RESOLUTION RE: APPROVE SPECIAL REVIEW PERMIT FOR A SOLID WASTE DISPOSAL SITE XTRA CORPORATION WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 21st day of October, 1987 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of XTRA Corporation, c/o Charles Hayes, 998 East Highway 119 , Longmont, Colorado 80501 , for a Special Review permit for a solid waste disposal site on the following described real estate, to-wit: SE* NWk , Section 8 , Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Mike Stewart, of Industrial Compliance , Inc. , and WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. The proposed Special Review permit is consistent with the Weld County Comprehensive Plan' s I-25 Mixed Use Development Area. The conceptual land-use map designated the subject site as an open space area. The reclamation plan for the proposed disposal site is to reseed the area with native grasses. % f r 871323 Page 2 RE : USR - XTRA CORPORATION b. The proposed use is consistent with the Agricultural Zone District and is provided for as a Use by Special Review. c. The proposed use is compatible with the existing surrounding land uses . d. No overlay districts affect the site . e . Special Review permit Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Special Review permit for a solid waste disposal site on the hereinabove described parcel of land be , and hereby is , granted subject to the following conditions : 1 . The attached Development Standards for the Special Review permit be adopted and placed on the Special Review permit plan map prior to recording the plat. 2 . The Special Review permit activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review permit plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Within 30 days after the date the landfill accepts refuse , a form letter, approved by the Department of Planning Services staff, shall be mailed to all surrounding property owners within one-half mile of the landfill boundaries . The form letter shall indicate the following information: a. The program that the landfill operators will use to pick up off-site windblown trash. b. The name and telephone number of the person or persons to call for pick-up of windblown trash. 4 . Prior to recording the Special Review permit plan map, and as a part of the Certificate of Designation, the applicant shall develop and post performance guarantees to handle such issues as: a. Closure of the facility. 871323 Page 3 RE : USR - XTRA CORPORATION b. Reclamation and revegetation. c . Contamination issues . d. Off-site litter control . e . Monitoring and maintenance. The County Engineer and the Planning Department shall approve the items listed and cost estimates to guarantee these concerns . The County Attorney' s Office shall approve the form of the performance guarantees . 5 . Prior to recording the Special Review permit plan map plat: a . Evidence shall be submitted to the Department of Planning Services staff that a plan amendment has been made to the area-wide water quality management plan and the proposal is consistent with that plan. b. The access road, as shown on the Special Review permit vicinity map and plan map shall be identified as a 100 foot right-of-way and the access road. The access road shall be realigned to be opposite Weld County Road 3-1/2 . The Special Review permit vicinity map, plan map and application materials shall be corrected to show these changes prior to recording the plan map and vicinity map. c . The Board of County Commissioners shall determine if Weld County Ordinance #53 shall be enforced. 6 . Plans , profiles, and typical cross section drawings of the primary access road shall be submitted to the Department of Planning Services. 7 . Prior to recording the Special Review plat: a. A copy of an approved access permit onto State Highway 119 shall be delivered to the Department of Planning Services. b. On Offsite Road Improvements Agreement shall be approved to cover the offsite improvements to the access road and the necessary improvement to State Highway 119 as identified by the Division of Highways. 871323 Page 4 RE: USR - XTRA CORPORATION The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 21st day of October, A.D. , 1987 . The Special Review permit is for a solid waste disposal site as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The landfill shall receive only solid waste of a nonliquid, nonhazardous, and nonradioactive nature . 'The waste shall be dry household and commercial refuse, construction and demolition debris . No liquid waste of any nature, including semisolid sludges, septic tank pumpage, or drum containerized waste shall be accepted. No hazardous waste, whether or not detoxified or treated, nor any small quantity generator waste shall be disposed of at the facility. No ash from any commercial coal burning activities shall be accepted at the facility. 