HomeMy WebLinkAbout861205.tiff RESOLUTION RE: APPROVE USE BY SPECIAL REVIEW FOR A NATURAL GAS LIQUID EXTRACTION FACILITY - DIVERSIFIED OPERATING CORPORATION (CLYDE AND ALICE KRAGER) WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 17th day of December, 1986 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Diversified Operating Corporation (Clyde and Alice Krager) , 1600 Stout Street, Suite 1500 , Denver, Colorado 80202 , for a Use by Special Review for a natural gas liquid extraction facility on the following described real estate, to-wit: Part of the SWa , Section 22 , Township 8 North , Range 58 West of the 6th P.M. , Weld County, Colorado WHEREAS, the applicant was represented at said hearing by Glenn Miller, and WHEREAS, Section 24 .4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. 1. j` 861205 Page 2 RE: USR - DIVERSIFIED OPERATING CORPORATION b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. No overlay districts affect the site. d. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a natural gas liquid extraction facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any additional building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Within thirty days of approval by the Board of County Commissioners , the applicant shall submit a soil erosion control plan for the Use by Special Review permit area approved by the West Greeley Soil Conservation District. The plan shall address the Soil Conservation District concerns identified in its letter dated October 6, 1966 . 4 . The Use by Special Review permit is for a natural gas extraction facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. The equipment located on the property shall be limited to: a. One separator b. One gas compressor c. One processor d. One generator e. Two eighteen thousand (18, 000) gallon storage tanks 3. A cattle-proof barbed wire fence and cattle guards shall enclose the Use by Special Review area. 4 . The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 5 . All liquid storage tanks shall be bermed to contain the greatest amount of liquid possible that can be released from the largest storage tank, in the event of a spillage. 6 . The soil erosion plan approved by the West Greeley Soil Conservation District shall be maintained on the subject property. 7. All vessels containing flammable or dangerous materials shall be identified in accordance with the National Fire Protection Association, #704M Identification System. 8. Sign (s) shall be posted at the boundary of the Use by Special Review site where access exists, identfying the operator, lease name, location, and listing a phone number, including area code, where the operator may be reached at all times. In lieu of the phone number being on the sign , the operator shall also furnish the phone number to the New Raymer Fire Protection District, Weld County Dispatch , and the Weld County Office of Emergency Management. 861205 Page 2 DEVELOPMENT STANDARDS - DIVERSIFIED OPERATING CORPORATION 9. Smoking shall not be permitted at any time on the Use by Special Review area. NO SMOKING signs shall be placed and maintained on the subject site. 10 . Fire extinguishers shall be maintained on the Use by Special Review site at all times . 11 . All land within twenty-five feet of any oil or gas tank containing flammable or combustible materials , or other appurtenant production equipment, shall be kept free of dry weeds, grass, or rubbish. 12. All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 13. The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 14 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 15. Personnel from the Weld County Health Department, New Raymer Fire Protection District , and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 16. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 17. The property owner or operator shall be responsible from complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the permit by the Board of County Commissioners. 861205 HEARING CERTIFICATION DOCKET NO. 86-69 RE: USE BY SPECIAL REVIEW FOR A NATURAL GAS LIQUID EXTRACTION FACILITY - DIVERSIFIED OPERATING CORPORATION (CLYDE AND ALICE KRAGER) A public hearing was conducted on December 17, 1986, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gordon E. Lacy, Pro-Tem Commissioner Gene Brantner Commissioner C.W. Kirby Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated October 29, 1986, and duly published October 30, 1986, in the Johnstown Breeze, a public hearing was conducted to consider the request of Diversified Operating Corporation (Clyde and Alice Kreger) for a Use by Special Review for a natural gas liquid extraction facility. Lee Morrison, Assistant County Attorney, made this matter of record. Chairman Johnson stated that this matter was continued from November 12, 1986, because the property had not been adequately posted prior to that hearing date. Keith Schuett, representing the Planning Department, read the favorable recommendation of the Planning Commission, which is subject to four Conditions and eighteen Development Standards, into the record. Glenn Miller came forward to represent the applicant and answer questions of the Board. Commissioner Brantner stated that Development Standards 418 and #11 are slightly different than the current State regulations, which require that the name of only one contact person be posted at the site if that persons's telephone number is recorded with emergency response agencies. He