CARLSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 27th day of August, 1986, at 2 : 00 p.m. for the purpose of hearing the application of Stener J. and Frances E. Carlson, 4111 Glade Road, Loveland, Colorado 80537, requesting a Change of Zone from A (Agricultural) to C-3 (Commercial) for a parcel of land located on the following described real estate, to-wit: Part of the SEQ SEa, Section 3 , Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 21 . 6. 2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission, and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The applicant has complied with all the application requirements listed in Section 21 . 7 et seq. , of the Weld County Zoning Ordinance. 2. NOW, -THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Stener J. and Frances E. Carlson for a Change of Zone from A (Agricultural) to C-3 (Commercial) on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording the Change of Zone plat, a recorded casement agreement between the applicant/owner and Longmont Centennial Inn, Inc. , shall be submitted to the Department of Planning Services. The easement agreement shall guarantee a permanent public ingress and egress easement thirty feet in width , providing access to the subject parcel from State Highway 119. The easement shall be shown on the Change of Zone plat. 2. The following Conditions shall appear as notes on the -Change of Zone plat: A. A Site Plan Review approved by the Department of Planning Services is required prior to the issuance of a building permit. B. Prior to the issuance of building permits, the applicant shall submit an approved State Highway access permit for the subject site to the -Department of Planning Services. C. Evidence of approval by the State Highway Department of the sewage treatment facility proposed for the site shall be delivered to the Department of Planning Services prior to the issuance of building permits. D. prior to recording the Change of Zone plat, there shall be a declaration of easement from parcel 2 to parcel 3 . The plat shall be amended to show the thirty foot easement. E. SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING July 16, 1986 A regular meeting of the Weld County Planning Commission was held on July 15, 1986, in the County Commissioners' Hearing Room, Weld County Centennial Building, 915 Tenth Street, Greeley, Colorado. Neil Scharada, Empire Laboratory, reported he had done soils test on this site, and there is a high water table, but it is easy to get around this, when building, in several different ways. Carlson for a Change of Zone from Agricultural to Commercial-Three be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval based upon the recommendations and conditions as outlined by the Department of Planning Services staff and amended by the Planning Commission and on the testimony heard by the members of the Planning Commission. Motion seconded by Lynn Brown. The Chairman called for discussion from the members of the Planning Commission. The recommendation of the Colorado Geological Survey was discussed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ann Garrison - yes; Louis Rademacher - yes; Harlan Else - yes; Lynn Brown - yes; Lydia Dunbar - yes; Paulette Weaver - No, because with the type of density of development that was seen here, she doesn't feel that independent, separate sewers systems can be adequate and we don't know when there will be adequate public sewer service. Jack Holman - No, for the same reasons outlined by Paulette. He also is beginning to have strong feelings on sewage treatment; especially in a congregated area where there a lot of business we should not allow any more expansion until the sanitation district is setup. Motion carried with five voting for the motion and two voting against the motion. The property under consideration is situated adjacent to the Interstate 25 interchange on State Highway 119. The "Del Camino" area currently includes approximately 57.3 acres of land that is zoned Commercial. Within the past 25 years, this location has developed from a truck stop with nonconforming status to -a commercial mode in unincorporated Weld County. Several commercial -activities which cater to the traveling -public have developed at this location. The uses which would be allowed on the subject property by granting the change of zone will be compatible with the surrounding land uses. C-3 (Commercial) zoning presently exists to the west and south of this 5 acre site. I-25 borders the site on the east boundary. A large agricultural -parcel is located to the north. These determinations are based, in part, upon a review of the information submitted by the applicant, other relevant information regarding this request and responses of referral entities which -have reviewed the request. C-3 (Commercial) zoning presently exists to the west and south of this 5 acre site. 1-25 borders the site on the east boundary. A large agricultural parcel is located to the north. Surrounding commercial activities include service stations, convenience stores, motels, fast food restaurants, and other similar auto-oriented services. Surrounding property owners have not objected to the proposed rezoning. The Department of Planning Services staff recommendation for approval is conditional upon the following: Prior to recording the change of zone plat, a recorded easement agreement between the applicant/owner and Longmont Centennial Inn, Inc. , shall be submitted to the Department of Planning Services. The easement agreement shall guarantee a permanent public ingress and egress easement thirty (30) feet in width, providing access to the subject parcel from State Highway 119. This report outlines from actual drilling, the extent of the gravel resource under this parcel . There is at least a 20 foot thick bed of good quality sand and gravel under this site. This site is open on two sides to additional land, that although not tested would appear to have an equal thickness of sand and gravel . This in turn is adjacent to a working sand and gravel operation. The point here is that as a five acre rezoning site, due to this restricted size, it is not economic to start a new operation (total plant) on this site. But also we feel strongly that if the county is going to preserve and use it' s gravel resource (per SB 29) that it needs to resolve these