2 . The hours of operation shall generally be between 7 : 00 a .m. and 5 : 30 p.m. , Monday through Saturday. The facility shall be closed on the major legal holidays , Thanksgiving, Christmas, and New Year' s. 3 . The following minimum personnel and equipment are expected to be utilized at the site: PERSONNEL: 1 supervisor 1 gate and record keeper 2 heavy equipment operators 1 labor/spotter (as needed) EQUIPMENT: 1 trash compactor 1 scraper 1 dozer 1 motor pool (grader) 1 2 ,000 -gallon water truck FACILITIES : 1 gatehouse 4 . The site operator shall keep the following records on site and available for review by the Weld County Health Department and the Colorado Department o₹ Health: 871323 Page 2 DEVELOPMENT STANDARDS -- XTRA CORPOPATION a. ) Reports of construction quality control. b. ) Litter policing reports. c. ) Volume and types of incoming refuse . d. ) Results of gas and water -quality monitoring. e. ) Any special waste accepted. 5 . The following operation measures shall be employed to control blowing litter at the site: a. ) Application of soil cover during refuse placement and at the -end of each day. b. ) Limiting the size of the working face during windy periods . c . ) Permanent and moveable site fencing. d. ) Litter pick up activities . e . ) Leasing operations during periods when high winds are present. 6 . Operational inspection of the -entire facility shall be made on a quarterly basis for the life of the landfill operation. The inspections shall be made by an independent contractor experienced with landfill operations . The inspections shall be made to ensure that the landfill operation is progressing in accordance with all aspects of the approved landfill plan. Inspection reports shall be prepared and submitted to both the Weld County Health Department and the Colorado Department of Health. 7 . All water samples shall to analyzed for the following parameters twice a year: Calcium Magnesium Lead Sodium _Potassium Iron Chloride* Sulfate Alkalinity Ammonia Total Dissolved Nitrate Specific Conductance Solids pm (field) * (field) * Chemical Oxygen Phenols Total Organic Halogen* Demand Total Organic Carbon *Indicates parameters to be analyzed quarterly. 871323 Page 3 DEVELOPMENT STANDARDS - XTRA CORPORATION The operator shall make justifiable changes as needed if the Weld County Health Department or the Colorado Department of Health would like to amend the groundwater sampling parameter list at some later date . 8 . Excavation inspections shall be made in each new excavated area . Inspections shall be made by an independent consultant who will then produce a written report that includes observations made in the newly excavated area and a map showing the inspected areas. Copies of the excavation inspection reports shall be supplied to both the Weld County Health Department and the Colorado Department of -Health. 9 . - Filling in the three phases shall be accomplished by a combination of ramp and area-fill methods . The ramp method shall be used to construct the first two lifts in each phase . The area-fill method shall be used to construct subsequent lifts . 1D . Surface water shall be controlled to ensure that run-on is not allowed to -enter the active disposal area, and that any surface water which falls on the working face is not allowed to leave the site . Intermittent historic flows from the site shall not be changed due to construction of the landfill . No significant changes in the amount ar quality of water flowing from the site are to occur. Three temporary drainages shall be constructed to divert natural flows away from the active filling areas. As landfilling progresses, and the lifts and phases are completed, the temporary diversions will be abandoned and new permanent diversions shall be constructed at higher elevations on natural slopes , continually routing runoff from undisturbed natural areas around the landfill . 11 . A clay-liner shall be installed following excavation to final depth. Once a section of the liner is constructed and approved, refuse placement can begin. Refuse shall be placed and compacted in loose layers approximately 2 feet thick. Incoming waste shall be unloaded at the top of the working face, where it shall be pushed downslope and compacted. A minimum of three passes of the trash compactor at an approximate slope angle of 6 : 1 should result in refuse densities of at least 1 ,000 pounds per cubic yard. Refuse material shall be placed in this fashion until a lift thickness of approximately 10 feet is attained. The lift shall be advanced upslope to near the end of the active phase. A minimum soil cover of 6 inches shall be placed over all exposed refuse each working day. When a lift is completed, the next lift shall be started at the low phase boundary and advanced over the top of the previous lift. 871323 Page 4 DEVELOPMENT STANDARDS - XTRA CORPORATION Lifts shall be placed in this fashion until the phase is completed. 