J I I g w j b a ` �.'naair m .n I LI ' bt.�o i1N\\'\\9& O • _--, „_____ N— „ n2 ` 2 I y O 2 RESOLUTION RE: APPROVE SPECIAL REVIEW PERMIT FOR USES SIMILAR TO THOSE LISTED AS USES BY SPECIAL REVIEW IN THE A (AGRICULTURAL) ZONE DISTRICT (MAINTENANCE REPAIR SHOP FOR RAILROAD CARS) - ROCKY MOUNTAIN RAILCAR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of March, 1988 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Rocky Mountain Railcar, c/o Ron L. Maynard, 12600 East 114th Avenue, Henderson, Colorado 80640 , for a Special Review permit for uses similar to those listed as Uses by Special Review in the A (Agricultural) Zone District (maintenance repair shop for railroad cars) on the following described real estate, to-wit: Part of the NEi , Section 2 , Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Ron L. Maynard, president, and WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 .2 of the Weld County Zoning Ordinance as follows: a. This proposal is located within the urban growth boundary area of the Town of Hudson and is consistent with the Weld County Comprehensive �.T 880204 Page 2 RE: SPECIAL REVIEW PERMIT - ROCKY MOUNTAIN RAILCAR Plan's Urban Growth Boundary Area Goals and Policies. The Town of Hudson Planning Commission has reviewed this proposal and determined that it is compatible with the town ' s interests and finds no problems with the proposed request. b. The proposed use is consistent with the intent of the A (Agricultural) Zone District and is provided for as a use similar to those listed as Uses by Special Review. c. The proposed use is compatible with the future development of the surrounding area as permitted by the existing zoning and with the future development as projected by the Town of Hudson. d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Special Review permit for uses similar to those listed as Uses by Special Review in the A (Agricultural) Zone District (maintenance repair shop for railroad cars) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review permit be adopted and placed on the Special Review plat prior to recording the plat. 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to the issuance of any building permit, electrical permit, grading permit, or the start of any construction: a. A copy of a soil erosion control plan approved by the Platte Valley Soil Conservation District shall be submitted to the Department of Planning Services . 880204 Page 3 RE: SPECIAL REVIEW PERMIT - ROCKY MOUNTAIN RAILCAR b. An access permit shall be obtained from the State Highway Department for the proposed access . c. A copy of a. well permit for the proposed uses, approved by the State Engineer's Office, Division of Water Resources , shall be submitted to the Department of Planning Services . d. A copy of a drainage plan approved by the Weld County Engineering Department shall be submitted to the Department of Planning Services. Maynard USR-821 1 . The Special Review permit is for uses similar to those listed as Uses by Special Review in the A (Agricultural) Zone District (maintenance repair shop for railroad cars) , as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Waste oil, waste paints, stains, treatments, creosote, antifreeze, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3 . The property shall be maintained at all times in compliance with the requirements of the Air Pollution Control Division, Colorado Department of Health, for fugitive dust and fumes. 4 . No rail cars containing hazardous wastes or harmful levels of residue of hazardous waste or materials shall be allowed onto the site at any time for any reason. 5 . No permanent disposal of wastes shall be permitted at this site. 6 . The septic system for the proposed facility shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal System Regulations. 7 . Wood shavings, sawdust and water materials shall be handled, stored and disposed of in a manner that controls fugitive dust, blowing debris and other potential nuisance conditions. 8. Fugitive dust shall be confined to the Special Review site. 9 . Maximum permissible noise level shall not exceed the industrial limit of 80 db (a) , as measured according to Section 25-12-102, C.R.S. 880204 Page 2 DEVELOPMENT STANDARDS - ROCKY MOUNTAIN RAILCAR 10 . An individual sewage disposal system is required for the dwelling for security personnel and the system shall be installed according to the Weld County Individual Sewage Disposal System Regulations. 11 . The property shall be maintained in accordance with the Soil Erosion Control Plan approved by the Platte Valley Soil Conservation Service. 12 . Access onto the Special Review site shall be approved by the Public Utilities Commission, Burlington Northern Railroad, and the State Highway Department . 13 . No building shall be constructed within Panhandle Eastern Pipe Line Company' s 50-foot right-of-way easement. 