RESOLUTION
RE: ACCEPT PORTION OF WELD COUNTY ROAD 52 FOR PARTIAL MAINTENANCE
WITH ASSOCIATED NATURAL GAS, INC.

WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home i„ 'J
Rule Charter, is vested with the authority of administering the 1p �"

affairs of Weld County, Colorado, and

WHEREAS, on November 23 , 1987 , the Board did, by Resolution, an
approve a Road Improvements and Maintenance Agreement with o
Associated Natural Gas , Inc. , concerning a portion of Weld County z ��',
Road 52 , known as 49th Street, and z

WHEREAS, pursuant to said Agreement, Associated Natural Gas, a No
Inc . , has paved the portion of Weld County Road 52 from its east
property gate west to the existing pavement at the intersection of o• r
Weld County Roads 52 and 35 , and

WHEREAS, the Board has now been presented with a request for z
Weld County to accept said portion of Weld County Road 52 for n• N
partial maintenance, and
N
WHEREAS, acceptance of said Road for partial maintenance may
include snow removal but shall exclude any repairs to the street, o
including the roadway, shoulders , or drainage ditches, and
n
WHEREAS , the Board deems it appropriate to accept a portion
of Weld County Road 52 for partial maintenance. t7• fn

NOW, THEREFORE, BE IT RESOLVED by the Board of County 00
Commissioners of Weld County, Colorado, that a portion of Weld
County Road 52 , known as 49th Street, be, and hereby is, accepted
into the Weld County Road system for partial maintenance as o
hereinabove stated. . C
BE IT FURTHER RESOLVED by the Board that no sooner than nine n
al
months after acceptance for partial maintenance of street, the
County Engineer shall, upon request by the applicant, inspect the
subject street and notify the applicant of any deficiencies. The
County Engineer shall reinspect the street after notification from
the applicant that any deficiencies have been corrected. If the
County Engineer finds that the street is constructed according to
County standards , he shall recommend acceptance of said street for
full maintenance. Upon receipt of a positive qualified
recommendation from the County Engineer for acceptance of said
Street, the Board of County Commissioners shall accept said street
as a public facility and County property, and shall be responsible
for the full maintenance of said street including repair.

WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and

WHEREAS , the Board has been presented with a Road z
Improvements and Maintenance Agreement with Associated Natural m m
Gas , Inc. , and C
WHEREAS , said Agreement involves increased truck traffic on a y• ~,
portion of Weld County Road 52 (49th Street) due to a Use by H o
Special Review permit issued to Associated Natural Gas, Inc. , and Z

WHEREAS , after study and review, the Board deems it advisable r m
to approve said Agreement, a copy of which is attached hereto and x
incorporated herein by reference . x N
NOW, THEREFORE, BE IT RESOLVED by the Board of County 70 m
Commissioners of Weld County, Colorado, that the Road Improvements
and Maintenance Agreement with Associated Natural Gas , Inc. be ,
and hereby is , approved .

BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Agreement.

THIS AGREEMENT , made and entered into this 14th day of
October , 1987 , by and between the COUNTY OF WELD , STATE OF PI to
COLORADO, hereinafter called "County" and ASSOCIATED NATURAL r H
UAS , INC . , hereinafter called "ANGI" . N

WHEREAS , ANGI has been issued a Use by Special Review
Permit to add a Fractionation Unit to the existing gas plant x n
located in the SESW of Section 25 , Township 5 North, Range 66 k o
West of the 6th Principal Meridian , and N

WHEREAS the addition will increase truck traffic to the mko
plant and increase dust and tale:

WHEREAS the County Commissioners have requested the paving m
a portion of Weld County Road 52 (49th Street) H

NOW, THEREFORE , in consideration of the mutual covenants
and conditions hereinafter set forth , the County and ANGI rn to

1 . Accesses onto Weld County Road 52 from the new property K.,
shall be limited to two. a

2. Truck traffic shall be limited to the west on Weld 8
County Road 52 or north on Weld County Road 35 ( 35th 6
Avenue) when leaving or returning to the Site. tlifn

3. Weld County Road 52 shall be improved from ANGI ' s east g o
property gate west to existing pavement at the o
intersection of County Road 52 and County Road 35 . The
improvements shall consist of a 4" thick by 24 foot 8 .
wide hot bituminous asphalt . Per verbal agreement with
Drew Sheltinga ( 10/ 13/87) , decision as to whether or n o
not base material will be required will be made by the a O1
Weld County Engineering Department before the paving is
installed . In any case the base will not be more than
b" thick and shall be #6 agrigate.
4 . ANGI , through the paving contractor yet to be named ,
will warranty and maintain the improved portion of
County road 52 for a period of one year , after such
time the County shall be responsible for maintenance .
5 . All construction and materials shall be in accordance
with the State Department of Highways , Division of
Highways , State of Colorado , Standard Specifications
for Road and Bridge Construction , latest edition .

6 . The County will provide testing and inspection for the
construction .
7. -ANGI will improve the above mentioned portion of County
Road 52 after the -Fractionator= Unit is installed . -_
Construction of road to be completed by 1 , October
1988 .
