RE: APPROVE BUS STOP EASEMENT TO CITY OF GREELEY AND AUTHORIZE
CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Bus Stop
Easement whereby the City of Greeley is granted a permanent bus
stop easement for a bus stop shelter at the Walton Building, and
WHEREAS, said Bus Stop Easement concerns property described
as follows :
A parcel of land being a part of the north
half of the vacated portion of "B" Street and
adjacent to Lot 26 , Block 33 , Clayton Park,
City of Greeley, Weld County, Colorado, being
the north 22 feet of the east 10 feet of the
north vacated portion of "B" Street.
WHEREAS, after review, the Board deems it advisable and in
the best interests of the citizens of Weld County to approve said
Bus Stop Easement, a copy of which is attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Bus Stop Easement
be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Bus Stop Easement.

RE: BUS STOP EASEMENT
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 1st day of
June, A.D. , 1988 .

BUS STOP EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that the Walton Building
hereinafter referred to as "Grantor", hereby
grants and conveys to the City of Greeley, Colorado , a Municipal
corporation , hereinafter referred to as "Grantee" , a permanent
bus stop easement for a bus stop shelter . Below is the
description of the bus stop easement .
A parcel of land being a part of the North half of the
vacated portion of "B" Street and adjacent to Lot 26 , Block
33 , Clayton Park , City of Greeley, Weld County, Colorado ,
being the North 22 feet of the East 10 feet of the North
vacated portion of "B" Street .
The permanent bus stop easement hereby granted shall entitle
the Grantee, its successors and assigns , to construct , replace ,
repair , inspect , maintain , remove and operate a bus stop shelter
and all appurtenances thereto. The permanent bus stop easement
also shall permit uses clearly incidental to those specified and
shall include the right of ingress and egress over and across the
Grantor ' s property to the extent reasonably necessary to exercise
and accomplish the bus stop purposes .
The Grantor shall have the right to make use of the surface
overlying the bus stop easement granted by this instrument so
long as such use does not interfere with the exercise by the
Grantee of the rights granted and conveyed by this instrument .
In no event shall the Grantor make claim against the Grantee for
damages to any improvements or fixtures hereafter installed by
the Grantor within the area of the permanent bus stop easement .
This Grant shall be binding upon the heirs , executors ,
administrators , successors , and assigns of the parties hereto .
IN WITNESS WHEREOF the Grantors have hereunto set their
hands and seals on this 1st day of June 1988 .
