT PLANS As a condition of service from the District, the applicant shall agree not to develop his land without first submitting his development plans to the Board for its approval . SECTION 5.8 APPLICANT MAY BE REQUIRED TO INSTALL SEWAGE FLOW MEASURING INSTRUMENT Whenever, in the opinion of the District, the use of water consumption measurements does not accurately reflect the amount of sewage or influent produced by the customer, the District may, in its sole discretion, elect to require the customer to install a suitable sewage flow measuring instrument. The customer will be charged for sewage flow as indicated by the instrument, less the allowable infiltration or actual infiltration, whichever is less. ARTICLE 6 VIOLATIONS AND PENALTIES SECTION 6.1 NOTICES Any person found to be violating any of the provisions of this Resolution shall be served with written notice stating the nature of the violation and providing a reasonable time limit for satisfactory correction thereof. Any notice shall be given in the same manner as provided for nonpayment of fees and charges under the provisions of Article 4, Section 4.4, of this Resolution. SECTION 6.2 LIABILITY TO DISTRICT Any person violating any of the provisions of this Resolution shall become liable to the District for any expense, loss or damage occasioned by reason of such violation. SECTION 6.3 DISCONTINUANCE OF SERVICE The District also reserves the right to discontinue sewer service for violation of any rule upon written notice of such intended discontinuance at least five days prior thereto advising the user in what particular such rule has been violated. 23-'0 73 SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING March 3, 1987 A regular meeting of the Weld County Planning Commission was held on March 3, 1987, in the County Commissioners' Hearing Room, Weld County Centennial Building, 915 Tenth Street, Greeley, Colorado. A quorum was present. The summary of she last regular meeting of the Weld County Planning Commission held on February 17, 1987, was approved as distributed. CASE NUMBER: None APPLICANT: Pine Lake Sanitation District REQUEST: Site application for a wastewater treatment facility LEGAL DESCRIPTION: Part of the NW} of Section 17, T7N, R67W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 3 miles north of Windsor; south of State Highway 14 and east of Weld County Road 15 APPEARANCE: Tom Hellerich, Dinner, Hellerich, and Lazar, Attorneys at Law, represented the applicant. This was an existing mobile home park and is currently on a septic system, but it is inadequate. There has been prior approval on the service plan for the Pine Lake Sanitation District. In December, the Board found there was a need for this in the area. There are currently 34 mobile homes sites on this property. LaVern Nelson, P.E. , Nelson Engineers, reported they have received the recommendation of the Planning Services staff and they agree with the staff's comments. He asked that the location be changed to six and one-half miles north of Windsor rather than three miles, and asked that the summary reflect this request. This project will serve the needs of the proposed mobile home park. It is estimated there will be approximately 583 residents in the 212 mobile home spaces. The sewage treatment plant will be a totally new facility. 870175 13 �� mee'1-+n5 J'- 1/-cfn This reimbursement to the District shall be made by future connectors in the form of an aid-to-construction fee and shall be in addition to such other regular fees charged by the District, such as plant investment fees and use fees. It is recognized that there are many possible combinations of conditions relating to sewer extensions which effect the basis for reimbursement. The following principles will be used as guidelines in establishing the reimbursement formula: (1) The formula shall be simple to administer. (2) The amount to be reimbursed to the District shall be that part of the cost of the sewer extension, including necessary appurtenances, that is unique to that particular extension. (3) When a sewer extension is considered to be an intermediate section of a sewer, the following principles will be used as guidelines: (a) There will be no sharing of costs with either the upstream or downstream section of the sewer. (b) Side connections joining at the downstream end (end closest to waste water treatment plant) will not share in any allocable costs of the downstream section. (c) Side connections joining at the upstream end of the inter- mediate section, but will share in the cost of the inter- mediate section. (d) The District Sewer Master Plan will be used to help deter- mine whether or not a sewer extension is an intermediate section of a sewer. SECTION 5.6 DISTRICT OWNERSHIP Customers, applicants, landowners, subdividers or developers who have completed construction of sewers shall , before these sewers are accepted by the District for service, deed these sewers and appurtenances, except for service lines, including all necessary easements, to the District, free and clear of all liens and encumbrances, properly described by certified survey, and furnish a bond to cover all maintenance for one year from the date of acceptance of the sewers by the District. In addition, before these sewers are accepted by the District, the applicant shall provide complete "as built" drawings in a form acceptable to District, including locations of "stub—outs." In the event a special district is formed by an applicant outside of this District for the purpose of financing outfall sewers, sewer collectors and appurtenances, the applicant shall agree that such transfer by deed shall take place when the subject sewers and appurtenances are free of all liens and encumbrances incurred by said special district, and that in the interim period between acceptance for use and transfer to the District, the District shall be allowed to consider these sewers and 870175 Summary of the Weld County Planning Commission March 3, 1987 Page 2 Tape 170 - Side 2 An aerated lagoon with a polishing pond is the best method for treating sewage at this location. They expect to have the sewer system operational toward the end of 1987. There will be a three hundred foot buffer zone around the perimeter of the facility. The depth of the pond will be higher than the water table. The Chairman called for discussion from the members of the audience. There was none. The Chairman asked that reading of the recommendation of the Department of Planning Services staff be dispensed with and that this be filed with the summary as a permanent record of these proceedings. AMENDMENT: Paulette Weaver moved a condition be added to read as follows: 1. Monitoring sells around the treatment facility shall be incorporated into the design and shall met the requirements of the County and the State Health Departments. Motion seconded by Ann Garrison. The Chairman called for discussion from the members of the Planning Commission. Discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. MOTION: Lydia Dunbar moved the request for Pine Lake Sanitation District for a site application be recommended favorably to the State Health Department as amended by the Planning Commission. This decision is based upon the recommendation of the Department of Planning Services' staff and the testimony heard by the members of the Planning Commission. Also, that the Chairman be instructed to sign the application reflecting the decision of the Planning Commission. Motion seconded by Louis Rademacher. The Chairman called for discussion from the members of the Planning Commission. Discussion followed. 