RE: APPROVAL OF RECORDED EXEMPTION NO. 1092 - EDWARD KIRLIN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended , did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 1092 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1092 was
submitted by Edward Kirlin for property which is located in part
of the SW* , Section 6 , Township 4 North, Range 68 West of the 6th
P.M. , Weld County, Colorado, being more particularly described in
the plat which shall be provided by the applicant and known as
Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 10 acres and 3 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations . The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Re: Recorded Exemption 1092
Dear Commissioners:
This request for a Recorded Exemption is submitted by Mr. Edward Kgrlin.
The parcel of land on which this request is being made is described as part
of the SW} of Section 6, T4N, R68W of the 6th P.M. , Weld County, Colorado.
The property is located north of Weld County Road 48 and east of Weld County
Road 1 . The parcel of land under consideration is the total contiguous land
owned by the applicant.
The request is to divide a 13 acre parcel into parcels of 10 and 3 acres,
more or less. The 13 acre parcel does not have any improvements. It is the
applicant's desire to create a 3 acre parcel so that a farm laborer can
build a home.
The Department of Planning Services' staff has concerns about the level of
development and the potential for continued divisions occurring in this
section. There have been seven (7) Recorded Exemptions approved in this
4ection since 1972. In the west half of this section there are 21 parcels
having an average acre size of approximately 14 acres, more or less. It is
the opinion of the Department of Planning Services' staff that sufficient
justification may not have been given by the applicant to warrant exempting
an additional lot at this time, but the vicinity development is reaching a
level where continued divisions may be interpreted as evading the intent of
the Agricultural zone district and the Weld County Subdivision Regulations.
The Department of Planning Services' staff' s concern is warranted by the
fact that increased residential development in rural areas, at some point in
time, requires an increase of public services. Additionally, rural
residential development reaches a level where it inevitably begins to
interfere and encroach upon the agricultural activities of that area.

Subject: Statements required in application for a recorded exemption
4. The purpose and reason for dividing a lot into two separate lots is to
provide a suitable location and space for a dwelling on a country acreage.
5. Building a house on a small amount of ground in the country is a practice
that has been going on for decades of time and still continues. The proposed
case would be more than ordinarily simple and limited. Therefore, it would
apparently fall within the general plans almost by necessity. Examples of
this type are easy to find in this same section 6 and especially in the two
sections south of it, sections 7 and 12, along the W old County line road.
6. For the reasons mentioned under Number 5, the present proposal is consistent
with the intent of the zone district and even more specifically so, fur all
but a slight amount would remain in agricultural production. This would be
the present crop, alfalfa. For hay or pasture are the crops best suited to
that area lying below the irrigation ditch, at a good slope.
7. The uses beyond a simple dwelling and a shed or two will be the previously
mentioned hay or pasture -- and perhaps a little garden. Again, crops and
use typical of the locality. Examples are common in the area.
8. Since the uses permitted, for a modest dwelling and the rest agricultural
crops, will be the same as is commonly found in the neighboring areas, it
will be free to develop similarly and naturally will develop like the
surrounding area, as permitted by the existing zone and as projected by
the comprehensive plan of the County.
9. With a moderate dwelling on the lot and the rest agricultural, there will be
almost nothing that could conflict with efficient and orderly development,
the open ground yielding itself to whatever form development takes.
10. Domestic water is available from a large line of the Little Thompson
Water District running immediately in front of the lot. It is also avail-
able to the remaining larger lot.
Sewage disposal would be by a septic system.
11. The property under consideration for a recorded exemption is very well
drained. It falls substantially from east to west and also to the south.
There are no airports for miles from this location.
It is not a flood plain.
There is no known geologic hazard in the property under consideration.

Dear Mr. Kirlin:
This letter is in response to your request that the Little Thompson
Water District commit to provide domestic water service to a pro-
posed additional residence to be located in Section 6 , Township 4N,
Range 68 West of the 6th Principal Meridian in Weld County, Colorado.
Further this property is described as having the Weld-Larimer County
Line as it' s western border.
For your information, the District currently has a 10" water line
located on the west side of County Line Road in the above described
location with additional capacity available.
Therefore, we will commit to provide domestic water service via a
standard 5/8" x 3/4" residential water tap to this property. This
commitment is subject to your agreeing to comply with the Rules and
Regulations of the District, specifically that if any improvements
or line extensions are needed to District facilities to provide water
service, they will be done at the developer ' s or owner ' s expense .
The current price for a tap as described above is $3 , 000 and is
subject to change without notice.
This commitment will expire one year from the date of this letter if
the tap has not been purchased and installed by that date.
