RE: ACTION OF THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO, CONCERNING SITE APPLICATION OF THE TOWN OF PIERCE
AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Town of Pierce wishes to make improvements to
its existing wastewater treatment facility, on the following
described parcel of land, to-wit:
Part of the W1 of Section 36 , Township 8 North,
Range 66 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, the Regulations for Site Applications for Domestic
Wastewater Treatment Works require review of the Site Application
by the Board of County Commissioners before construction may be
started and, further , that various local and state agencies be
given the opportunity to review and comment on said Site
Application , and
WHEREAS, the Town of Pierce has submitted its Site
Application to the Board of County Commissioners of Weld County,
Colorado for review and comments, a copy of said Application being
attached hereto and incorporated herein by reference, and
WHEREAS, after study and review, the Board finds that said
Site Application is compatible with the Weld County Comprehensive
Plan and that it is in the best interest of Weld County to
recommend approval of said Application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Site Application
of the Town of Pierce be, and hereby is, recommended favorably to
the Colorado Department of Health as being compatible with the
Weld County Comprehensive Plan.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Site Application.

determine that each site location is consistent with the longrange, comprehensive planning for
:he are : in which it is to be located, that the plant on the proposed site will be managed to
-lninire the potential adverse impacts on water quality, and must encourage the consolidati.n;
wastewater treatment works whenever feasible,
,n making this determination, the Division requires each applicant for a site approval for a
.l ,nestic wastewater treatment works to supply an engineering report describing the project bni
:hawing the applicant' s capabilities to manage and operate the faility over the life of the
,r 'act to determine the potential adverse impacts on water quality. The report shall be
considered the culmination of the planning process and as a minimum shall address the
following:
Service area definition including existing population and population projections,
flow/loading projections, and relationship to other water and wastewater treatment plants
in the area.
Proposed effluent limitations as developed in coordination with the Planning and Stan ds
Section of the Division. (Allow minimum four weeks processing time. )
Analysis of existing facilities including performance of those facilities.
Analysis of treatment alternatives considered.
Flood plain and natural hazard analysis.
Detailed description of selected alternatives including legal description of the site,
treatment system description, design capacities, and operational staffing needs.
Legal arrangements showing control of site for the project life.
Institutional arrangements such as contract and/or covenant terms for all users which will
be finalized to accomplished acceptable waste treatment.
Management capabilities for controlling the wastewater throughout and treatment within the
capacity limitations of the proposed treatment works, i.e. , user contracts, operating
agreements, pretreatment requirements.
Financial system which has been developed to provide for necessary capital and continued
operation, maintenance, and replacement through the life of the project. This would
include, for example, anticipated fee structure.
Implementation plan and schedule including estimated construction time and estimated
start—up date.
Depending on the proposed project, some of the above items may not be applicable to address.
In such cases, simply indicate on the application form the non applicability of those.

RESOLUTION OF THE WELD COUNTY PLANNING COMMISSION
Moved by Doug Graff that the following resolution be introduced for passage
by the Weld County Planning Commission. Be it therefore Resolved by the
Weld County Planning Commission that the following be adopted.
REQUEST: Site approval for improvements to an existing wastewater
treatment facility
NAME: Town of Pierce, Colorado
ADDRESS: P.O. Box 57, Pierce, Colorado 80650
LEGAL DESCRIPTION: Part of the W} of Section 36, T8N, R66W of the 6th P.M. ,
Weld County, Colorado
LOCATION: Approximately one mile southeast of Pierce; south of Weld County
Road 88 and east of Weld County Road 35
be approved for the following reasons:
The Town of Pierce has received grant and loan funds from the State
Department of Local Affairs to construct improvements to existing sewage
treatment lagoons. The proposed improvements consist of the addition of two
5 horsepower surface aerators and three infiltration ponds as well as the
addition of a greasetrap and modification of the gravity inlet line to
reduce maintenance. The construction will take place on or adjacent to the
existing facility, which is located on laud owned by the State.
In reviewing site applications for wastewater treatment facilities, the
State Health Department Water Quality Control Division directs the planning
agency to comment on the relationship of the treatment works to the local
long-range comprehensive plan for the area as it affects local water quality
and consider whether there is sufficient capacity to serve the proposed
development.
The Planning Commission's approval based upon the following:
Environmental Protection Policy #2, pages 78-79 of the Weld County
Comprehensive Plan, states:
Any land-use that will pollute any stream, body of water,
subsurface aquifer, aquifer recharge, the air or the surrounding
surface will require the development of a proper treatment
facility or environmental protective operation before said
land-use can be allowed.
The subject proposal has been reviewed and approved by the Larimer-Weld
Council of Governments 208 Water Quality Board. The Weld County Health
Department is recommending approval of the proposal, which is scheduled to
be reviewed by the Board of Health on August 26, 1986.