870175 I The applicant's contracted right to reimbursement under a sewer contract shall extend for a period of 10 years from the date of the execution of said contract, unless otherwise determined by the Board for good cause. This reimbursement shall be made from fees charged future connectors to the sewer for this specific purpose. Such reimbursement shall not be made from any revenues, fees or charges inuring to the benefit of the District as a result of this Resolution or as amended. The District will collect the reimbursement fee and remit it to the applicant prior to the time of connection. It is recognized that there are many possible combinations of conditions relating to sewer extensions which effect the basis for reimbursement. To establish the basis for reimbursement, the following principles may be used as guidelines in establishing the reimbursement formula: (1) The formula shall be simple to administer. (2) The amount to be reimbursed to the applicant shall be that part of the cost of the sewer extension, including necessary appurtenances, that is represented by the ratio of the use of others to the total use. other SFE' s other SFE's + applicant' s SFE's (3) When a sewer extension is considered to be an intermediate section of a sewer, the following principles will be used as guidelines: (a) There will be no sharing of costs with either the upstream or downstream sections of the sewer. Whenever the District extends a sewer to serve a particular area, it shall be eligible for reimbursement from future connectors to that extension. CASE NUMBER: USR-778:87:2 APPLICANT: Western Gas Supply Company REQUEST: A Use by Special Review Permit for a major facility of a public utility LEGAL DESCRIPTION: Part of the NW} of Section 34, TIN, R67W of the 6th P.14. , Weld County, Colorado LOCATION: Approximately 3 miles west and one mile north of Brighton; east of Weld County Road 19 and south of Weld County -Road 4 APPEARANCE: Richard Chamberlain, Western Gas representative and employee, stated the natural gas to this area has a higher Btu value than in the Denver-Boulder area. They will inject compressed air into the lines to bring down the Btu level so it can be used in the Metropolitan area. The orifices would need to be changed in the natural gas appliances if this were not done. They will run approximately sixteen miles of new lines, but only about one mile will be run in Weld County. Noise levels will meet all state requirements. This will be an unmanned facility, but there will be two men at the site for approximately five hours per day. The plant will have an automatic shut-down feature. They will meet with the Brighton Fire Department and comply with whatever they require. They will also meet with the Engineering Department following this meeting to discuss their concerns. No residences in the area are closer than one-fourth mile. He has read the recommendations, conditions, and Operation Standards as outlined by the Department of Planning Services staff and has no objections to them. The Chairman called for discussion from the members of the audience. There . was none. The Chairman asked that reading of the recommendations, conditions, and Operation Standards be dispensed with and that they be filed with the summary as a permanent record of these proceedings. The Chairman reminded the members of the Planning Commission that this request is a major facility of a publi-c utility. Therefore, the Planning Commission's action if final. If the Planning Commission's action is for denial the applicant may request a hearing with the Board of County Commissioners. ,y01 5 ° rio..�y e�:3 ill SECTION 5.3 SUBMISSION OF SEWER EXTENSION PLANS TO DISTRICT Prior to the initiation of construction by any applicant proposing to construct sewage collection facilities under Section 5. 2 of this Resolu- tion, the applicant shall submit construction plans and specifications to the District for review. Any cost of such review by the District or its engineer shall be borne by the applicant. Such plans shall conform to the sewer design standards as may be established by the District from time to time. No sewers shall be constructed within the Board's jurisdiction until final plans and specifications have been approved by the Board or its engineer and written authorization to proceed has been obtained from the Board. No sewers shall be accepted by the Board or placed into operation unless they have been inspected and approved by the Board's authorized inspector or engineer and it is determined that such sewers meet in all respects the requirements set forth in the sewer design and construction standards established by the District. No excavation shall be started until all required permits have been obtained. No individual connections shall be made to the existing sewer system of the District without the express written authorization of the Board by permit. SECTION 5.4 CONSTRUCTION OF SEWER MAINS BY CUSTOMERS At the sole discretion and direction of the District, the Applicant shall be required to install the facilities described in Section 5.2 and Section 5.3 of this Resolution by private contract, subject to approval of the plans and specifications by the District, receipt of a permit from the District as provided in this Resolution and District inspection of actual construction. At the sole discretion of the District, the appli- cant may deposit with the District the estimated cost of reviewing, inspecting and installing the facilities described in Sections 5.2 and 5.3 of this Resolution, and the District may then proceed to make the installation with its own forces or by contract with a private contrac- tor. In the event that the original deposit is insufficient, the applicant shall , upon notification, immediately deposit the balance required with the District to complete the work. SECTION 5.5 EXTENSION OF FACILITIES - REIMBURSEMENT. Extension of facilities may be made by applicants as set forth herein. The District may, at its discretion, extend its facilities if service to the particular area is feasible, practical , and desirable. a. Reimbursement When Applicant Extends Sewer. Any applicant who extends a sewer to serve his particular area may be eligible for reim- bursement from future connectors to that extension. The basis, or formula, for this reimbursement shall be determined by the Board of Directors, and shall be included as part of the sewer service contract. NAME: Pine Lake Sanitation ADDRESS: 7200 East State Highway 14, Fort Collins, CO 80524 REQUEST: Site application LEGAL DESCRIPTION: Part of the NWl of Section 17, T7N, R67W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 3 miles north of Windsor; south of State Highway 14 and east of Weld County Road 15 THE WELD COUNTY PLANNING COMMISSION RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: The proposed wastewater treatment facility will not adversely affect the local water quality and will be designed with sufficient capacity to serve the proposed development. This request is compatible with the Weld County Comprehensive Plan in that this proposal will insure that adequate public sewer service will be available for proposed residential development, and will have no adverse impacts on water quality. On June 12, 1985, the Board of County Commissioners approved Case Number Z-419 for a Change of Zone from A (Agricultural) to R-5 (Mobile Home Residential) . The Planning Commission recommends the following -condition be incorporated into this request: 1. Monitoring wells around the treatment facility shall be incorporated into the design and shall meet the requirements of the County and the