RE: AUTHORIZATION FOR CHAIRMAN TO SIGN FINDINGS AND ORDER OF THE
BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO,
CONCERNING VIOLATION OF ORDINANCE 108-A - HOWARD FOSTER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board received a letter from the West Greeley
Soil Conservation District concerning grasslands being plowed
without the owners or operator of the parcel first obtaining a
permit, pursuant to Ordinance 108-A, and
WHEREAS, said plow-out occurred on lands located in Section
10 , Township 11 North, Range 60 West of the 6th P.M. , Weld County,
Colorado, said lands being owned by Samuel Steiner, Esther
Steiner, and Mary Esther Nash, with Howard Foster being the
operator of said lands, and
WHEREAS, pursuant to such letter and inspection, a hearing
was held on the 6th day of August, 1986 , and
WHEREAS, the Board did Find that the above described parcel
has been illegally plowed, and that the owners and operator be
Ordered to cease cultivation for the next thirty (30) days on
those portions of the subject property which are in stubble
residue, with cultivation being allowed to continue on those
portions of the property which are now idle or in summer fallow,
and
WHEREAS, the owners and operator be advised, by certified
mail , of said Findings and Order, a copy of which is attached
hereto and incorporated herein.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that Samuel Steiner,
Esther Steiner, and Mary Esther Nash, as owners , and Howard
Foster, as the operator, of the hereinabove described parcel of
land be notified, by certified mail, of the Findings and Order of
the Board of County Commissioners of Weld County, Colorado,
concerning dust blowing from said property.
BE IT FURTHER RESOLVED by the Board that the Chairman be , and
hereby is, authorized to sign said Findings and Order.

FINDINGS AND ORDER OF
THE BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
WHEREAS, a written complaint has been received by the Board of County
Commissioners of Weld County, Colorado, from the West Greeley Soil
Conservation District, in accordance with Article 3, Section I(1) , of Weld
County Ordinance 108-A, specifying that grasslands in Section 10, Township
11 North, Range 60 West of the 6th P.M. , Weld County, Colorado, have been
plowed and planted to crops after May, 1982, without first obtaining a
permit to do so pursuant to Weld County Ordinance 108 or Ordinance 108-A,
and
WHEREAS, said grasslands are currently owned by Esther Steiner, Samuel
Steiner, and/or Mary Esther Nash, with Howard Foster being the operator of
said grasslands, and
WHEREAS, pursuant to said complaint, a hearing before the Board was
held on August 6, 1986. The following persons were present at said hearing:
Ron Miller, District Conservationist for the West Greeley Soil Conservation
District; Greg Snell, Mr. Miller's Assistant; and Dean Severin, Vice
President of the West Greeley Soil Conservation District. At said hearing,
the Board made the following Findings, pursuant to Article 3, Section 1(1) ,
Weld County Ordinance 108-A:
1. That the above-described grasslands in Section 10, Township 11
North, Range 60 West of the 6th P.M. , Weld County, Colorado, are
"grasslands" pursuant to the definition contained in Article 1, Section
III(4) , Weld County Ordinance 108-A.
2. That said grasslands were broken after May, 1982, appearing to
have been broken in 1984 and 1985.
3. That said grasslands were broken without first obtaining a permit
pursuant to Weld County Ordinance 108 or 108-A.
IT IS HEREBY ORDERED that owners Esther Steiner, Samuel Steiner, and/or
Mary Esther Nash, or operator, Howard Foster, shall:
1. Obtain a permit within thirty (30) days of August 6, 1986, in
accordance with Weld County Ordinance 108-A, to plow said grasslands.
2. Cease cultivation for said thirty-day period on those portions of
the subject property which are in stubble residue, with cultivation being
allowed to continue on those portions of the property which are now idle or
in summer fallow.
If you, Esther Steiner, Samuel Steiner, Mary Esther Nash, and/or Howard
Foster do not comply with the Order included herein, the Board of County
Commissioners of Weld County, Colorado, shall take further action to enforce
the provisions of Weld County Ordinance 108-A upon said grasslands.

Dear Mr . Barker :
It has come to our attention that Section 10, Township 11 North,
Range 60 West , has been plowed and planted to crops after May 1982 . It
appears the land in question was plowed in 1984 & 1985 . There is no plan
or permit plan approved by this board for this land .

Subject: 108 n r thn Plntu-CM tt of Grasslands,
By Esther and _Samuel Steiner, and Mary Nash
I have been informed that grasslands located in Section 10 ,
Township 11 North, Range 60 West of the 6th P.M. , Weld County,
Colorado, have been plowed without obtaining a permit pursuant to
Ordinance 108 or 108-A. It appears that the land is currently
owned by Samuel Steiner and Mary Esther Nash; however, Esther
Steiner is the person who is still listed in the Assessor' s Office
as the record owner. Mr. Greg Snell, who works for District
Conservationist Ron Miller, provided me with such information. He
gave me the attached map which shows the cultivated grasslands in
question.
The hearing on Wednesday' s Agenda will be pursuant to Article 3 ,
Section I (1) of Ordinance 108-A. A copy of the Ordinance is
attached hereto. Please note that Article 3 , Section I (1) gives
the Board authority to order that cultivation must cease
immediately and that the landowner and/or operator shall obtain a
permit in accordance with Ordinance 108-A.
I have informed the Steiners and Ms. Nash about the Wednesday
hearing by mail. It appears that Mr. Howard Foster is the
operator of the lands in question. Mr. Foster called me this
morning when I was out of the office, and has said that he will
call me back sometime today. I would suspect that he will be
willing to obtain a permit pursuant to the Ordinance.
I would suggest that the Board order Mr. Foster and/or the
Steiners and Ms. Nash to obtain a permit pursuant to Ordinance
108-A within 30 days. If they do not obtain such a permit within
30 days , the Board will then consider revegetating the grasslands
and charging the cost to Mr. Foster and/or the Steiners and Ms.
Nash.