14 . Two working days prior to construction of utility lines, streets, sidewalks, and driveways within Panhandle Eastern Pipe Line Company' s 50-foot right-of-way easement, the utility notification center of Colorado shall be notified so that all utilities can be located and identified. 15 . All construction on the property shall he in accordance with the requirements of the Weld County Building Code Ordinance. 16 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 17 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 18 . Personnel from the Hudson Fire Protection District, Weld County Health Department, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 880204 Page 3 DEVELOPMENT STANDARDS - ROCKY MOUNTAIN RAILCAR 19 . All stored materials shall be stored within the proposed screened storage areas on the Special Review plat. 20 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing standards and all applicable Weld County Regulations . Any material deviations from the plans or standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services . 21 . The property owner or operator shall be responsible for -complying with all of the foregoing standards. Kirby, Pro-Tem Commissioner Jacqueline Johnson - Excused Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Nary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Lanell Swanson The following business was transacted: = hereby certify that pursuant to a notice dated February 24, 1988, and duly published March 3, 1988, in the Johnstown Breeze, a public hearing spas conducted to consider the request of Rocky Mountain Railcar for a Special Review permit for uses similar to those listed as Uses by Special Review in the A (Agricultural) Zone District (maintenance -repair shop for railroad cars) . Chairman Brantner advised those present that, only four Commissioners being present, if this hearing should result in a tie vote, the absent Commissioner would review the record and listen to the tape of this hearing prior to casting the deciding vote. Lee Morrison, Assistant County Attorney, made this matter of record. Lanell Swanson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record of this hearing. Ron Maynard, president of Rocky Mountain Railcar, came forward to explain this request and answer questions of the Board. (Let the record reflect that during Mr. Maynard's presentation, Commissioner Kirby was called from the hearing.) No public testimony was offered concerning this request. Upon Commissioner Kirby's return, he was advised of what had transpired during his absence and was given the opportunity to ask additional questions. Commissioner Lacy moved to approve this request for a Special Review permit, subject to the Conditions and Development Standards contained in the Planning Commission's recommendation. Seconded by Commissioner Kirby, the motion carried unanimously. This Certification was approved on the 21st day of March, 1988. Railroad tracks are between this property -and the frontage road, a new at-grade crossing of this rail line would be required. Approval by the railroad company and the Colorado Public Utilities Commission (P.U.C. ) would be necessary before an acccess to the frontage road could be permitted. 2. _In order to pursue the above approvals it is important to Establish the location on the frontage road where an access can be permitted. Due to the difference in elevation between the railroad tracks and the frontage road, we cannot determine -from the Use by Special Review Permit Plan Map if the access location shown would -meet our access design standards. Specifically, we are concerned that the access grade could exceed the maximum allowable eight percent grade within -the I-76 right of way. It must also be shown that adequate sight distance is available at this location. To properly evaluate the proposed access it will be necessary for us to review plan and profile design plans. We encourage the project engineer to coordinate preparation of these plans with this office to ensure compatibility with the State Highway Access Code. 3. Upon acceptance of an access design by this office and the receipt of approval by the railroad and the P.U.C. , an Access Permit must be obtained from this office for construction of the access. Scheltinga, -County Engineer \ , Subject: Rocky Mountain Railcar USR-821 Access to the site is proposed from the State Highway Service -Road across the Chicago-Burlington and Quincy Railroad to the property. I have no comments regarding access. However, the highway department and the railroad should approve the proposed improvements. I agree with the drainage plan and the proposed detention facility. However, there are a few points that need tole addressed. On page 3 the drainage report indicates the release rate from the detention area will be no greater than historic rate for the 100-year storm. The Weld County Zoning Ordinance under Sections 24.5. 1 .5. 1 and 24.5. 