RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 60 - STEVEN
SCHULTZ
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , on June 27 , 1973 ,
approved Recorded Exemption No. 60 concerning property described
as Part of the SW≤, Section 28 , Township 7 North, Range 66 West of
the 6th P.M. , Weld County, Colorado, and
WHEREAS, Steven Schultz is now requesting that Recorded
Exemption No. 60 be amended, and
WHEREAS, the Board of County Commissioners has studied said
request to amend Recorded Exemption No. 60 and deems it advisable
to approve the same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the amendment to
Recorded Exemption No. 60 , as requested by Steven Schultz , be, and
hereby is , approved.
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

RE: Amended RE-60
The attached application, plat and related items are in reference to a
request from Steven Schultz for an amended recorded exemption. The parcel
of land on which this request is being made is described as part of the SW1/4
of Section 28, T7N, R66W of the 6th P.M. , Weld County, Colorado. .
This request is being done in conjunction with another amended recorded
exemption (Amended RE-713) . The applicants are amending the recorded
exemptions to enable the applicants of Amended RE 713 to build their home
out of the one hundred (100) year flood plain of Coal Bank Creek. Approval
of this amended recorded exemption will not create any additional
residential building sites.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The impact on agricultural surrounding land-uses does not appear
to be significantly different than the original request approved
on June 27, 1973.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County

WHEREAS, on May 5, 1972, the General Assembly of the State of Colorado,
enacted Senate Bill #35 as relates to Chapter 106 of the Colorado Revised Statutes,

WHEREAS, on August 30, 1972, the Board of County Commissioners of Weld
County, Colorado adopted Subdivision Regulations for Weld County, Colorado to
comply with the prescribed Senate Bill #35, and
WHEREAS, the Weld County Planning Commission has recommended to the
