HomeMy WebLinkAbout850761.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT NO. 1022 - GEORGE AND PATRICIA CASTOR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 29th day of May, 1985 , considered the request of George and Patricia Castor for a mobile home to be used during a medical hardship, and WHEREAS, said mobile home is to be occupied in an A-Agricultural Zone District on a parcel of land being more particularly described as follows: Lot 4 , Block 52 , Aristocrat Ranchettes Subdivision, Weld County, Colorado WHEREAS, the Board of County Commissioners , having heard the testimony, finds that said request should be granted subject to the following conditions: 1) The applicant shall apply for a building permit for the mobile home within thirty days from the date of approval by the Board of County Commissioners; 2) A septic permit shall be obtained and the site shall meet percolation test requirements prior to the issuance of a building permit; 3) Prior to the issuance of a building permit, the owner shall submit evidence that the water tap or well is supplying water in such a manner as to be adequate in quality, quantity and dependability for the proposed use; and 4) The mobile home shall not be occupied until such time that the applicant has complied with the above mentioned conditions. Legal Description of Parcel: Lot 4, Block 52 Aristocrat Ranchettes Subdivision Location: 1 mile northeast of Ft. Lupton The Department of Planning Services staff has reviewed this request and recommends that the request be approved for the following reasons: WILL WILL NOT X Be compatible with the Weld County Comprehensive Plan. X Be compatible with the surrounding area. X Be in harmony with the character of the neighborhood. X Adversely affect the immediate area. X Be adequately served by water and sewage disposal facilities. X Adversely affect the general health, safety and welfare of the inhabitants of the area and the County. COMMENTS: A similar request for a medical hardship zoning permit was presented to the Board of County Commissioners on October 21, 1981 as ZPMH-488 as a result of a violation action by the department. The request was denied. It is unclear whether the mobile home was ever removed from the property. While the Department is recommending approval of a second mobile home to be used as a medical hardship today, it should be noted that, it appears the Castors are operating a day care center from the property. The department is presently investigating the day care center as a possible zoning violation. It is unclear at this time what involvement Patricia Castor has in the day care center operation. The intent of the medical hardship zoning permit is to provide living quarters for someone responsible for the supervision and care of an individual needing medical care. It is not the staff's desire to issue a zoning permit for medical hardship to someone that will be involved with the day care center operation and not the medical supervision and care of Patricia Castor. The staff would recommend that the Board be reasonably sure that the mobile home be used for medical hardship purposes before granting approval. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant applying for a building permit for the mobile home within thirty (30) days from the date of approval by the Board of County Commissioners. 2. A septic permit shall be obtained and the site shall meet percolation test requirements prior to the issuance of a building permit. 3. Prior to the issuance of a building permit, the owner shall submit evidence that the water tap or well is supplying water in such a manner as to be adequate in quality, quantity and dependability for the proposed use. 4. She takes the following medications: 70 units of NPH a day; Hydrochlorothiazide, 50 mg. b.i.d. ; Dilantin, 200 mg. q.i.d. ; Tegretol, 200 mg. q.i.d. ; Digoxin, 1 tablet a day and potassium, 1 tablet a day. Because of her multiple illnesses and rather complex medications and sight problems, it is necessary for this patient to have someone with her. It is my understanding that in order to do this she will need to move another trailer into her court for the person to live in. I certainly hope you will allow this to maintain Ms. Caster's medical conditions in a stable condition. Thank you very much for your help.