State Health Departments. Motion seconded by Ann Garrison. SECTION 4.5 FEE FOR INCLUSION OF PROPERTY IN DISTRICT Property may be included in the District in accordance with the provi- sions of Colorado statutes at the discretion of the Board. Persons peti- tioning for inclusion of real property in the District shall submit with their petition an amount deemed appropriate by the District to cover all costs and expenses incurred by the District in processing such petition. Until revised, the processing fee shall be $400.00 plus publication costs. Any property included into the District which, due to applicable law and timing of the petition, is exempt from taxation for the year of annexation shall be assessed an inclusion fee in addition to the processing fee. The inclusiion fee shall be approximately equivalent to the amount of taxes which the District would have received from that property for the then current tax year based upon the date of the Board' s order of inclusion. SECTION 4.6 AVAILABILITY OF SERVICE FEE As set forth in Section 32-1-1006 C.R.S., the Board may assess an "avail- ability of service" charge against residential lots lying within the District but which are not serviced, provided that the District's lines are within 100 feet of the property line of the particular residential lot. No such availability of service of service charge shall be imposed unless approved by an affirmative vote of the Board after a public hearing and upon notice of the hearing mailed to each taxpaying elector as provided by law. ARTICLE 5 SEWER LINE EXTENSION POLICIES SECTION 5.1 GENERAL It shall be unlawful for any person to construct a sewer main or service line to be connected to the District sanitary sewer system without: (1) Having made formal application to the Board for approval ; (2) Having complied with all requirements and regulations of the Board; and, (3) Having received written authorization from the Board, or its designee. SECTION 5.2 EXTENSION OF SEWER COLLECTION FACILITIES Any applicant for sewer service from the District shall pay the full cost of construction and inspection of all extensions and connections, exclu- sive of sewage treatment facilities, but including necessary easements, rights-of-way, and permits from county, state or other governmental agencies, as are required to provide service by the District and connect the applicant to the District's existing system, unless otherwise provided by the District. 8701Q75 Tai Pine Lake Sanitation District March 3, 1987 Page 2 The Chairman declared the resolution passed and ordered that a certified copy be forwarded with the file of this case to the Board of County Commissioners for further proceedings. All statements are due and payable on or before the first day of the next month, e.g. , a statement mailed on or about the first working day of January is due and payable on or before February 1. Any statement which is not paid in full on or before the first day of the next month after billing shall be deemed a delinquent account. c. Delinquency Charges. In addition to the amount deemed delin- quent, the following delinquency charges shall be charged by the Dis- trict: (1) $ 25.00 if the delinquent amount is paid prior to the next successive billing. (2) If the delinquent amount is not paid prior to the next successive billing, the delinquent amount plus the delin- quent charge provided for in paragraph (1) above shall draw interest at the rate of one percent (1%) per month (commencing on the first day of the second billing) until paid in full . d. Disconnection. (1) The Board may, at its discretion, direct the District' s employees, agents, and/ or engineer to dig up and dis- connect the sewer line and terminate the service of the delinquent customer not sooner than five days after date of service or mailing of a "Shut-off Notice." (2) In the event the Board determines that service shall be disconnected, the District shall deliver by hand or certi- fied mail to the user a "Shut-off Notice." The Notice shall state that the delinquent account, plus all charges and penalties, must be paid within 72 hours of the time of service of the notice. If the owner, occupant or user cannot be located for personal service, it shall be lawful to attach the said notice to the premises in a conspicuous location. (3) If disconnection has been commenced, there will be an additional charge of $150.00 plus the actual costs to the District of making such disconnection and reconnection . These charges, in addition to all delinquent amounts, penalties and interest, shall be paid in full prior to service being restored. e. Lien. Until paid, all rates, penalties, tolls, fees, interest and charges shall constitute a perpetual lien on and against the property served, and any such lien may be foreclosed in the manner as provided by law at the discretion of the Board. 87(ts 7 I COMMENTS PINE LAKE SANITATION The Larimer Weld Regional Council of Governments has received an application for an amendment to the Regional (208) Water Quality Management Plan for this area. NOTE: For establishments of any kind falling into more than one of the above categories, each separate category would be computed individually and then all categories totaled for that establishment's total monthly charge. Commercial applications shall also be carefully reviewed to determine the type of sewage to be treated and the ability of the District's facilities to treat this sewage (i.e., service stations, dry cleaning, etc. ) . b. Rates for Property Not in District. In every case where the District furnishes sewer service to property not included in the Dis- trict, the District shall be paid for sewer service at the discretion of the District by specific contract with the person receiving service, and all fees, rates and charges shall be fixed and determined by the District with reference to such service and contained in said contract, provided, however, that the total contractual charges, fees, rates, etc., shall be increased by an amount equivalent to the revenue which would be obtained by the District from the particular property by way of tax levy. It is the intent of the District that property served outside of the District should pay an equivalent amount in lieu of taxes in addition to the contractual charges, fees, rates, etc. SECTION 4.4 SEWER SERVICE BILLING a. Billing and Payment. Statements for all charges shall be mailed on or about the first working day of the months of January, March, May, July, September and November. Statements shall include all charges (fees, penalties, service line repair charges, etc. ) incurred during the previous two-month calendar period. The District may send monthly state- ments to any or all users at the discretion of the District. 