Dear Mr. Meddles:
The Department of Planning Services Staff reviewed your request to locate a
mobile home on your property to be used as hired help to care for the horses
involved in your breeding, training, and boarding facility. The staff
determined that you could apply for a Mobile Home Zoning and Building Permit
for the classification of accessory to farm. The staff determined that the
addition of a mobile home would not constitute a major change in
CUP-34:78:3, and therefore you would not need to amend the permit.
I am enclosing a Zoning Permit for a Mobile Home application for your
convenience. If you have any questions or need additional information,
please call me.

Dear Mr. Meddles:
Thank you for your letter of April 16. In this letter you indicated your
desire to dispose of part of your property through the Recorded Exemption
process. To do this you would need to submit a recorded exemption
application to the Department of Planning Services and obtain the
appropriate approval.
The horse boarding operation, as described in CUP-34 would need to be
considered separately from the recorded exemption process. The creation of
two parcels of land out of the 40 acres the conditional use permit was
approved for would be considered a major change to the approved conditional
use permit. Major changes to an approved conditional use permit requires
that an amendment be approved. This can be accomplished by submitting an
application for a Use by Special Review permit and obtaining the appropriate
approval. Enclosed you will find procedural guides and application
materials for both a Recorded Exemption and a Use by Special Review permit.

Dear Mr. Allison:
Our property at 3690 Weld County Road 7, Erie, Colorado 80516 was approved for
a building permit by the Weld County Commissioners in June of 1978 under Con-
ditional Use Permit (C.U.P. ) # 34.
It is our desire, at this time, to dispose of part of this property as outlined
below assuming the Commissioners will allow us a Recorded Exemption to build an
additional house on the 38 (plus or minus) acres as shown on the attached plat.
We wish to sell the properties in either of the two options listed below:
OPTION I - Sell the property fronting on Road 7 from the center of the irrigation
ditch to Road 7. This is approximately 2 acres as shown on the plat. The C.U.P.
conditions for the horse operation may, or may not, be conveyed with this trans-
action.
OPTION II - Sell the back portion (approximately 38 acres) assuming we are able
to receive approval for a Recorded Exemption. The C.U'.P. for the horse operation
may, or may not, be conveyed with this transaction.
My wife and I will be retiring in approximately three years and we wish to continue
to live on this property as this has been home to us for about 8 years.
I personally feel the granting of a Recorded Exemption by the Commissioners would
fit into the area' s present use. With the exception of a salvage yard in the South
East quarter of Section 15, Township 1 North, Range 68 West, the rest of the area
is comprised mostly of a few small farms (2-10 acres) with modest homes that lend
themselves to small agricultural endeavors.

If we are able to obtain a Recorded Exemption, this would not upset the
environmental status of the area, nor would it cause a strain on any of
the natural resources as water would come from a commercial company that
supplies the area.
I feel that if the Recorded Exemption is granted, it would fit into the
surrounding area and would also help the Weld County tax valuation for the
area.
