RE: APPROVAL OF RECORDED EXEMPTION NO. 938 - ROBERT AND VICTORIA
WORKMAN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 938 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 938 was
submitted by Robert and Victoria Workman for property which is
located in part of the SE' , Section 18 , Township 4 North, Range 68
West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately 12 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Dear Commissioners:
This request for a recorded exemption is submitted by Robert and Victoria
Workman. The parcel of land on which this request is being made is described
as part of the SE} of Section 18, T4N, R68W of the 6th P.M. , Weld County,
Colorado. The property is located approximately 2 miles east of Berthoud
north of Colorado Highway 56 and west of Weld County Road 3. The parcel of
land under consideration is the total contiguous land holdings of the
applicant.
The request is to divide the property into parcels of 11.69 acres and 4.59
acres, more or less. The applicant wishes to retain the larger parcel and
maintain its present use and sell the smaller parcel to a brother-in-law as
a rural residential homesite. Both proposed lots will have access and
adequate frontage to Weld County Road 3.
The Weld County Health Department and the Colorado Highway Department have
reviewed the application materials and have uo objections to the request.
The Department of Planning Services Staff reviewed the recorded exemption
request on Wednesday, October 22, 1986, and has concerns for approving a
request to subdivide a parcel of 16 acres into smaller parcels in a section
of land with existing numerous small parcels. The staff feels that
development in the area has reached a point that this request would evade
the Weld County Subdivision Regulations and would not be consistent with
efficient and orderly development.

Recorded Exemption application and determine if the standards of Section 9-2
E. (1) (a) through (m) have been met.

Dear Mr. Workman;
This letter is in response to your request that the Little Thompson
Water District commit to supply domestic water service to an
additional residence to be located immediately north of the present
residence at 21167 Weld County Road 3, Berthoud, Colorado.
The District presently has a 4 " main located on the west side of
Weld County Road 3 at the above address . There is additional capacity
in this line at the present time.
Therefore, the District will commit to provide an additional residence
with domestic water service. This committment will expire one year
from the date of this letter if a tap has not been purchased and
installed by that date. The current tap fee for a standard 5/8 x 3/4
residential tap is $3 ,000 . 00 and is subject to change without notice .

WELD COUNTY PLANNING DEPARTMENT
Dear Sirs:
"PURPOSE & REASON"
During the past year there have been financial changes in my life which have
forced me to attempt salvaging my assets by selling approximately 4.5 acres
to my brother-in-law. My brother-in-law, Paul Davis, has occupied a mobile
home at my address for nearly four years. This exemption would solve two
problems and greatly aid both of us. Upon the building of Mr. Davis's
residence on the proposed exemption, the mobile home would be removed.
"CONSISTENT WITH POLICIES OF WELD COUNTY COMPREHENSIVE PLAN"
In general my understanding of the comprehensive plan for Weld County is to
allow for orderly separation and development within the confines of the
County. The area in which I live has changed from primarily agricultural
use to residential. My property address is 21167 Weld County Road 3. We
are located two miles east of Berthoud. The square mile in which I live has
developed into a number of separate land owner's private residences. This
land use is very consistent all the way to Berthoud on Colorado Highway 56,
as well as along Weld County Roads 1 & 3. Our property is on the east
fringe of this land use, as most of the property to the east returns to
large farm acreages.
"CONSISTENT WITH THE INTENT OF THE ZONE DISTRICT"
In this I must only assume that the exemption would be consistent with the
area due to numerous other parcels of land which have the same use as the
intended land use planned for my property, as well as Mr. Davis. That being
a single family dwelling.
"WHAT USES WILL BE PERMITTED"
The only uses of the proposed properties will be that of single family
residences. Each land owner may wish to keep domestic livestock and
domestic animal pets, keeping in mind the limit requirements set forth by
Weld County. This use, I believe, is compatible with the surrounding land
uses due to the fact that within two miles of my property there are upwards
of 50-75 other landowners with the exact same land uses, that being single
family residences.
"FUTURE USES OF COMPATIBILITY"
As the pressure increases for living sites, I believe that the areas of
smaller concentrations will give way to more residences in regards to given
acres. Due to the close proximity of my property to Berthoud proper, the
concentration will start next to the City and slowly move outwards due to
utilities and other services, i.e. , fire, police, etc. It would be very
difficult to estimate the time it will take for the City to enclose my
property area, but due to current trends, I do not believe that ten to
fifteen years is out of touch.
"CONSISTENT WITH EFFICIENT & ORDERLY DEVELOPMENT"
This proposal will not be inconsistent with the orderly development of the
area due to the fact that the area in which the property is located is

comprised of acreages of three to four acres up to areas of twenty to thirty
acres. These acreages are completely residential in nature.
"WATER & SEWAGE DISPOSAL METHODS"
The water supply in this area is the Little Thompson Water District.
Located in Berthoud. The supply line is buried in Weld County Road 3 and
the proposed exemption property has 381' of frontage on Weld County Road 3.
Therefore, there would be no problem in Little Thompson Water District
placing a meter and supply line for the new residence.
Sewage disposal must be accomplished by the use of a septic system. The 4.5
acres would more than amply handle the shed water from the system. The
water tap and septic system will need to be designed to fit whatever
residence style the new owner selects.
"PROPERTY LOCATION"
The property in question is located on a bluff site, the nearest water way
is the Little Thompson River, located nearly 1i miles to the south. There
is no possible way any amount of precipitation could put the land in
question in any danger.
The question of possible geologic hazard is difficult to address, but there
are no known problems existing.
Due to the remote location the question of conflict with the Weld Airport
District is negative.
In review, the sale of the property to my brother-in-law will allow my
family to remain in our home. I have a son in the local school district
and would like to remain there for the duration of his schooling.
The exemption would remove an existing non-conforming mobile home and
replace it with an attractive home.
The exemption will not deter from the area as there are numerous small
tracts in the immediate area.