670175 LAND-USE APPLICATION SUMMARY SHEET Date: February 24, 1987 NAME: Pine Lake Sanitation District ADDRESS: 7200 East State Highway 14, Fort Collins, CO 80524 REQUEST: A site application for a wastewater treatment facility LEGAL DESCRIPTION: Part of the NW} of Section 17, T7N, R67W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 3 miles north of Windsor; south of State Highway 14 and east of Weld County Road 15 SIZE OF PARCEL: 13 acres, more or less POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS: The Colorado Department of Health, Water Quality Control Commission's regulations require that the applicant submit the site application to all appropriate local governments, planning agencies and state agencies for review and comment prior to submission to the Colorado Department of Health's District Engineer. The regulations further state that if the proposed facility is located in the unincorporated area of a county, the county planning agency should be requested to comment upon the relationship of the treatment works to the local long-range comprehensive plan for the area as it affects water quality including the location in the flood plain and capacity to serve the planned development. The county agency should also comment upon the relationship of the treatment works to the comprehensive plan for the area as it affects water quality for the proposed treatment works to be located within the boundaries of a city or town. The Weld County Health Department has specific concerns about this request. A copy of its memorandum, dated February 23, 1987, is attached to this land-use summary. (See Article 4, Sewer Line Extension Policies. ) SECTION 3.4 TAPPING If approved lines are to be constructed within subdivisions, stub—outs shall be made from under the streets so that subsequent cutting of the streets is not required. These stub—outs shall be plugged, inspected, located and approved in writing by an official designated by the District to provide such inspection. A map in a form satisfactory to the District shall be provided to the District. Actual cost incurred by the District for such inspection shall be reimbursed by the applicant. Actual tapping of the lines shall be done only with equipment approved by the District and by a representative of the District or under his direct supervision. SECTION 3.5 TAP TRANSFER A tap, when purchased, stays with the property for which it was pur- chased. The District will not approve nor allow taps to be transferred from one location or dwelling to another. Taps can be transferred by the current owner of property to a subsequent owner by paying all outstanding fees and charges plus a tap transfer fee in the amount of $20. 00 which is charged to reimburse the District for the necessary change of name and address on the many books and documents kept by the District. The current owner of such property shall remain liable for all fees and charges, whether incurred by him or by a subsequent owner, until all outstanding fees and charges, including the transfer fee, are paid in full and the transfer has been effected on the District' s records. SECTION 3.6 COMMENCEMENT OF MONTHLY CHARGES Monthly service charges as provided in Article 4 below become due and payable when the user connects to the District' s sewer system, or one year from the date on which the tap is purchased, which ever event occurs first. COMMENTS PINE LAKE SANITATION The Larimer Weld Regional Council of Governments has received an application for an amendment to the Regional (208) Water Quality Management Plan for this area. 870175 (1) Subdivision. In order to obtain taps for a subdivision, the applicant must make formal application to the District. This appli- cation will be reviewed by the Board and its technical advisors to determine if service to a particular location is feasible, practi- cal , and desirable. This application shall include plans in a form satisfactory to the District and which are detailed enough to deter- mine the location of service required, number of taps required and physical features which may affect service. The application shall also be accompanied by payment of a fee for technical review, which fee is set by the Board. Provided the Board determines that service to a particular location is feasible, practical , and desirable, the applicant will then be required to enter a contractual arrangement with the District and pay certain sums of money as required in the contract. To properly plan the facilities and maintain a high standard of service by the District, the District must be able to project the required services and, therefore, must have contractual commitments binding upon both the applicant and the District to properly provide such service. (2) Single Tap. A single tap may be purchased by making applica- tion to the District at its office and obtaining a determination from the District that it is feasible, practical , and desirable to serve the property. If it is so found, the tap may be purchased by payment of the plant investment fee, and the applicant must then make arrangements to have his service lines installed by a contrac- tor approved by the District. Once the service line is installed from the structure or dwelling to the line of the District, the District, for the sum currently being charged as a tapping fee, will tap the line and connect the service. This tapping fee is payable in advance of the tapping. All connections to the lines belonging to and owned by the District shall be made only by the District or its designated representative. (3) Several Taps. More than one tap may be purchased from the District if the purchase is for use on dwellings and structures which do not fall into the subdivision category. The limit on the number of taps which shall be sold to any given location without that location being deemed a subdivision shall be made by a decision of the Board. ARTICLE 3 USE OF DISTRICT SEWER SYSTEM SECTION 3.1 UNAUTHORIZED USE No unauthorized person shall uncover, make any connection with or opening into, use, alter or disturb any District sewer or appurtenances without first obtaining a written permit from the District. SECTION 3.2 RESPONSIBILITIES OF THE USER No user shall discharge or cause to be discharged any storm water, surface water, ground water, roof runoff, subsurface drainage, cooling water or unpolluted industrial process water to any sewer as herein defined. No user shall discharge or cause to be discharged to any sewer main, any harmful water or wastes, whether liquid, solid or gas, capable of causing obstruction to the flow in sewers, damage or hazard to structures, equip- ment and personnel of the sewage system or other interference with the proper operation of the sewer system. Wastewater shall be deemed harmful at the sole discretion of the District. Pretreatment shall be provided by the user to the satisfaction of the District before the waste is allowed to enter the District disposal system. Each user shall be responsible for constructing and maintain the entire length of his service line. Leaks or breaks in the service lines shall be repaired by the property owner within 72 hours from the time of notification of such condition by the District. If satisfactory progress toward repairing the said leak is not being made, the inspector shall have the authority to terminate the service or to have the line repaired. Financial system which has been developed to provide for necessary capital and continued operation, maintenance, and replacement through the life of the project. This would include, for example, anticipated fee structure. Implementation plan and schedule including estimated construction time and estimated start—up date. Depending on the proposed project, some of the above items may not be applicable to address. The con- struction costs shown are based on 1986 prices. The annual in- crease is impossible to predict, but based on the past performance, the increase will probably range between 3.5% and 10% annually. Although these estimates represent the best information avail- able, there is no guarantee of the actual costs to be incurred. There may be unforeseen factors that can substantially affect the final costs of construction when considering that the current cost predictions are based on preliminary data at a time that may be many months prior to actual design and construction. Every effort will be made to accomplish a final project commensurate with the financial program that is adopted as a result of this report and subsequent studies. 