HomeMy WebLinkAbout880799.tiff RESOLUTION RE : APPROVAL OF RECORDED EXEMPTION NO. 1105 - LEROY J. AND NANCY J. BAKER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended , did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land , to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 1105 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 1105 was submitted by Leroy J. and Nancy J. Baker for property which is located in part of the Ni SWI , Section 9 , Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request is to divide the property into parcels estimated to be approximately 48 acres and 4 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be , and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems; 2) A Weld County Septic Permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal Regulations; and 3) The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. I've also attached a PDF from the NRA's technical team advisors that talks about berms and baffles and how incorportating them into your design can reduce the safety fan (area that is unsafe due to the possibility of bullets traveling into that area) onto a specified area that can be as small as the perimeter of the berms. I've also included another PDF from a range designer that talks a little more in depth about construction of these baffles and the engineering behind them. To make a long story short, Great Guns is going to have the NRA's technical team advisors come out and design the rifle and pisol ranges in order to ensure our design in top notch for safety and customer satisfaction. Kelly Berndt Great Guns Owner 970 897-2277 1 • • TO:Department of Public Health and Environment FROM:Great Guns Sporting LLC SUBJECT:AMUSR-1105 Lead Management Plan DATE:07-17-2009 Great Guns is concerned about stewardship of the environment and has taken the EPA's Best Management Practices for lead into account throughout the designing and operation of the shooting range. The EPA states that there are several range characteristics that lead to water contamination or prevention. Great Guns Sporting LLC intrinsically prevents lead propagation in the following ways: 1. The pH of the soil at Great Guns is 7.8 making it fairly basic.This falls in the ideal pH range of 6.5 to 8.5 for shooting ranges.A high pH allows lead to form a protective coating of Lead Oxide which reduces the solubility of lead into water dramatically. 2. The soil characteristic of Great Guns is a fine sandy loam,which is a soil that allows good lead reclamation. Underneath the top soil is bentonite clay which bonds with free lead ions and prevents further migration. 3. The annual precipitation at Great Guns is around 12 inches per year which nearly classifies the area nearly as a desert(10 inches per year). Low precipitation provides little means for lead migration. 4. The water table at Great Guns is very deep(>150'). Water has a long residence time in the soil to reach the water table. During that time,the water would pass through numerous clays which would bond to the few free lead ions. 5. The topography of Great Guns is gently sloping allowing little likelihood of runoff or ponds. Furthermore,there are no riparian or wetland areas close and downstream of Great Guns which are the areas that are most adversely affected by lead migration. 6. The range is covered by grass which absorbs rainwater reducing the time that lead is in contact with rainwater. The vegetation also slows and prevents runoff. 7. Downrange is very accessible for lead reclamation and recycling which allows Great Guns to reuse a finite resource. The previous factors are a huge part of Great Guns'lead management. The intrinsic properties of the range leave the lead basically inert.Great Guns uses the following techniques to make the removal and recycling of lead possible: 1. Great Guns contains the lead into as small of an area as possible by overlapping shotfall zones and using backstops. This allows the removal of the lead to be less difficult. 2. Great Guns has a third party reclaiming company come in every 2-3 years to determine if lead reclamation should take place. 3. Great Guns reclaims lead at a minimum of every five years. 4. Lead reclaiming machinery is used to reclaim the highest possible percentage of lead(up to 95%). 5. Baker. The parcel of land on which this request is being made is described as part of the Ni SW} of Section 9, T1N, R68W of the 6th P.M. , Weld County, Colorado. The property is located approximately 1.5 miles northeast of the Town of Erie, east of Weld County Road 5 and approximately .5 miles north of Weld County Road 10. This request is to divide a 52 acre parcel of land, which is the total contiguous land holdings of the applicants, into two (2) lots of 48.45 acres and 3.554 acres, more or less. Access to both lots is proposed from Weld County Road 5, a county local gravel road. Water service to the larger lot is currently supplied by a domestic well. Water service to the smaller lot is proposed from Left Hand Water Supply Company. A septic system exists on the larger lot and is proposed on the smaller lot. It is the opinion of the Department of Planning Services' staff that sufficient reasons have not been given by the applicant to warrant creating an additional lot at this time. The Department of Planning Services' staff has concerns about the level of development and the potential for continued divisions occurring in this section. The Town of Erie Planning Commission has recommended denial of this request because the proposed smaller lot is under ten acres. The staff would like the Board to be aware of the development pattern that has occurred in this area and to consider whether this type of piecemeal development should be allowed to continue. Six recorded exemptions have been approved in this section since 1973. In the west half of this section twenty-eight parcels currently exist. One other recorded exemption application is currently being reviewed by the department for the west half of this section. The Board recently approved Recorded Exemption #1096 on July 13, 1988, in this section at the southeast corner of the intersection of Weld County Roads 5 and 12. Development in this area is reaching a level where continued divisions may evade the intent and purpose of the Weld County Subdivision Regulations. In addition, residential development in rural areas necessitates an increased demand for road maintenance, police and fire protection, school busing, snow removal, utilities, and other urban services.
