STATEMENT
This Subdivision Exemption is being requested for the following reasons :
A 1 .0 Acre tract was created by Warranty Deed (Book 123, Page 553) on May 30, 1895
for church purposes.
On April 1 , 1902, a tract was created by Warranty Deed (Book 200, Page 251 ) for use
as the Elwell Cemetery. The cemetery tract was redescribed by agreement on March
29, 1957 (Book 1474, Page 114) and then transferred to. the Town of Johnstown on
April 25, 1957 (Book 1476, Page 142).
The above two parcels are in close proximity but do not have common property lines.
On January 29, 1936, the then present owner of the 1.0 Acre tract deeded said tract
to the owner of adjoining property outside the cemetery tract (Book 988, Page 106).
The present owners now desire to market the tract with the existing improvements.
To eliminate the strip of land on the North and West of said tract, lying between
said tract and the cemetery property, an outer boundary survey, plat and legal des-
cription were prepared. This Subdivision Exemption is being processed to recognize
this revision as a legal tract of land. .
The adjoining farm (156.5 Acres , more or less) is presently described as the Southeast
Quarter of Section 1 , Township 4 North, Range 68 West "EXCEPT" for several tracts
previously sold for use as the cemetery , the Johnstown Water Treatment Plan, a farm
tract, and State Highway 60. Future transfer of the farm will necessarily show
this "Subdivision Exemption" tract as an additional EXCLUSION.