12 . The completed _portion of each phase segment shall be covered with topsoil and seeded as soon as practically possible . The cover will be a minimum of 3 . 5 feet consisting of 6 to 12 inches of uncompacted soil overlain by a minimum of b inches of topsoil . All but the topsoil shall be placed as scan as possible over -areas in which refuse placement has been completed. 13 . The final top of the landfill shall have a two percent slope and shall have a -northeast trending crown approximately 225 feet from the western boundary. The northern, western, and west half of the southern boundaries shall meld into the natural topography. The eastern half of the southern boundary and the eastern boundary shall have -a 4 : 1 slope. 14 . The construction of the clay liner shall be placed in six inch lifts and compacted with a sheep' s foot compactor until it reaches a compacted dry density equal to or greater than 95 percent of the standard Proctor density (ADTM-D-69B) . The moisture content of the material shall be maintained within 2 percent of optimum moisture content using the same testing criteria. Not less than two feet of material sha11 be compacted to these specifications . 15 . To ensure that the clay liner and final cover are constructed in accordance with the specifications outlined in the Design and Operations Plan, an independent sails and materials testing firm shall be retained to observe and test liner and cover materials . The program shall consist of material classification tests conducted for every 3 ,D00 cubic yards of clay material -placed in the liner and for every 3 ,000 cubic yards placed in the cover. This type of testing shall ensure that materials placed are suitable for their intended use . In addition, compaction and moisture content testing shall be conducted on the compacted clay liners and covers. Moisture density testing shall be conducted at no less than 100 feet spacing intervals for the liner and 300 foot spacing for the cover. Copies of this testing shall be forwarded to the Weld County Health Department and the Colorado "Department of Health. 16 . Unauthorized access to the landfill facility sha11 be prevented by a permanent site fencing around the landfill entrance area and the final active filling arca. A six foot high chain-link fence with a 2 foot canopy shall be used around the entrance area in the northeast corner to secure 871323 Page 5 DEVELOPMENT STANDARDS - XTRA CORPORATION the gatehouse and equipment -areas . The filling area perimeter shall be fenced with 6 foot nonclimbable fence topped with three strands of barbed wire. 17 . To ensure that fill excavation volumes -and material balances are being achieved as landfilling progresses , the landfill area topography shall be mapped on an annual basis. Annual mapping shall be used to determine -actual annual air space and soil borrow used. An annual material balance report shall be prepared and shall be available for inspection by the Weld County Health Department and the Colorado Department of Health. 18 . A total of five groundwater monitoring wells shall be installed upon issuance of the Certificate of Designation. Four wells shall be installed at two locations along the southeastern property boundary. Two of the wells shall be installed at one location in the invert of the existing gully where it exits the site along the southeastern boundary. The other two wells shall be installed near the intersections of the southeastern and eastern fill boundaries . At each location, one well shall be installed in the saturated zone while the other is installed in the overlying unsaturated materials . XTRA Corporation anticipates a six-month con- struction period prior to the onset of filling. The wells shall be sampled four separate times in that period to provide a good data base to calculate baseline means and standard deviations for each parameter. _Upon commencement of the landfill operations , results from routine groundwater monitoring events can then be statistically compacted to this base line -data. Significant changes in the parameter values would then trigger resampling and, if necessary, a more extensive contaminant characterization effort. 19 . Methane gas monitoring shall be performed simultaneously with groundwater sampling episodes . Methane monitoring wells shall be constructed, or existing wells utilized, around the perimeter of the final landfill boundary to depths equal to the depth of excavation adjacent to the well . New walls shall be placed 300 feet on center on all final landfill boundaries . Wells shall be constructed using 2 inch diameter glue-joint PVC casing placed in 4 inch diameter borings . The PVC shall be slotted and gravel packed to within 10 feet of the ground surface . The annular space above the gravel pack shall be baekfilled with dry bentonite . 