1.5.2 require _detention facilities to store the 100-year developed runoff while releasing the 5-year existing runoff. Since the -computations in the drainage report deal with the existing 10-year discharge it would be accept-able to use those figures as opposed to making separate computations for the _5-year storm. I have made preliminary calculations that indicate changing the release rate to the 10-year existing condition can be done without revising the -site plan. On -page 12 of the drainage report a "C" factor of 0.01 was used. I believe the correct factor is 0.05 as shown in the runoff coefficient table as shown on page 8 of the drainage report. This would have the effect of changing the 10-year existi-ng :discharge from 0.66 cubit feet per second to 3.32 cubic feet per second. If the outflow rate of 3.32 cubic feet per second is used to determine maximum -storage as shown on page 13, I believe the storage will peak between 80,000 and -90,000 cubic feet. That would relate to a peak pond elevation of approximately 43.0 according to the cumulative detention graph shown on page 14. Reviewing the site plan indicates should the _pond raise to elevation 45.0 there would be no damage. Also, to accommodate the release rate of 3.32 cubic feet per second the proposed 18" pipe out of the detention pond should be reduced to a 12" _pipe and laid at a very flat slope. The above comments on drainage should be reviewed and verified by the designer and the appropriate revisions made in the drainage report and to the plan. Their existing facility is not sufficient to handle their needs . They dilligently negotiated with the United States Army to expand their currant operations on the arsenal . After months of pursuing their goals , negotiations broke off due to the lack of interest by the United States Army. Rocky Mountain Railcar is proposing to construct a 110' x250' structure. This structure will be used for the purpose of repairing the damaged railroad cars and perform preventive maintenance on these cars. The fumes that are created by the small touch-up painting and welding will be extracted from this facility through roof ventilation. They currently have no indoor facilities to work en these cars. Together with the afore- mentioned structure, an office, wheel shop and storage building will be constructed. One dwelling for security personnel is proposed. Railroad spurs will also be put in place to handle their anticipated needs . The maximum amount of railroad spurs will be limited to that as shown on the Use by Special Review Permit Plan Map. NEED FOR USE Due to inclimate weather conditions in the State of Colorado, indoor facilities to repair and maintain the railroad cars has become a necessity for Rocky Mountain Railcar to meet their contract requirements. As stated previously, Rocky Mountain -Railcar currently does not have indoor facilities . The proposed structure will house approximately 10 rail cars which can be repaired and maintained simultaneously. 2 880204 USF OF SURROUNDING PROPERTIES This property is bounded by the Interstate 76 Right-of-Way, two service roads, and the C.B.& O. Railroad right-of-way to the Northwest. �lpproxi-mately one-half -mile north by northeast is a chicken farm and turf farm. To the east is vacant land with non-productive vegetation. South by southeast of this parcel is currently being cultivated for productive farming. To the southwest is vacant land with non-productive vegetation. NEAREST RESIDENTIAL STRUCTURE The nearest residence to this parcel is a modular home one-half mile directly south. Approximately three-quarters of e mile to the south- west lies the Town of Hudson. There are no residential structures to the immediate west, north or east. CLIENTELE The maximum number of users, patrons, members and buyers will be limited to very few. Due to the nature of this business, which is a service and not a retail, persons entering this property other than the employees will be limited. Other than small delivery vehicles, most deliveries will be made by rail. OPERATIONS At this time there will be approximately 40 employees including management working one 8-Hour shift 6 days a week, working overtime only when needed. When Mr. Maynard ' s operation is at it ' s full potent- ial, approximately 100 people will be employed, including management, working two B-Hour shifts 6 days a week . Delivery of rail cars to be serviced will be determined by the rail lines schedule. The hours of operation will be dependent on the backlog of work but will motbegin before b:00 a .m. and not exceed 12 :D0 a.m. 3 S80204 WATER SOURCE A well is proposed for this site for its water supply. An existing well permitted in 1962 for livestock use is situated on this parcel at this time. Tests are being performed on the aforementioned well to see if it will suffice the needs for commercial use. If it proves to be sufficient, an application will be prepared for commercial use and sub-mitted for approval . If it proves to be insufficient, an application for a well permit will be prepared to drill a new well and submitted to the state for approval . ACCESS It is proposed that a 24 foot gravel road be constructed to county road standards for access to this