RE : APPROVE INTERGOVERNMENTAL AGREEMENT BETWEEN WELD COUNTY AND
CITY OF EVANS AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board has been presented with an Inter-
governmental Agreement between Weld County and the City of Evans
regarding implementation of a Rental Rehabilitation Program, and
WHEREAS, the terms and conditions are as stated in said
Agreement, and
WHEREAS, after review, the Board deems it advisable to
approve said Intergovernmental Agreement, a copy of which is
attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Intergovernmental
Agreement between Weld County and the City of Evans regarding
implementation of a Rental Rehabilitation Program be, and hereby
is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be , and
hereby is , authorized to sign said Intergovernmental Agreement.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 28th day of
September, A.D. , 1987 .

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT, entered into this 15th day of SeEtember
19_ 87, by and between the BOARD OF COMMISSIONERS OF WELD COUNTY ,
COLORADO, a body politic of the State of Colorado, hereinafter called
"the COUNTY" and the Ci y of Evans, , a body politic
hereinafter called the City._
WI TNESSETH:
WHEREAS, pursuant to the Housing and Urban-Rural Recovery Act of
198.7., hereinafter called "the ACT, " the United States, acting by and
through the Secretary of the Department of Housing and Urban
Development, hereinafter called "HUD, " has made available to the State
of Colorado certain funds for the implementatic-:• of a Rental
Rehabilitation Program; and
WHEREAS the State of Colorado, through the Department of Local
Affairs has the :Legal authority to provide funds to counties for
Rental Rehabilitation activities and
WHEREAS, the City. has expressed interest in a.1 iot nq the
program to operate within its jurisdiction; and
WHEREAS, the County has indicated a. willingness to submit
program proposal to the State to carry out the HUD Rental
Rehabilitation ; and
WHEREAS, the parties hereto desire to provide assurances and
delineate the areas of cooperation between the County and the

NOW. THEREFORE, in furtherance f said RESOLUTION, and in
consideration of the mutual conditions, covenants and agreements
herein contained, it is agreed by and between the parties as follows:
1 . Planning the Rental Rehabilitation Program: The parties,
through their executives and staff , shall coopeOate with each other in
developing the Rental Rehabilitation proposal , with all parties giving

rules and regulations of the ACT.
2. Term of the Agreement: This Agreement shall remain in full
force and effect for so long as the parties to this Agreement are
pursuing Rental Rehabilitation funding for said proposed project or,
if awarded, carrying out such project activities. Any party to this
Agreement may, however, terminate its participation in this Agreement
sig months after providing written notice of such termination to the
other parties to this Agreement. This Agreement may be terminated at
any time by agreement of all parties to this Agreement unless a grant
contract. is in effect with the State. In this case, the State must
approve such termination and arrangements for completing the project.
3. Authorization to Submit a Proposal : The County is authorized
to submit a proposal to the State on behalf of the CitY.._.. - - to
apply for funds under the HUD Rental. Rehabilitation Program; and to act

agrees to indemnify the City from any and all liability,
loss or damage the City may suffer in connection with the
administration of the project upon approval of the proposal .

CITY OF EVANS, COLORADO
ORDINANCE NO. 686-87
AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE CITY OF EVANS AND
THE COUNTY OF WELD CONCERNING THE RENTAL REHABILITATION PROGRAM.
WHEREAS, the Department of Housing and Urban Development is
making available to the State certain funds for the implementa-
tion of a Rental Rehabilitation Program, and
WHEREAS, Weld County and the City of Evans wish to apply to
the State for such funds to be used within the City of Evans for
rental housing rehabilitation , and
WHEREAS, the city staff of the City of Evans has- recommended
that the CIty of Evans cooperate with the County of Weld in
applying for a grant , and
WHEREAS, an emergency exists in that the application must be
submitted no later than September 25 , 1987 for its approval .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EVANS, COLORADO:
1 . The recitals above set forth are incorporated herein by
reference for all purposes as though set forth in full .
2 . The Intergovernmental Agreement attached hereto is
approved , and the Mayor and City Clerk are authorized and
directed to execute such agreement .
3 . This Ordinance is immediately necessary for the
preservation of the public peace, health and safety .
INTRODUCED, READ AND APPROVED ON FIRST READING as an
Emergency Ordinance this 15th day of September , 1987.
