RE: DECLARE CERTAIN EQUIPMENT AS SURPLUS AND AUTHORIZE AUCTION
AGREEMENT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, State statute and the Weld County Administrative
Manual require that all items disposed of be declared surplus by
the Board of County Commissioners, and
WHEREAS, it has been determined that certain Road and Bridge
equipment be declared as surplus, a list of said items being
attached hereto and incorporated herein by reference, and
WHEREAS, Ritchie Bros. Auctioneers has offered to auction
said equipment, with a guarantee to Weld County of $150,000 gross,
at 12% commission, and a 70/30 split on anything over the
$150,000, being 70% for Weld County and 30% for Ritchie Bros.
Auctioneers, and
WHEREAS, Ritchie Bros. Auctioneers' offer exceeds all
trade-in values or outright purchase offers the County has
received for said equipment, and
WHEREAS, the Board deems it advisable to declare the listed
Road and Bridge equipment as surplus, and to accept the offer of
Ritchie Bros. Auctioneers.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Road and Bridge
items as listed be, and hereby are, declared surplus property.
BE IT FURTHER RESOLVED by the Board that the offer of Ritchie
Bros. Auctioneers to auction said equipment, with the terms being
as hereinabove stated, be, and hereby is , accepted.

Dear Mr. Duncan:
This is to advise you formally that the Board of County Commissioners of
Weld County accepted today the attached offer made by you on April 18, 1986
via Mr. George Goodell. The Board accepts option one which is as follows:
Richie Brothers Auctioneers (R.B.A.) will guarantee Weld County
$150,000 gross at auction with a 12% commission and a 70/30
split on anything over the $150,000, that is 70% for Weld County
and 307, for R.B.A.
Please coordinate the delivery and auction arrangements of the equipment
with Mr. Goodell.

Dear George,
As to our several conversations, Ritchie Bros. Auctioneers
will offer the following alternatives on the sale of the
equipment as per the attached Schedule "A".
1. R.S.A. will guarantee Weld County $150,000 gross
at auction with a 12% commission and a 70/30 split
on anything over the $150,000, that is 70% for Weld
County and 30% for R.B.A.
2. R.B.A. will auction Weld County' s equipment for a
straight 10% commission.
In both alternatives, we estimate your maximum repair budget
to be $5000.00. This figure would include cleaning, sand-
blasting, painting and decaling. Our commission rate covers
all advertising and sale site costs .
The above offer is good until May 9, 1986 and would be F.O.B.
our sales site located at 821 Weld County Rd. 27, Brighton,
Colorado. We are looking at conducting an auction in June.
I hope that we can be of service to Weld County on this
equipment and any future equipment. We look forward to
your decision. Thank you for your time and consideration
in this matter.
