RE: APPROVE AMENDMENT TO RECORDED EXEMPTION NO. 482 - RALPH AND
CAROLYN PRIOR
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on February 18 , 1981 , the Board of County
Commissioners approved Recorded Exemption No. 482 for Ada May
Guard, for property described as part of the Southwest Quarter of
Section 33 , Township 7 North, Range 66 West of the 6th P.M. , Weld
County, Colorado, and
WHEREAS, Ralph and Carolyn Prior, having Power of Attorney
from Ada May Guard , are requesting that Recorded Exemption No. 482
be amended to enlarge Lot A from 1 . 90 acres, as stated in the
original Recorded Exemption, to approximately 3 acres, and
WHEREAS, after study and review, the Board deems it
appropriate to approve said amendment to Recorded Exemption No.
482.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described amendment to Recorded Exemption No. 482 for Ralph and
Carolyn Prior be, and hereby is , approved.
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations . The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Re: Amended Recorded Exemption RE-482
Dear Commissioners:
This request fur a recorded exemption is submitted by Ralph and Carolyn
Prior. The parcel of land on which this request is being made is described
as part of the SWi of Section 33, T7N, R66W of the 6th P.M. , Weld County,
Colorado. The property is located approximately 3 miles west of Eaton,
north of Weld County Road 74 and east of Weld County Road 29. Lot A is the
total contiguous land holdings of the applicant. The applicant does have
power of attorney from Ada May Guard, owner of Lot B, in submitting this
amendment.
The request is to divide the property into parcels of 2.75 acres and 67
acres, more or less. Lots A and B have existing residences located on the
property. The Prior's wish to amend recorded exemption #482 to enlarge Lot
A by approximately one acre. They wish to build a second residence on Lot A
for their own use and then reclassify the existing residence to accessory to
farm use (subject to the approval of a zoning permit for an accessory
dwelling) .
The following referral agencies have reviewed the application materials and
have no objections to the request:
- Town of Eaton
- Weld County Health Department
The Department of Planning Services staff reviewed the Prior's proposal on
June 11, 1986, and has concerns for approving a request to enlarge Lot A to
2-3/4 acres with the intent of having two dwellings on the parcel. The

existing dwelling presently serves as a residence for hired help. The
employees assist in farming and feeding cattle on surrounding acreages
leased by the Priors. The applicants have demonstrated a need for farm
help; however, if the amendment of Recorded Exemption 482 is granted, both
an accessory to farm dwelling and a principal dwelling would exist on a
2-3/4 acre parcel.
The staff requests that the Board of County Commissioners consider this
recorded exemption application and determine if the standards of Section 9-2
E. (1) (a) through (m) have been met.
