HomeMy WebLinkAbout870075.tiff RESOLUTION RE: APPROVE BASIC MEMORANDUM OF UNDERSTANDING BETWEEN WELD COUNTY AND COLORADO STATE UNIVERSITY, COOPERATIVE EXTENSION SERVICE, AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Basic Memorandum of Understanding between Weld County and Colorado State University, Cooperative Extension Service, for Cooperative Extension work, and WHEREAS, the terms and conditions are as stated in said Memorandum of Understanding, a copy being attached hereto and incorporated herein by reference, and WHEREAS, after review, the Board deems it advisable to approve said Memorandum of Understanding. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Basic Memorandum of Understanding between Weld County and Colorado State University, Cooperative Extension Service, for cooperative extension work be, and hereby is , approved. BE IT FURTHER RESOLVED by the Board that the Chairman be , and hereby is , authorized to sign said Memorandum of Understanding. WITNESSETH THAT: WHEREAS, County desires to participate in the educational work as authorized by the Smith-Lever Act, as amended, and other acts supporting Cooperative Extension work which includes the conduct of Extension work in agriculture and related fields, home and family living, 4-H and youth and community services and resource development education In the county; and, WHEREAS, Extension is authorized by State and Federal law to conduct Cooperative Extension work in the State of Colorado; and, WHEREAS, Extension and County desire to enter into this Memorandum of Understanding as a master document to set out the nature of the program and the relationship of the parties: NOW, THEREFORE, the parties do hereby agree to expend their best efforts to conduct and support a Cooperative Extension program under the following terms and conditions: Section 1. County agrees: (a) To furnish suitable office space, and pay the essential costs of utilities, travel, office expense, supplies and equipment needed in the conduct of Cooperative Extension work in the county. (b) To provide the applicable amount of the professional staff personnel costs based on a formula to be developed within the guidelines promulgated by the State Legislature. (c) To provide necessary clerical and secretarial personnel. (d) To submit to the Director of the Colorado Cooperative Extension Service a copy of the county budget approved for Items (a), (b) and (c) above. The budget will be certified as true and correct by the responsible county officer and will be submitted prior to the beginning of each calendar year. Section 2. Extension agrees: (a) To maintain at Colorado State University an office of Cooperative Extension for the management and conduct of all Cooperative Extension work. (b) To maintain a professional staff available for assistance to the programs conducted In the county. (c) With the approval of the County, recruit and supervise professional staff to serve in the County. (d) To provide that portion of the professional staff personnel costs which is determined under the formula developed. Section 3. Extension and County mutually agree: (a) That the personnel costs of Bit (6) professional FTE's (fulitime equivalents) will be provided by the parties as described in Section 1 (b) and 2 (d) above. This agreement will in no way limit either party at Its sole discretion from employing additional professional or paraprofessional personnel in the County Extension Office atits awn expense. (b) To notify the other party in writing at least ninety (90) days prior to any expected major change in program which would affect the professional personnel or support of the program. (c) The CSU Cooperative Extension Service, as a publicly funded educational organization, operates in compliance with the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, and the Rehabilitation Act of 1973, and as such, all programs, activities and employment opportunities are available without regard to race, color, national origin, sex, religion, age or disability. Section 4. This Memorandum of Understanding shall remain in full force and effect from year to year until terminated by either party by written notice given ninety (90) days prior to the anticipated time of termination.