20 . A manhole and gravel leachate detection structure shall be constructed between the edge of the excavation and the downstream toe of the first list in the lowest part of the 871323 Page 6 DEVELOPMENT STANDARDS - XTRA CORPORATION excavation. She leachate detection system shall also include four monitor wells that are inside the fill area and are spaced 50 feet on renter along the southeast facing boundary of Phase Three. The wells -shall use drilled into the refuse between the excavation cut and the first lift berms . Well depths shall be determined by the depth of refuse, and in no case ahall penetrate the clay liner. 21 . If at any time negative groundwater results, methane results, or monitoring results are obtained, the operator shall notify the Weld County Health Department and the Colorado Department of Health of the results within five working days . The operator -shall request a meeting to discuss the monitoring results . If necessary, confirmation sampling and testing will be conducted. If an environmental problem is confirmed, the operator -shall have an additional 30 days to evaluate the dat-a and present a specific plan of action to both the Weld County Health Department and the Colorado Department of Health. 22 . Bost-closure inspections shall include documentation of surface cracking, erosion, slope angles , drainage , and condition of vegetation. One of the inspections each year shall be made in the late spring, when damage would most likely occur due to thaw and runoff. Any damage or other deficiencies shall be promptly repaired. 23 . If wet spots or seeps are encountered during excavation procedures, prior to construction -of the liner, the Colorado Department of Health shall be notified before emplacement of the liner. 24 . A base-grade plan shall be developed and submitted to the Weld County Health Department and the -State _Department of Health as the clay liner is being placed at the landfill. 25 . The Weld County Health Department and the State Department of Health shall he notified what type of moist -miscellaneous fill shall be placed in any portion of the clay liner for protection if it has been left exposed for more than two months . 26 . A one foot intermediate cover shall be placed over any lift which will be exposed for -more than one -month. 27 . The applicant shall obtain a Fugitive Dust Control Permit from the -State Department of health, Air Pollution Control _Division. A copy of the permit shall be forwarded to the _Department of Planning Services . Any violation of the 871323 Page 7 DEVELOPMENT STANDARDS - XTRA CORPORATION Fugitive Dust Control Permit shall be deemed a violation of the Special Review permit. 28 . At least one person shall be accessible at all times during hours of operation who is knowledgeable on the restrictions set forth by this Special _Review permit, the Certificate of Designation, and by any other permit requirements . That person shall be responsible to insure compliance with all requirements. All Development Standards and regulations shall be posted on the premises. Information on how to contact responsible parties shall be forwarded to the Department of Planning Services and the Weld County Health Department. 29 . Metal signs shall be posted at the customer entrance way. The signs shall be a minimum of three feet in width and four feet in length. Sign #1 shall state : "ALL UNCOVERED TOADS SHALL BE CHARGED TWICE SHE NORMAL FEE" Stan #2 shall state: "ABSOLUTELY NO HAZARDOUS OR TOXIC WASTES, SEPTIC OR LIQUID SEPTIC SLUDGE ACCEPTED" 30 . During the life of the landfill, the applicant shall maintain advisory signs on State Highway 119 . The signs shall advise landfill users the distance to the site and that all loads must be covered. 31 . Access to the Special Review permit site shall be by a 100 foot road right-of-way. The access road into the site shall be constructed to Weld County Engineering Department standards , and elevated where necessary to promote drainage and prevent soft spots . 32 . The site shall be appropriately fenced to control scattering of wind-blown debris and confine all solid waste discharged to the site. 33 . The applicant shall control wind-blown debris , odors, vectors , and fire by the ongoing compaction of the working face and the prompt application of daily cover material on accepted waste . The applicant shall remove wind-blown debris from off site areas and return it to the landfill . 871323 Page 8 DEVELOPMENT STANDARDS - XTRA CORPORATION 34 . Monthly, or within five working days of receipt of a written request from the Weld County Health Department, the owner/operator of the landfill shall collect wind-blown trash and debris from surrounding properties . 