indicated that he felt the Development Standards should conform to the State regulations, and moved that Development Standards #l8 and #11 be amended to conform to the present State regulations. The motion was seconded by Commissioner Kirby. Following discussion, the motion carried unanimously. No public comment was received concerning this application. Commissioner Lacy moved to approve the Use by Special Review, subject to the Conditions recommended by the Planning Commission and the Development Standards, as amended. Kevin King, land surveyor, presented a plat showing the changes made in the boundary lines of the property. The Chairman asked Mrs. Harding if she had reviewed the recommendations and conditions as outlined by the Department of Planning Services staff. She stated they have no objections to any of these items. The Chairman called for discussion from the members of the audience. There was none. The plan has been to install this plant for the storage of liquids that are taken out of the natural gas. The Board of County Commissioners has given them permission to obtain a building permit prior to this request being approved. If the request is denied, they will have to remove all construction at their own expense. They are hoping there is enough gas in this area to develop it. Terry Cameron, Diversified Operating Corporation, reported if this area does develop, they will try to find a natural gas line in the area. If none can be found, the gas will be injected back into the well for storage. The Chairman asked the applicant if they had reviewed the comments, conditions, and development standards as outlined by the Department of Planning Services staff. Mr. Forson stated they have and object to development standard #3 which requires a chain link fence. They feel in this area a chain link fence is not needed and the cost is prohibitive. They would prefer putting in an oil field fence that would keep cattle out, otherwise they have no objections. Debbie deBesche stated the staff has added a new condition #4 to read as follows: 4. Within thirty (30) days of final approval by the Board of County Commissioners, the applicant/operator shall apply for the required Air Emissions Permit from the Air Pollution Control Division, Colorado Health Department. The following is Diversified Operating Company's ("DOC") formal request for this temporary use permit. At present DOC is in the process of drilling locations on a large block of acreage in the general area of 3 miles northwest of New Raymer, Colorado, Township 8 North, 'Range 58 West. Although the primary objective is to develop-oil production, there is associated natural gas being discovered with the oil . Four wells have presently been completed as producers. DOC must test the completed wells to determine if the economics are present to build a pipeline out of the area for sale of natural gas. Currently no pipeline company is interested in building a line to our acreage and buying the residue gas. DOC requests Weld County commissioners to allow DOC to Install and operate a natural gas liquids extraction equipment, on a plant site already secured from Clyde Krager in the SW/SW Section 22, TBN, R58W, for a period of six months. The closest occupied domicile, Clyde Krager's residence, is two miles southeast of the proposed location. At the end of the six months period, DOC will either have applied for a Special Use Permit for permanent facilities, or will remove the equipment. Two (2) eighteen thousand (18,000) gallon storage tanks. 3. A six (6) foot Chain link fence, topped -with three (3) strands of barbed wire, shall enclose the Use by Special Review area. A. The appearance of the facility shall be maintained in a neat and orderly _condition through periodic -painting and-maintenance. 5. All liquid storage tanks shall ,be bermed to contain the greatest amount of liquid possible that can be released from the largest storage tank, in the event of a spillage. 6. The soil erosion plan approved by the West Greeley Soil Conservation District shall be maintained on the subject -property. 7. All vessels containing flammable or 'dangerous materials shall be identified in accordance with the National Fire Protection Association, #704M identification system. 8. The operator shall -provide the New Raymer Fire Protection District a list of four (4) manes, phone numbers, and address of responsible parties it can contact twenty-four (24) hour-s -a day in case of emergency. 9. Smoking shall not be permitted at any time on the Use by Special Review area. NO SMOKING signs shall be placed and maintained on the subject site. 10. Fire extinguishers shall be maintained on the Use by Special Review site at all times. 11. A metal sign shall be placed on the property indicating the name and telephone number of the person(s) to _contact twenty-four (24) hours a day in the event of en emergency. The property owner or -operator shall be aesponsible for complying with the Design Standards of See ti-on 24.5 of the Weld County Zoning Ordinance. 13. -The property owner or -operator shall be _responsible for _complying with the operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 16. Personnel from the Weld County Health Department, New Rayner Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time An order to insure the activities _carried out on the -property comply with the Development Standards stated thereon and all applicable Weld County Regulations. 17.