15 870175 Financial Analysis General The "District will have no long term indebtedness. The owner of Pine Lake Village Mobile Home Park is arranging long term financing for the entire mobile home park development. Included in that financing package are sufficient funds to provide for a total connection fee payment to the District equivalent to the capital cost of the sewage treatment plant, its appurtenances, and land. The park developer will prepay all sewer taps on a per unit basis to the District so that the District will have no debt for the initial construction to serve the planned 212 rental spaces. A monthly service charge as described later in this report will be paid to the District from park space rental income to pro- vide a source of revenue for necessary operation and maintenance costs. In subsequent sections of this Service Plan, a build out schedule for the park is shown to be a maximum of 4 years. The sewage treatment plant and land cost is estimated to be $226,776 . This results in a per connection cost of $1, 069. 70 for 212 units. The District will have the authority to assess a mill levy as an additional source of income. At present , the District does not anticipate the need for a mill levy. Although the entire area proposed for service by the Pine Lake Sanitation District is not included in the District boundaries initially, that area outside that is planned for mobile home park rental and zoned R-5 will be served either by long term contract or by annexation to the District. In either case, connection fees will be paid to the District in accordance herewith. Weld County officials have determined that the developers of the park have the financial capability to discharge the proposed indebtedenss on a reasonable basis as shown in the following re- solution taken from the minutes of the November 12, 1986 meeting of the Board of Commissioners of Weld County: "The area to be included in the proposed District has and will have the financial ability to discharge the proposed indebtedness on a reasonable basis. " Cost Estimates The following cost estimates are based on current construction bid prices for comparable work in this area . These estimates in- clude costs of major portions of the work and the conditions which might affect the final cost of the work. Engineering design, con- struction observation, easements , legal, fiscal and contingency items are included as 28% of the estimated construction cost. 870175 14 Legal Aspects Land and Easements The District has entered into a contract to purchase the the site of the proposed wastewater treatment plant. (See Appendix A, Exhibit No. 13 ) A permanent 20 foot wide easement will be needed for the con- struction and maintenance of all sanitary sewer lines. Easements within the District will be provided as necessary when the collec- tion system is purchased from the owner of the mobile home park. Agreements The District will obtain a discharge permit as required by the Colorado Department of Health, Water Quality Control Division. All the rules and regulations will be followed to insure the dis- charge permit is enforced for the life of the plant or as required. Discussions have been initiated with the owners of the water rights that would be affected by the discharge into the unnamed perennial drainageway. The Rules and Regulations of the District have also been in- cluded with this site application. (See Appendix B, Exhibit No. 14 ) 870175 13 Implementation Plan The wastewater treatment improvements proposed with the expansion of the mobile home park are planned to be constructed during 1987 . The wastewater collection lines will be constructed in phases over a three (3 ) year period also beginning in 1987. The actual construction will proceed only after approval of District formation and the treatment site application. Operation of the plant will not commence until a discharge permit has been issued. 870175 12 1 and the employees will be subject to all safety measures as required by the Department of Health and the Occupational Safety and Health Administration (OSHA) . Operation and Maintenance (0 & M) The stabilization ponds as proposed are relatively simple to operate. The major items for the operator to monitor for satis- factory treatment are: 1 ) maintain adequate water levels in each of the ponds; 2 ) insure normal functioning of submerged aerator; 3 ) provide adequate chlorination ; and , 4 ) provide regular testing of water quality parameters to ensure proper performance and to satisfy legal requirements of the State Health Department and the discharge permit. Regarding the maintenance of the wastewater treatment plant, regular daily inspections will be made to check each of the following areas : 1. Shallow rooted, perennial grasses may be planted on the dikes to within one (1 ) foot of the normal water surface elevation. Grass should be mowed on a regular basis during warm weather. 2. Trees and shrubs will not be allowed to grow on the dikes of the ponds. 3 . Animal burrow damage in the dikes. 4 . Bank erosion. 5. Perimeter fence. 6. Proper operation of mechanical equipment. In addition to daily maintenance, the on-going duties will in- clude keeping the collection and outfall lines clean and freeflowing, maintaining records on mechanical equipment which detail names of manufacturer and supplier, specifications, nature and frequency of maintenance, and record keeping and reporting to the District' s board of directors on treatment plant performance. The proposed facilities of the District will require one person on a part time basis for the daily operation and maintenance, A second person will occasionally be needed for jobs which, for safety or physical reasons, cannot be handled by one person. The plant operator, as a minimum, will possess a Class "D" wastewater operators certificate. It is anticipated that the District will contract with the Weld County Health Department to sample and test the treated wastewater for compliance to established effluent limitations. 870175 11 be sealed with a bentonite-soil mixture to meet the Colorado Depart- ment of Health permeability standards determined for aerated lagoons. Polishing Pond - The polishing pond is designed to provide enough detention time to allow the heavier solids, which are not broken down, time to settle out. This pond will continue to re- duce the organic matter in the wastewater utilizing photosynthesis to obtain the necessary oxygen. The polishing pond will have a depth of five (5 ) feet to pro- , vide detention time of 56. 1 days at a capacity of 437 , 500 cubic feet (10.04 ac.ft. ) . The polishing pond will also be equipped with a recirculating pump to the aerated lagoon should more oxygen be required during the treatment process. Chlorine Contact Basin - The chlorine contact basin will pro- vide 30 minute detention time at a chlorine dosage of five (5 ) mg/1 at average flow. The facility will be provided with baffle walls as required to provide the required 40 : 1 length to width ratio. Collection System - The collection system will be constructed by the owner of the mobile home park. It will be designed to dis- charge at a control structure at the sewage treatment facility. Ownership of the collection system will be transferred to the Sanitation District for operation and maintenance when the treat- ment system is operational . The collection system will be con- structed to conform to the design criteria shown herein and as otherwise required to meet the regulations of Weld County and the State of Colorado. Lateral sewers are designed to carry, when running full, 400 gallons per capita per day, or four (4 ) times the anticipated average flow. Trunk and outfall sewers are designed to carry 250 gallons per capita per day under the same conditions. All of the lines within the District will have a minimum diameter of eight (8 ) inches and will be constructed on grades such that at design flow rates the velocity will be greater than 2. 