parcel. The aforementioned road will he maintained by Rocky Mountain Railcar and periodically be matted with spent oil to control the dust during the time of construction. Within 12 months of the completion of the construction and weather -permitting, this -road will be paved to county road standards. This road will access from the State Highway service road to the northwest of this parcel. Contact has been made with Wally Jacobsen at the -St-ate Highway Department. It was stated that the highway department will review the request for access at the time of submittal of this application and will issue comments and recommendations . At that time, construction drawings will be prepared for approval by the State Highway Department. A total area for 50 parking spaces will be constructed together with 2-handicapped parking stalls . TRAFFIC Most of the traffic that enters this property will be those vehicles driven by the employees, small multi-passenger vehicles. The number of vehicles per shift will depend on how many employees will work these certain shifts. SEWAGE FACILITIES Rocky Mountain Railcar is proposing a sewage septic system for this parcel . Upon approval of this application, an engineered septic system will be prepared and submitted to Weld County Health Services for approval . FIRE PROTECTION This parcel is in the Hudson Fire Protection District. Mr. Maynard has been in contact with the firs district and it was stated that they foresee no problems . At the time of construction all buildings will he constructed to the fire district codes. Fire breaks will be constructed along all railroad spurs to insure protection for the railroad cars . All weeds will be removed within 18 feet on each side of the outer mainline tracks . ANIMALS No animals other than domestic pets will be allowed on this parcel . STOCKPILE At the southwesterly corner of this parcel ( See Map) there will be an approximately 10-0 ' x100 ' 6 foot stockade fenced area for stockpile usage. in this stockpile there will be railroad bed building materials to be used for new track construction and track maintenance . These supplies will be replenished when used. _In addition to the proposed screening, this stockpile and this entire parcel is naturally screened from the west ty the elevated portion of the main C.E.&Q. -Railroad bed . DE-BRIS Small debris generated from the operations of this project will be picked up weekly and taken to a proper disposal area. Scrap material that is generated will be stored in a single sail car and removed approx- imately every two weeks to C.F. I . in Tueblo, Colorado for recycling. 5 880204 No hazardous material will exist on this project since all rail cars are carefully emptied and cleaned before preventive maintenance or re- pair is done. Railcars cannot be accepted on this site until the cars have been manifested and plaquered according to the 704 plaquer standards . Due to the nature of this business, no ground contamination of any type will occur. LANDSCAPING It is planned at this time for landscaping to be placed around the westerly entrances of the proposed buildings . The buildings will be of earthtone colors to insure proper aesthetics with the surrounding area. The remainder of this parcel which will not be used for rail pur- poses will be planted with productive hay and cultivated periodically. RECLAMATION Upon cessation of this Use by Special Review, all rails and rail- road beds will be removed. This will be done by a firm that has sub- mitted the highest bid for doing so. It will be stated in the contract that it will be a condition to return this parcel to its natural state as close as possible as it exists today. PROPOSED TIME TABLE Within nine months of the approval of this Use by Special Review and all other required documents and plans the main rail line and all buildings will be in place, weather permitting. The entire project will be completed within twelve months of this time, weather permitting. The proposed paved road will be constructed within 24 months . LIGHTING Lighting for the access drive, set at suitable intervals and light- ing for the exterior of the proposed buildings is going to be installed. Mr. Maynard attended a town meeting for Hudson and briefly explained his proposed project. It was stated at the aforementioned meeting that this proposed project conforms with Hudson' s Comprehensive Plan. It was also stated that no problems were foreseen and the town was looking forward to a quick completion of this project as this will undoubtedly provide monetary gains for the Town of Hudson and Weld County. 2 ) The existing _zoning of this parcel is agricultural. The proposed use is allowed by special review. The location to the main rail line is ideal for this operation. 3) At this time this parcel ha-s no productive vegetation and it is unknown if this particular parcel ever has had productive vegetation. With the construction of this project, it is the feeling that it is not taking away any productive agricultural land.
