WHEREAS, the Board of County Commissioners of Weld County,

WHEREAS, with the recent enactment of Senate Bill No. 158 ,
o which amended Section 24-33 .5-226 (1) (e) , C.R.S. , the Board of
County Commissioners of Weld County, Colorado, and/or the Wel4

portion thereof for the purpose of conducting athletic or special

WHEREAS, it is the desire of the Board of County
Commissioners of Weld County to regulate the partial or complete
closure or restriction of all Weld County roads for the purpose of
conducting athletic or special events thereon, pursuant to Section
24-33 . 5-226, C.R.S.
NOW, THEREFORE, BE IT ORDAINED by the Board of County
Commissioners of Weld County, Colorado, that the following
regulations concerning the conducting of athletic or special
events on Weld County roads are hereby adopted:
I . INTENT
It is the purpose of this Ordinance to regulate the partial
or complete closure of Weld County roads for the purpose of
conducting athletic or special events thereon, or for the purpose
of ensuring the safe and efficient movement of traffic to and from

or around an athletic event or special event which is in such
proximity to a Weld County road that the event or any traffic
attendant thereto will have a significant effect on the regular
traffic flow on Weld County roads.

0 3 The term "close" or "closure" as used in this Ordinance shall
° Z be deemed to include the partial closure of any lane or other
m • portion of a Weld County road or the restriction or regulation of
o traffic on the Weld County road by the Weld County Sheriff.

III . CLOSURE OF A WELD COUNTY ROAD BY THE WELD COUNTY SHERIFF
a The Weld County Sheriff has the authority to close a Weld
• County road or a portion thereof for the purposes as set forth in

coo Section I . above. A closure by the Weld County Sheriff may be
z authorized only if:

NE A. Written application therefor is submitted to the Weld
a County Sheriff and approved by him. Said application
must contain such information as the Sheriff deems

N w necessary and must be submitted to the Sheriff at least
.� thirty (30) calendar days prior to any contemplated
w z athletic or special event which will utilize Weld County
FCC Roads. The form of said application will be
o substantially similar to that which is attached hereto
u r4 as Exhibit "A. "

co B. The applicant pays to the Weld County Sheriff at the
time he submits the application an amount estimated by
.N-+ o the Sheriff to be the actual cost of the Sheriff ' s
Office for processing the application, and the applicant
agrees to pay in accordance with Section IV.A. of this
Ordinance the actual cost of the Sheriff' s Office in
providing any services for conducting the closure . Such
costs shall include any regular or overtime salaries,
equipment, and fuel.
C. The applicant agrees to pay for and provide evidence of
liability coverage as determined by the Weld County
Sheriff, to protect Weld County, by and through the
Board of County Commissioners of Weld County, the Weld
County Sheriff, and their employees , from any liability
for any injuries or damages which may arise out of the
closure or the Weld County Sheriff' s assistance in

a ensuring the safe conduct of the closure. Nothing in
w this paragraph C. shall be construed as a waiver by Weld

IV. FEES AND INSURANCE
If the closure application is approved by the Weld County
Sheriff, the applicant shall:
A. Pay to the Weld County Sheriff prior to the closure the
amounts the Sheriff estimates to be the costs of the
Sheriff 's Office in conducting the closure . Said costs
may include, but are not limited to, the following:
1 . Equipment time, personnel time, and fuel used by
Weld County Sheriff' s Office Deputies in conducting
the closure.

N days, or by both such fine and imprisonment.

ag VI . SEVERABILITY
CO ° If any section, subsection, paragraph, sentence, clause, or

{-Ay, phrase of this Ordinance is for any reason held or decided to be
invalid or unconstitutional, such decision shall not affect the
m w validity of the remaining portions . The Board of County
Commissioners hereby declares that it would have passed this
Ordinance and each and every section, subsection, paragraph,
sentence, clause, or phrase thereof irrespective of the fact that
any one or more sections , subsections, paragraphs, sentences,
clauses, or phrases might be declared to be unconstitutional and
invalid.
VII . EFFECTIVE DATE
This Ordinance shall become effective five (5) days after the
final publication of this Ordinance.

UApplicant is responsible, pursuant to Weld County Ordinance No. 153 , for
the total actual cost to the Weld County Sheriff's Office for conducting any

M closure of a street or highway for the purpose of an athletic or special
event. Applicant is further responsible to pay for and provide liability
insurance in such amount and for such coverage as may be required by the
Weld County Sheriff sufficient to protect Weld County and the Sheriff from

o any liability for injuries or damages which may arise out of the closure.
Such insurance must include general liability and auto liability, must
o H extend coverage to spectators and participants, and must name "Weld County,
Colorado, by and through the Board of County Commissioners of Weld County,
the Weld County Sheriff, and their employees" as additional insureds.

d' Applicant must pay in advance the estimated cost of such closure. Any
N N actual cost in excess of the estimated cost will be billed to the applicant.

• d Please read the following instructions carefully before completing this

application for a permit to conduct an athletic or special event on the

THE PROCEDURES FOR OBTAINING A PERMIT FOR AN ATHLETIC OR SPECIAL EVENT ARE
AS FOLLOWS:
1 . Complete this application supplying all required information. The
information must be detailed. Attach explanations if necessary. A map
showing the proposed route or area of activity must be attached.
Include on the map all suggested traffic control points and any
suggested detours.
2. A signed application must be submitted to the Weld County Sheriff's
Office at least 30 calendar days prior to the event.
3. A $25.00 application fee must accompany the application.
4. If the application receives preliminary approval, it will be returned
containing a statement of total estimated cost and the amount of
liability insurance that will be required. The application must be
resubmitted with a certified check payable to the Weld County Treasurer
EXHIBIT "A"
in the amount of the total estimated cost and a certificate evidencing
an insurance policy in the required amount.