0 feet per second to pre- vent the deposition of solids. Due to the shallow bedrock through- out much of the area and no basement construction, the sewers will be constructed utilizing a shallower depth than that normally re- quired . Manholes will be installed at the end of each line, at all changes in grade, size or alignment and at distances not greater than 400 feet apart. The minimum manhole diameter will be 48 inches. Safety Features The proposed plant will be fenced and signed as a sanitation facility. The plant operator will be trained in the use and operations of safety devices. Also evaluated during the alternative treatment analysis was the possibility of extending Boxelder Sanitation District' s collec- tion system to Pine Lake Village. The extension would require 14,050 lineal feet of 8 inch gravity sewer, 7 , 450 lineal feet of force main and four (4 ) lift stations at an estimated total construction cost of $410,215. (See Exhibit No. 7 ) In addition to this cost, the park would still have to install its collection system and pay the necessary tap and service fees as required by Boxelder' s district. At the present time, Boxelder' s board of directors is not accepting systems or designs which incorporate lift stations; therefore, this alternative was rejected . The aerated and stablization pond system as proposed an this report meets the needs of the mobile home park. The system will operate satisfactorily below its projected design capacity. Also, this type of treatment facility offers simplicity of operation, lower operation and maintenance costs, flexi-bility in expansion and reliability. Treatment Plant The aerated lagoon system was choosen based upon cost, construction schedule, the ability of expansion , the ease of operation and the ability to meet the needs of the District. The aerated lagoon system will include an aeration basin, polishing pond, and permanent chlorination facility. (See Exhibit No. 8 ) When the district reaches the estimated population equivalent of 583 , the average hydraulic flow to the plant will be 58 , 300 gal- lons per day. The corresponding organic loading will be 99.1 pounds of BOD per day. The facilities have been designed using an average hydraulic flow of 100 gallons per capita per day and an organic loading of 0. 17 pounds of BOD per capita per day for the current and projected service area of the Pine Lake Sanitation District.District. Aerated Pond - The aerated pond is designed to provide enough detention time and oxygen mixture to reduce the BOD, fecal coli- forms, and total ammonia to meet the effluent requirements as established by the Colorado Department of Health. Complete mixing will occur in the 0 . 45 acre aerated pond . The aerated pond will have a depth of six (6 ) feet to provide a detention time of 1-5 . 1 days at a capacity of 117 ,600 , cubic feet (2 . 70 ac.ft. ) . The aerated pond will have one (1 ) , 5-horsepower submerged aerator to provide oxygen to oxidize (stabilize) the or- ganic matter as well as provide the necessary mixing. A berm width of eight (8 ) feet, side slopes of 3 :1 and a two (2 ) foot freeboard are proposed for proper maintenance of both the aerated lagoon and polishing pond . Groundwater: At the time of the investigation , free groundwater was encountered in all the borings at depths five and one-half (5-1/2 ) to six and one-half (6-1/2 ) feet below the surface. Water levels in this area are subject to change due to seasonal variations, irrigation demands on and adjacent to the site, fluctua- tions in the level of the reservoir or pond located in the northeast corner of the site, and flows in the Larimer County Canal located adjacent to the northeast corner of the site. In addition, a perched groundwater condition may occur at the site. Where water is not already encountered above the bedrock stratum, surface water may percolate through the upper subsoils and become trapped on the relatively impervious rock, thus forming the perched groundwater condition. Empire Laboratories, Inc. , of Fort Collins, a geotechnical engineering firm has performed tests on the on-site clayey silt with bedrock fragments to determine if the material is suitable for use as a pond liner. Empire Laboratories recommends a bentonite- soil mixture be used for the liners due to the permeability of the on-site material not meeting the Health Departments requirements. Their determination was made based on falling head permeability tests performed on remolded proctor samples from material obtained on site by the geotechnical firm. (See Exhibit No. 6 ) Should a pond liner be required it will consist of a bentonite- soil mixture to insure the seep rate is less than the allowed one- thirty-second of an inch per day (1/32"/day) . Three pounds of bentonite per square foot or the required amount to insure the seep requirement is met will be thoroughly mixed into the on-site clayey- silt and compacted at ninety-five percent ( 95% ) Standard Proctor. Treatment Alternatives Various alternatives were evaluated for providing treatment to the wastewater generated by Pine Lake Sanitation District. The two on-site systems studies were: A package plant using the ex- tended aeration process; and an aerated lagoon followed by a polishing pond . Each alternative would -include chlorination facilities and will provide an acceptable effluent. The first alternative, a package plant, was rejected for the following reasons : 1 . Treatment process is more sensitive to operating problems and variations of influent loadings. 2. Requires additional operator attention . 3 . Operating costs are higher. 4. The Colorado Department of Health has concluded that package plants, in general, have a less than satisfactory track record in Colorado. 870175 8 The applicable water quality standards for this classification are: Dissolved Oxygen (DO) - 5 mg/1 (minimum) pH - 6 .5 to 9 .0 Fecal Coliform - 2,000/100 ml In addition , the District' s wastewater treatment facilities will be required to provide standard secondary treatment. The limitations on these effluent parameters are as follows : 30-Day Average 7-Day Average BOD 30 mg/1 45 mg/1 TSS 30 mg/1 45 mg/1 Oil and Grease Less than 10 mg/1 Total Residual Chlorine Less than 0 . 5 mg/1 The treatment system as proposed by the Pine Lake Sanitation District, which provides secondary treatment with chlorination, will satisfy these water quality standards. Geotechnical Information A preliminary geotechnical investigation within the District was conducted during October, 1984 . The report indicated the soil profile in order of increasing depths in the vicinity of the pro- posed wastewater treatment plant is as follows : 1. Topsoil : The proposed treatment plant facility is over- lain by a six (6 ) inch layer of silty topsoil . The topsoil has been penetrated by root growth and organic matter and should not be used as a bearing soil or as a fill and/or backfill material. 2. Sandy Clayey Silt: This stratum underlies the topsoil and extends to the bedrock below. The clayey silt varies to a silty clay, contains varying amounts of sand and lenses of silty sand and exhibits low to moderate bearing characteristics in its damp to saturated in situ condition. When wetted, the silt stra- tum exhibits little to slight swell potential. 