small zone (use) changes verses setting up a larger zone change that would allow this resource to be mined. This case and area is a prime example of an area with a large economic resource that will never be mined if each rezoning is considered on a case by case basis. The purpose of this addendum is to determing -quantities of sand and gravel at the above-referenced site and determine if gravel extraction at the site is economical. The field investigation, carried out on June 6, 1986, consisted of drilling, logging, and sampling one (1 ) test boring. The test boring was located in the approximate center of -the property and is shown on the Test Boring Location Plan included in Appendix A. The proposed site is located along the west right-of-way of I-25, north of Colorado Highway 119, northeast of Longmont, Colorado. More particularly, the site is described as a tract of land situate in the Southeast 1 /4 of the Southeast 1 /4 of Section 3, Township 2 North, Range 68 West of the Sixth P.M. , Weld County, Colorado. The site is relatively flat, open pasture land vegetated with grass and weeds. The property slopes gently to the south and has minor drainage in this direction. The site is bordered by the I-25 right-of-way on the east, existing commercial buildings on the south, and open fields to the -north -and west. The soil profile at 'the site consists of strata of material -arranged in different combinations. In order of increasing depths, -they are as follows: (1 ) Silty Topsoil: The area tested is overlain by a six (6) inch layer of silty topsoil. (2) Sandy Silty Clay: This stratum underlies the -topsoil and extends to -a depth of three (3) feet below the -surface. The sand, gravel and cobble stratum is well graded. (4) Claystone Bedrock: The bedrock was encountered below the sand and gravel stratum at 'depths of twenty-three (23) feet below the surface and -extends -to greater 'depths. The upper one (1 ) foot ofthe bedrock is highly weathered; however, the underlying claystone is -firm. (5) Ground Water: At the time of the investigation, -free -ground water was encountered at the site at a depth of two (2) feet below the surface. Water levels in this area may be subject to change -due -to seasonal variations and irrigation demands on and/or adjacent to the site. A twenty (20) foot layer of sand, gravel and cobbles was encountered at the site. The granular material is overlain by three (3) feet of overburden. Based on our visual inspection, -the material appears to be suitable for use -as construction material. However, due to the small size of the parcel, -extraction of this material , in our opinion, is not economically feasible. Providing a minimum fifty (50) foot buffer around the perimeter of the property and assuming the pit will be excavated on minimum 1 :1 slopes and using an average depth of twenty (20) feet of gravel, approximately eighty-five -thousand (85;000) cubic yards of sand, gravel could be -extracted from the site. In our opinion, -this quantity is too small to warrant the cost of moving in a crushing plant -to process the sand, gravel and cobble material. A crushing plant and stockpiles generally occupy approximately two acres. This would further reduce the size of the pit area. In addition, due to the proximity of the -property to existing businesses to the south , extraction of sand and gravel in -this area is not desirable. Since the majority of the sand and gravel stratum is below ground water, the sand and gravel will have -to be excavated by use of a drag line or the area will have to be dewatered prior to quarrying operations. In our opinion, the soil conditions encountered in the test boring drilled at the site are suitable for residential and commercial construction. High water levels in the area can be effectively lowered by filling the site or by construction of dewatering systems. The water table is also quite high at a depth of .5-1.0 feet. Frost action is often a problem in this area due to the high water table. Aquolls and Aquepts also have severe construction limitations. The frost action tends to be a problem for building foundations. Buildings with basements are not recommended because of the high water table. Tier Carlson r • 411 Glade Drive Loveland , Colorado 80537 Re: 5-Acre TTact of Land -- SLR of SE,' S3 1 ;t: Weld County, Colorado ELI Project No. 6448 Dear Mr. Carlson : At your request, Empire Laboratories, Inc. has made a mineral evaluation for a five-acre tract of land located on the west side of 1-25 north of Colorado Highway 119, east of Longmont , Colorado. The purpose of this evaluation was to determine mineral sources at the (rite. � I The site lies within the valley of the St. `c rain Croel v,1':ich flows le , northeasterly direction approximately one mile north of the site. Existinr gravel pits are located east and west of the site ir: the alluvium of the St. Vrain Creek. The publication "Sand, Gravel anti (;'carry Aggregate Resources Colorado Front -Range Counties" by Schwochow, Shroba, and - Wic-klein prepared by the Colorado Geological Survey 1974 indicates that the area is underlain by flood plain or valley fill alluvial deposits of sand and gravel suitable for economic use. The actual thickness -and quality of the gravel and overburden in the project area is not known. However, drilling -done for Luv's Truck Stop near the site encountered two (2) feet of -overburden underlain by twelve (12) feet of sand and gravel. The actual quantity and quality of sand _and gravel on the site should be determined by test borings or pits. Due to the relatively small size of the parcel of land , -economic extraction of this material is questionable without extraction of minerals on the adjacent properties. The site is underlain by the Pierre Shale Formation . The Pierre shale i• not known to _contain economic minerals such as coal , limestone or quarry rock; therefore, except for the potential of sand and gravel extraction , the above minerals, in our opinion, do not exist on the property to economic depths. It should be noted that this evaluation is based on our general knowledge of the geology in the area and subsurface investigations on nearby properties. To more accurately determine the depth of overburden of sand and gravel at the -site, it is recommenced that test borings be drilled on the site to determine these thicknesses.
