RE: APPROVE ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT BETWEEN
WELD COUNTY, COLORADO, AND DIVERSIFIED OPERATING CORPORATION
AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and m to

WHEREAS, the Board has been presented with a Road Maintenance LA

and Improvements Agreement between Weld County, Colorado, and w -a
Diversified Operating Corporation concerning an open-cut gravel
pit located in the NWi of Section 14 , Township 8 North, Range 58 • n

WHEREAS, the Owner has applied to the County for a Use by o

WHEREAS, the gravel pit will generate an increase in heavy
truck traffic, and

WHEREAS, the existing County roads that serve the gravel pit H o
will require increased maintenance and improvements due to the z
increase in heavy truck traffic, and r N

WHEREAS, the County and the Owner have reviewed the proposed
maintenance and improvements conditions and acknowledge they will a, ;
enhance the accessibility and safety of the roads that serve thetv

gravel pit.

NOW, THEREFORE, in consideration of the mutual covenants and
conditions hereinafter set forth, the County and Owner mutually ttl +a

1. The County road that service the gravel pit are Weld d
County Road 129 for 4 miles south and 1 mile north of
the pit entrance; Weld County Road 127 from Road 86, 2 8 A,
miles north; Weld County Road 86 between Roads 127 and

2. The Owner agrees to adequately repair any damage on the
entire haul route as described above that is created by
heavy truck traffic hauling from the owner's gravel
pit.
3. The Owner will be responsible for providing adequate
dust abatement along said haul route.

Dear Keith:
As we discussed, Diversified Operating Corporation wishes to mine gravel
from the "Lindsey Pit" located in the NW-NW, Section 14, T8N, R58W, Weld
County, Colorado.
The State of Colorado has in the past operated the pit under USR-407.
We have requested a copy of the applicable development standards as found in
Book 913, Reception No. 1834839.
It is our request that Diversified Operating Corporation be given permission
from the Weld County Commissioners to operate the gravel pit according to the
standards set forth in USR-407, thus saving time and money for both Weld
County and ourselves.

Re: The transfer of Special Use Permit #407:79:28 from the State of
Colorado to Diversified Operating Corporation.
Dear Mr. Miller:
Thank you for your letter dated June 15, 1987, in which Diversified
Operating Corporation is requesting to be allowed to operate the "Lindsey
Gravel Pit", located in a portion of the NWi NWi of Section 15, T8N, R58W of
the 6th P.M., Weld County, Colorado.
The Department of Planning Services Staff reviewed your request and
determined that Diversified Operating Corporation could operate the existing
gravel pit under the Special Use Permit #407:79:28. The Lindsey Permit must
be operated in compliance with the 15 operation standards approved for
Special Use Permit #407:79:28.
Please submit to the Department of Planning Services a copy of the following
as required by the Development Standards prior to the use of the site:
1. $100,000 liability insurance policy.
2. A fugitive dust emission permit must be obtained from the Colorado
Department of Health.
3. Access and haul routes approved by the Weld County Engineering
Department.
In addition to the above listed items, the Mined Land Reclamation Board may
also require additional permits. The Mined Land Reclamation Board's address
is 1313 Sherman Street, Denver, CO. 80203, and their phone number is
866-3567.
