RE: PRELIMINARY HEARING FOR LOCAL IMPROVEMENT DISTRICT — 71ST AVENUE
A public hearing was conducted on March 1 , 1989, at 9:00 A.M. , with the
following present:
Commissioner C.W. Kirby, Chairman
Commissioner Jacqueline Johnson, Pro-Tem
Commissioner Gene Brantner
Commissioner George Kennedy
Commissioner Gordon E. Lacy
Also present:
Acting Clerk to the Board, Tommie Antuna
Assistant County Attorney, Lee D. Morrison
Engineering Department representative, Drew Scheltinga
The following business was transacted:
I hereby certify that pursuant to a Resolution of the Board, dated
February 1, 1989, a public hearing was conducted to consider the
petition for a Local Improvement District. The improvements of the
proposed Local Improvement District shall include 71st Avenue between
U.S. 34 Business Route (also known as West 10th Street) and U.S. 34
Bypass; 77th Avenue between U.S. 34 Business Route and 12th Street;
76th Avenue between 11th Street and 12th Street; 11th Street between
77th Avenue and 76th Avenue; and 12th Street between 77th Avenue and
76th Avenue. I further certify that letters were mailed to the
property owners in this area notifying them of the scheduled
preliminary hearing, said letters being mailed February 10, 1989. Lee
Morrison, Assistant County Attorney, made this matter of record. Drew
Scheltinga, Director of the Engineering Department, gave a presentation
concerning the cost estimates and approximate amount to be assessed on
each property, the preliminary plans and specifications, the materials
to be used, the number of installments and the period of time in which
the cost of improvements shall be payable and the property to be
assessed. Mr. Morrison said Robert and Georgia Grott; Mr. and Mrs.
Alvin R. Griffin; and Jim Dieken submitted letters stating their
opposition to this Local Improvement District. He said Dwight and Judy
Schmidt submitted a letter in favor of it, and Marvin R. Stewart
submitted a letter requesting that his two lots be considered as a
single parcel for the purpose of assessment. Those members of the
audience coming forward to speak in favor of the proposed district
were: Margaret Dolby, Renada Reigel, Bill Morris, and Roy Dolby. Those
speaking in opposition were: Bill Calkins, Ken Kaplan, Alvin Klein,
Gary Wiedeman, Gilford Alexander, Marvin Stewart, Anna Marie Gies, Dave
Knaus, Jim Dieken, Marie Klein, and Katherine Knaus. (Tape Change
#89-9 while Jim Dieken was speaking.) Board members, Mr. Warden, and
Mr. Morrison responded to questions of the audience. After discussion,
Commissioner Lacy moved to adopt the Intent Resolution and set the
hearing date as April 12, at 10:00 a.m. Seconded by Commissioner
Kennedy, the motion carried unanimously.
