RE: APPROVAL OF RECORDED EXEMPTION NO. 916 - LEG R. AND SHIRLEY
J. KUNAU
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 916 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 916 was
submitted by Leo R. and Shirley J. Kunau for property which is
located in the N1 NE4 , Section 16 , Township 7 North , Range 66 West
of the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant and
known as Exhibit "A" , said plat to be recorded , and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 70 acres and 10 acres .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following: 1) The applicant shall submit a
mylar plat to the Department of Planning Services to be recorded
in the office of the Weld County Clerk and Recorder within sixty
days from the date of approval by the Board of County
Commissioners. The plat shall be drawn in accordance with the
requirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations, and shall reflect a seventy-five foot right-of-way
reservation south of the centerline of State Highway 14; and
3) Prior to recording the plat, the applicant shall submit a new
zoning permit application for the mobile home. The purpose of the
permit is to reclassify the mobile home for the intended use.

Dear Commissioners:
This request for a recorded exemption is submitted by Leo R. and Shirley J.
Kunau. The parcel of land on which this request is being made is described
as N} NE} of Section 16, T7N, R66W of the 6th P.M. , Weld County, Colorado.
The property is located 2 miles west of Ault on Weld County Road 31. The
parcel of land under consideration is the total contiguous land holdings of
the applicant.
The request is to divide the property into parcels of 70 acres and 10 acres,
more or less. The applicants wish to retain the smaller parcel including
improvements for their homesite. The 70 acre parcel will be sold, and it is
intended that the property will continue to be farmed. Both proposed lots
will have access and adequate frontage to Weld County Road 31.
The proposed 10 acre site includes a number of outbuildings and 2 dwellings.
The house is vacant at the present time. The Kunaus reside in the mobile
home, which was permitted in 1972 for accessory to farm use. It is
necessary that the Kunaus reclassify the mobile home, as its present
function 1s a principal dwelling.
The rear portion of proposed Lot B is a part of the crop-producing farm
unit. It is the staff's opinion that this area planted in corn should
remain intact with the proposed 70 acre parcel. The applicants have
indicated that they wish to build a new home toward the rear portion of Lot
B, but have not stated how the 10 acres will be managed. The staff
-questions that the intended use is consistent with the County Comprehensive
Plan.
The following referral agencies have reviewed the application materials and
have no objections to the request:

- State Highway Department (conditional upon a 75 foot right-of-way
reserved south of the centerline of State Highway 14) .
The Department of Planning Services staff reviewed the Recorded Exemption
request from Mr. and Mrs. Kunau on August 12, 1986, and has no objection to
the removal of improvements from the existing 80 acres. However, the staff
does have concerns for approving a 10 acre split for rural residential use
where the removal of land from crop production is not justified. The
applicant has not adequately demonstrated in the submitted application
materials that the proposed land use will be consistent with the intent of
the Agricultural Zone District and how the proposed land use will be in
compliance with the Weld County Comprehensive Plan.
The staff requests that the Board of County Commissioners consider this
Recorded Exemption application and determine if the standards of Section 9-2
E (1) (a) through (m) have been met.

Dear Ms. Dunn:
We have reviewed the Kunau Exemption request, and we ask for your
consideration of the following comments:
1 . Projected traffic on State Highway 14 indicates the need for a
150-foot total right of way, 75 feet each side of the highway
centerline. Additional width to meet this need should be
protected by reservation or, preferably, dedication, as permitted
by local regulations.
2. Access to this property from S.H. 14 should not be affected by
the proposed property division. Since County Road 31 borders
the east side of this property, direct access to S.H. 14 should
not be necessary for proposed Parcel A.

To Whom It May Concern:
The purpose of dividing this property into two properties is to release the
home and improvements from the balance of the farm as to comply with an
existing real estate contract.
The proposal is consistent with the policies of the We].d County Comprehensive
plan in that the uses and nature of the land will not be changed by this
process. The land in question is now zoned agriculture and shall remain a
primary agriculture use, thus insuring the proposal is consistent with the
intent of the zone district in which the subject property is located.
Uses that will be permitted are limited to those permitted by the County
agriculture zoning ordinance which includes crop , pasture and limited animal
husbandry. This is compatible with existing surrounding land uses as these
are presently engaged in the same uses.
The uses permitted will be compatible with the future development of the
surrounding area as permitted by the existing zone and with future development
as projected by the comprehensive plan of the County.
This proposal will not be inconsistent with efficient and orderly development
as nothing will change except ownership of property.
The sewage disposal method is a septic system. A domestic water tap is now in
use on subject property.
The property under consideration does not lie in a flood plain, geologic
hazard or Weld County Airport Overlay District.
