HomeMy WebLinkAbout870298.tiff RESOLUTION RE: APPROVE INTERGOVERNMENTAL AGREEMENT WITH FEDERAL BUREAU OF PRISONS AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board has been presented with an Intergovernmental Agreement between the Weld County Sheriff' s Office and the Federal Bureau of Prisons concerning the housing of certain federal offenders in the Weld County jail, and WHEREAS , the terms and conditions are as stated in said Agreement, a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board deems it advisable to approve said Agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Intergovernmental Agreement with the Federal Bureau of Prisons be, and hereby is , approved, nunc pro tunc April 1 , 1987 . BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign said Agreement. Box 759 April 1 , 1987 915 - 9th Street Greeley, Colorado 80632 (303) 356-4000 Intergovernment Agreement Number J100c-0260 This Agreement is entered into between the Department of Justice, Bureau of Prisons and the Weld County Jail , Greeley, Colorado, hereinafter referred to as the Contractor, pursuant to the authority of 18 USC including 4002, 4004, and 4082 and the Cooperative Agreement Act of 1977 (P.L. 95-244) and OMB Letter dated October 1982. 1. The Contractor agrees to accept Federal offenders and undertake their custody, care, treatment, and susistence in accordance with the attached - Federal Prison System Policy Statement Number 7338.1, dated January 1, 1978, for Contract Detention Services--Detention and Short-term Service of Sentence in Non-Federal (facilities) (jails) . 2. Basic medical care will be provided to Federal prisoners by the Contractor which shall include sick call and selfcare, i .e. , care of any condition which can be treated by the prisoner. This may include such "over the counter" type medications as may be approved by the Department's medical staff. The cost of the hospitalization, prescription, surgical , and dental care will be borne by the Bureau of Prisons, in accordance with the Policy Statement Number 7338.1, dated January 1, 1978. 3. Period of Performance: This agreement is effective April 1, 1987 and shall continue for an indefinite period. 4. Payment Schedule: In consideration of satisfactory performance of work called for under this Agreement, the Bureau of Prisons shall reimburse the Contractor at the rate of $45.00 per day. The rate covers one person per manday. The contractor shall bill for the day of arrival and not for the day of departure. The estimated number of mandays is 720 (540 male and 180 female) per year. Billing shall be based on actual mandays used. The total obligations of the Bureau of Prisons under this contract is estimated not to exceed $32,400.00 per year. This Agreement shall be funded incrementally on a fiscal year basis. Consequently, the Bureau of Prisons will obligate funds at the beginning of each fiscal year, subject to the availability of such funds and the estimated needs of the Bureau. Payment shall be monthly, upon receipt of a proper invoice. 870298 5. Contract Monitor: Dave Pawlowski , Community Programs Manager or his successor is hereby designated as Contract Monitor for this contract . This designation does not include authority to sign contractual documents or to otherwise make commitment or issue changes which will effect the price, quantity, or perfor- mance of this Agreement. 6. Billing Procedures: Submit invoices to: Dave Pawloski Community Programs Office U.S. Bureau of Prisons 314 U.S. Courthouse and Post Office 350 S. Main Street Salt Lake City, U.T 84101 (801) 524-4212 Invoices shall be submitted monthly for per diem and for reimbursements not covered by the per diem rate (i .e. , hospital , prescriptions, etc.) that are approved in advance by the C.P.M. , a separate invoice must be submitted. Release of Inmates: No release date of any Federal resident shall be retarded, advanced, or otherwise changed or altered without the approval of a Bureau of Prisons Institution Records Officer or Community Programs Manager granting written authorization. 8. .Price Redetermination: This is a firm fixed price agreement for the first twelve months of contract performance and for prospective price redetermination either upward or downward as follows: (a) General . The total price set forth in this contract shall be periodically redetermined in accordance with the provisions of this clause. The prices for services performed prior to the first effective date of price redetermination shall remain fixed. (b) Price Redetermination Periods. For the purpose of price rede- termination the performance of this contract is divided into successive periods. The first period shall extend from the date of the contract twelve months and the second and third period shall extend for twelve months from the end of the last preceding period, except that the final period may be varied by agreement of the parties. The first day of the second and each succeeding period shall be the effective date of price redeter- mination for the period. 870298 (c) Price Redetermination. Not more than 60 calendar days nor less than 30 calendar days before the end of each redetermination period, except the last, the contractor shall submit: (1) Proposed prices for services which may be performed in ; the next succeeding period under this contract , together with: (a) an estimate and breakdown of the costs of services on forms which we will supply; (b) sufficient data to support the accuracy and reliability of such estimate (e.g. , Independent Financial Audit) ; and (c) an explanation of the differences between such estimate and the original (or last preceding) estimate for the same services. Upon receipt of the data required by this paragraph (c) , the Contractor and Contracting Officer shall promptly negotiate to redetermine fair and reasonable contract prices which may be performed in the period following the effective date of price redetermination. Where the contractor fails to submit the data as required above within the time specified, payments under this contract may be suspended by the Contracting Officer until the data is furnished, and if it is later determined that the Government has overpaid the contractor, the excess shall be repaid to the Government immediately. Interest shall be computed for the period starting 30 days after the data due date to the date of payment. (d) Contract Modifications. Each negotiated redetermination of prices shall be evidenced by a modification to this contract, signed by the Contractor and the contracting officer, setting forth the redetermined prices for services performed hereunder during the applicable price redetermin- ation period.