3. Sandstone-Siltstone Bedrock: The bedrock was encountered in all borings below the upper silts at depths two and one-half (2-1/2 ) and eight and one-half (8-1/2 ) feet below the surface and extends to greater depths. The upper one-half (1/2 ) to three and one-half ( 3-1/2 ) feet of the bedrock is highly weathered ; however, the underlying sandstone interbedded with minor amounts of silt- stone and traces of claystone is firm to dense. Lenses of densely cemented sandstone were encountered in several places throughout the bedrock stratum. Areas which may be served by gravity sewers but that are outside the initial District limits will be required to pay the cost of extensions to serve their development as well as a fee for their share of treatment. Wastewater Characteristics - The characteristics of the District' s wastewater have been estimated based on generally ac- cepted domestic wastewater strengths and on design criteria re- commended by the Colorado Department of Health . Future wastewater loading has been determined using the estimated characteristics and the projected population. The Colorado Department of Health recommends, for design Pur- poses , that an average individual flow contribution of 100 gallons per capita per day (gpcd ) be used to determine the quantity of waste- water generated. The composition, as well as flow, of domestic wastewater varies from area to area and with the time of day. The two most common measures of the "strength" of wastewater are Biochemical Oxygen Demand (BOD) and Total Suspended Solids (TSS ) . The deter- mination and monitoring of other characteristics such as chemical oxygen demand , temperature, color, pH, dissolved oxygen , fecal coliforms and ammonia may be warranted by a particular situation. For preliminary design purposes , the following values have been utilized as domestic wastewater strengths : BOD - 0. 17 pounds per capita Der day (ppcd ) TSS - 0. 17 ppcd Water Quality Objectives - The Colorado Water Quality Control Act of 1973 established the mechanisms required to implement water pollution controls at the State level. The Water Quality Control Commission is responsible, by State statute, for the promulgation of control regulations and to describe prohibitions, standards, concentrations and effluent limitations on pollutants that may be discharged into classified waters of the State. The State is also responsible for operating a discharge per- mit system for wastewater treatment facilities which is administered by the Colorado Department of Health. The Pine Lake Sanitation District will be required to obtain a discharge permit as well as an Amendment to the 208 Plan as administered by the Larimer-Weld Regional Council of Governments. Water quality standards have been adopted for river basins within the State. The unnamed drainageway into which the District will discharge is a tributary to Segment 13 of the Cache La Poudre River. This segment is classified for secondary contact recreation, warmwater aquatic life class 2 , and agriculture. (See Exhibit No. 5 ) 870 r 6 Design Criteria Population Projection - Initial project planning indicates that the expansion of the mobile home park from the present 34 units to 212 units will occur over a four (4 ) year period. The population during this period will grow from 94 to a total of 583 persons assuming 2 . 74 persons per mobile home. Several factors have been identified as reasons for expecting complete development of the mobile home park within the specified four (4 ) year period : 1. The location offers easy access to either Fort Collins or Greeley. 2 . Aesthetically the park offers a spectacular view of the front range mountains . The rental spaces within the park will range from 6 , 000 to 11 , 000 square feet to better accommodate the larger mobile homes currently being manufactured. 3 . Recent development in and around Fort Collins (i .e. , Anheuser Busch brewery) along with the potential growth of satel- lite companies. 4 . The quality and affordability of new mobile homes has in- creased in recent years allowing a larger percentage of people to become homeowners. 5 . Market analyses have concluded there is a need for addi- tional mobile home spaces. Vacancy rates in comparable parks is very low. 6. The site has excellent access via Colorado State Highways 14 and 257. It is not the intention of the park owner to increase the number of rental spaces above 212 ; therefore, the 10 and 20 year population projections for the mobile home park will also be an estimated 583 people. Design Period - In the planning of improvements , it is necessary to design for some future estimated population. The time in which this population is reached is termed the "design period" . In most instances, wastewater treatment facilities are designed for a future period of 20 years. Regardless of the design period chosen, however, facilities must be designed to function efficiently at both the present and future estimated populations. It encompasses 87 . 5 acres. The contributors to the wastewater collection and treatment systems will consist of the 212 mobile homes located on the northerly 57. 37 acres (3.7 units Der acre) of the property. The mobile homes will be located on rental spaces with the present owners retaining land ownership. The legal description of the proposed District boundary and the wastewater treatment site are provided . (See Appendix A, Exhibit No. 10 and No. 11 ) The District is located outside the Flood Hazard, Airport, and Geologic Hazard Overlay Districts as designated by Weld County. The only domestic water well within one mile of the District, listed on the master extract list for Division 1, Ground Water Section of the State ' s Division of Water Resources (Exhibit No. 3 ) is located on the Pine Lake Village property under the name of Howard H. Gordon. (See Exhibit No. 4 ) This well is not being used nor is there planned use for the well as a source of potable water. The North Weld County Water District serves potable water to the park and will continue to do so. The nearest existing wastewater service entity to the District is the Boxelder Sanitation District. That District boundary is located three miles west of Pine Lake Village. Pine Lake Village is in a drainage basin which is not tributary to the Boxelder Sanitation District wastewater treatment facility. As a result, extensive pumping, using lift stations and force mains for long distances is required . Such added costs of facilities makes connection with Boxelder infeasible. Ernest J. Croissant, Box- elder' s general manager indicated that it is not feasible to ex- tend their service area to include Pine Lake Village. (See Appendix A, Exhibit No. 12 ) The proposed wastewater treatment plant is designed to be operated as a flow through treatment facility. The effluent will be discharged into a natural drainageway with no plans of water reuse on site. The District will discharge into an intermittent drainageway which joins a perennial stream approximately one-eighth (1/8 ) mile to the West. The District will be the only permittee discharging to this water body and is expected to have no detrimental effect on the stream. The maximum discharge from the proposed treatment facility is anticipated to be less than 0. 09 cubic feet per second or approximately 40 gallons per minute. 870175 4 measurements were taken prior to water being turned into either the Larimer County or Larimer and Weld Canals. It is assumed that at this time of year the flow in this drainageway is at its lowest. The flow was conservatively determined to be 0. 