sewage treatment lagoons which were constructed in 1969 .
Improvmements proposed consist of the addition of a grease trap,
modification of the gravity inlet line to reduce maintenance ,
the addition of 2 , 5-hp surface aerators and the construction of
percolation ponds to dispose of effluent without surface discharge.
All proposed facilities are to be constructed on or adjacent to
the existing site.

utility (wastewater treatment facility improvements) .
LEGAL DESCRIPTION: Part of the W} of Section 36, T8N, R66W of the 6th
P.M. , Weld County, Colorado.
LOCATION: Approximately one mile southeast of Pierce; south of Weld County
Road 88 and east of Weld County Road 35.
be approved by the Weld County Planning Commission for the following
reasons:
1. The submitted materials are in compliance with application requirements
of Section 25.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Weld County Planning Commission that the
applicant has shown compliance with Section 25.8 of the Weld County
Zoning Ordinance as follows:
- Alternatives to this proposal have been adequately assessed
and the proposed action is consistent with the best interest
of the people of Weld County. Reasonable efforts have been
made to minimize the impacts on croplands in the Agricultural
Zone district;
- The expansion of the wastewater treatment facility will
utilize an area immediately adjacent to the existing
treatment site. The site selection area is zoned
Agricultural and preserves agricultural land by placing the
improvements adjacent to the existing treatment facility;
- The proposal will not have an undue adverse effect on
existing and future development of the surrounding area as
set forth in Ault's Comprehensive Plan. The area is zoned
Agricultural. Crop production remains the predominant use in
the area;
- The nature and location for expansion of the facility will
not unreasonably interfere with any significant wildlife
habitat and will not unreasonably affect any endangered
wildlife species, unique natural resource, historic landmark,
or archaeological sites;

- The site shall be maintained in such a manner so as to
control soil erosion, dust, and the growth of noxious weeds;
- The design of the proposed facility mitigates negative
impacts on the surrounding area to the greatest extent
possible;
- No overlay districts affect the site; and
- Use by Special Review Development Standards will provide
adequate protection of the health, safety and welfare of the
neighborhood and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. The Use by Special Review activity shall not occur nor shalt any
additional building or electrical permits be issued on the
property until the Use by Special Review plat has been delivered
to the Department of Planning Services' office and the plat is
ready to be recorded in the office of the Weld County Clerk and
Recorder.

DEVELOPMENT STANDARDS
Town of Pierce, Colorado

1. The Use by Special Review permit is for expansion of a wastewater
treatment facility for a public utility as submitted in the
application materials on file in the Department of Planning
Services and subject to the Development Standards stated hereon.
2. The Use by Special Review site shall be entirely enclosed with a
three (3) strand barbed wire fence.
3. Warning signs identifying the sand-use shall be placed at sixty
(60) foot intervals entirely around the Use by Special Review
site. The maximum area of the signs shall be fifteen (15) square
feet and shall be of sufficient size to be read at a distance of
two hundred (200) feet.
4. Ail Construction done on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
5. The property owner or operator shall be responsible for complying
with the Design Standards of Section 24.5 of the Weld County
Zoning Ordinance.
6. The property owner or operator shall be responsible for complying
with the Operation Standards of Section 24.6 of the Weld County
Zoning Ordinance.
7. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to insure the activities
carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.
8. The Use by Special Review area shall be limited to the plans shown
hereon and governed by the foregoing Standards and all applicable
Weld County Regulations. Any material deviations from the plans
or Standards as shown or stated shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and
the Board of County Commissioners before such changes from the
plans or Standards ate permitted. Any other changes shall be
filed in the office of the Department of Planning Services.
9. The property owner or operator shall be responsible for complying
with all of the foregoing Standards. Noncompliance with any of
the foregoing Standards may be reason for revocation of the Permit
by the Board of County Commissioners.