34 cubic feet per second (cfs ) or approximately 153 gallons per minute (gpm) . The surrounding properties outside the limit of the District range in size individually from 2. 95 to 156 acres. They are sparsely populated and zoned agricultural. The proposed District encompasses only the south 87. 5 acres of Pine Lake Village properties. The area outside the District which may be served by gravity sanitary sewer flow has been estimated to be 370 acres. Development on these adjacent properties is not anticipated in the near future. At the time development does occur, the services of the District can be expanded as needed. 870175 3 of septic tanks and leach fields. A system, such as this, is generally unacceptable to County and State health officials due to difficulties encountered in monitoring these facilities on a regu- lar basis and providing continuity regarding responsibility for the proper operation and maintenance of the facilities. The site is presently served by other public utilities which are required for development. These utilities are: Water - North Weld County Water District Gas - Public Service Company of Colorado Electricity - Poudre Valley Rural Electric Association Telephone - Mountain Bell Fire - Poudre Fire Authority School - Weld County School District RE4 All of the above utilities have been contacted concerning their adequacy of facilities and all have expressed a willingness and capability to provide the necessary services to the proposed development. Physical Aspects The topography of the District slopes predominantly to the south and southwest. The Larimer County Canal, at the northeast corner of the boundary, flows in a southeasterly direction. Weld County Road 15 is located approximately one-eighth (1/8 ) mile to the west. The southern boundary lies adjacent to the Platte River Power Authority transmission line easement. The drainageway into which the wastewater outfall will dis- charge is located along the eastern edge of Section 18 . This drain- ageway flows south until it is intercepted by the Larimer and Weld Canal in the Northeast Quarter (NE-1/4 ) of Section 19 . Approximately 270 feet upstream of this point on the drainageway there is a structure which diverts water to Smith Reservoir. The water stored in Smith Reservoir is utilized to irrigate surrounding acreages . The outlet pipe from Smith Reservoir crosses underneath the Larimer and Weld Canal and discharges into a continuation of the natural drainageway which eventually empties into Timnath Reservoir some two miles southwest of Pine Lake Village. The existing drainageway has a perennial flow. During the growing season , irrigation waste runoff from adjacent lands flows into this drainageway substantially increasing the amount of water carried. The area which contributes runoff to this drainageway to the point of interception by the Larimer and Weld Canal is approxi- mately 765 acres. Weir measurements were taken on April 22 and 25, 1986 , on the drainageway at the point of diversion to Smith Reservoir. I Introduction and Overview General The Pine Lake Sanitation District and its Service Plan was approved by Weld County with the intent to provide a complete local sanitary sewage collection and treatment system for the District. The District Court is in the process of reviewing the Service Plan for the final step in the formation of the District. The Court has shown no opposition to the formation of the District, therefore, the District is filing the Site Application and request for Major Amendment to the 208 Plan so that the review process can begin. Pine Lake Sanitation District will be created through the District Court process prior to approval of the Site Application and Major Amendment to the 208 Plan. This report has been prepared by Nelson Engineers for in- formational purposes to accompany the Colorado Department of Health "Application for Site Approval" for the Pine Lake Sanitation District wastewater treatment facility. It has been prepared to furnish all interested parties of the proposed District; Colorado Department of Health ; Larimer-Weld Regional Council of Governments ; Weld County Commissioners ; Health Department of Weld County; Weld County Planning Department; Colorado State Geologist; and all property owners within and in the vicinity of the Pine Lake Sanitation District with pertinent information for the evaluation of the proposed wastewater treatment facility and site. This re- port will address the preliminary design , regulations, and other related matters of the treatment facility. The wastewater treat- ment facility will discharge the effluent into a natural drain- ageway in accordance with all local , county, state and federal regulations. Description of the Area The area to be served is located in the Northwest Quarter (NW-1/4 ) of Section 17 , Township 7 North , Range 67 West in Weld County. The site is one-half (1/2 ) mile west of Colorado State Highway 257 on the south side of Colorado State Highway 14 . The intersection of Interstate 25 and Colorado State Highway 14 is four and one-eighth (4-1/8 ) miles to the west, and the Town of Windsor is approximately six and one-half (6-1/2 ) miles to the south. (See Exhibit No. 1 ) The existing development consists of a 34-unit mobile home park known as Pine Lake Village. In June of 1985, the Weld County Commissioners approved a change of zone for 75 . 72 acres from agri- culture to R-5 (mobile home residential ) . This change of zone was required to expand the existing development from 34 to 212 units. There is a privately owned wastewater collection and treat- ment system serving the existing Pine Lake Village. In making this determination, the Division requires each applicant for a site approval for a domestic wastewater treatment works to supply an engineering report describing the project and showing the applicant's capabilities to manage end operate the faility over the life of the project to determine the potential adverse impacts on water quality. The report shall be considered the culmination of the planning process and as a minimum shall address the following: Service area definition including existing population and population projections, flow/loading projections, and relationship to other water and wastewater treatment plants in the area. Proposed effluent limitations as developed in coordination with the Planning and Standards Section of the Division. (Allow minimum four weeks processing time.) Analysis of existing facilities including performance of those facilities. Analysis of treatment alternatives considered. Good plain and natural hazard analysis. Detailed description of selected alternatives including legal description of the site, treatment system description, design capacities, and operational staffing needs. Legal arrangements showing control of site for the project life. Institutional arrangements such as contract and/or covenant terms for all users which w!:' be finalized to accomplished acceptable waste treatment. Msn:gement capabilities for controlling the wastewater throughout and treatment within the capacity limitations of the proposed treatment works, i.e., user contracts, operating agreements, pretreatment requirements. Financial system which has been developed to provide for necessary capital and continued operation, maintenance, and replacement through the life of the project. This would include, for example, anticipated fee structure. Implementation plan and schedule including estimated construction time and estimated start-up date. Depending on the proposed project, some of the above items may not be applicable to address.