35 . Portable fencing shall be used around the active dump site arca at all times to limit the blowing of trash and debris . 36 . Prior to construction or excavation for this landfill , the applicant shall sample -and analyze the groundwater from its monitor wells to establish a base line for future analysis . Groundwater quality shall be monitored by the applicant/operator quarterly from the four monitoring wells in -accordance to the Colorado Department of Health Standards . 37 . Prior to each phase of refuse placement at the facility, documentation shall be submitted to the Department of Planning Services, the Weld County -Health Department, and the State Department of Health that a Colorado Registered Professional Engineer certifies the integrity of the clay liner and that the clay liner has been constructed in accordance with the specifications contained in the submitted design -and operation plan. 38 . In the event that the owner or operator of the proposed landfill change-s, a new Special Review permit application and Certificate of Designation shall be submitted by the new owner or operator. The new application shall be considered by the Weld County Planning Commission and the Board of County Commissioners under the existing zoning regulations , the Weld County Comprehensive Plan policies , and the State Solid Waste Disposal Site and Facilities Regulations . 39 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 40 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 41 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 42 . Personnel from the Weld County Health Department, State Department of _Health, and Weld County Department or Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out 871323 Page 9 DEVELOPMENT STANDARDS - XTRA CORPORATION on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 43 . The Special Review permit area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations . Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of planning Services . 44 . In the event that additional offsite improvements, such as a stoplight at State Highway 119 and the access road are required, the owner shall participate in those improvements on a pro-rata share based on the total trip impact associated with the solid waste disposal site and remaining active life versus the projected life of other developments. 45 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the permit by the Board of County Commissioners. 871323 HEARING CERTIFICATION DOCKET NO. 87-67 RE: SPECIAL REVIEW PERMIT FOR A SOLID WASTE DISPOSAL SITE AND CERTIFICATE OF DESIGNATION - XTRA CORPORATION A public hearing was conducted on October 26, 1987, at 2:00 P.M. , with the following present: Commissioner Gordon E. Considerable discussion was held concerning the control of dust and the access to this site. A public access to this landfill and the proposed Baldridge- Richardson P.U.D. from State Highway 119 should be located directly south of existing County Road 31/2. If this landfill and the P.U.D. develop concurrently, complete turn lanes will be warranted at this access as required by the State Highway Access Code. However, if only the landfill operation uses this access, turn lanes are less likely to be required. A final determination will be made through the Access Permit process. 2. As you are aware, there are two major developments under county review on the north side of S.H. 119 at C.R. 32. The projected traffic from these developments will also warrant turn lanes and, ultimately, a traffic signal at this intersection. The above developers are cooperating on an off-site road improvements agreement for the S.H. 119/C.R. 3% intersection and other affected county roads. Since a traffic signal at this location would serve traffic from both sides of S.H. 119, it may be possible to have the XTRA Corp. and Baldridge-Richardson P.U.D. participate in the off-site road improvements agreement toward the cost of the traffic signal. After the landfill has been filled, approximately 2 . 6 acres will drain toward highway 119 . The end result shows that there will be less runoff discharged directly to the creek after the landfill is completed as compared with the currently undeveloped property. The estimates of discharge volumes used in the original design of the proposed permanent diversion ditches for the perimeter of the fill area were derived using an estimated and very conservative time of concentration of 10 minutes . Use of this time of concentration will result in a greater design discharge and therefore channels with greater capacity. XTRA Corporation is not proposing to revise the drainage channels to correspond to the actual discharge although it is slightly less . Retention ponds are typically used in areas of development where urbanization has resulted in increased runoff and therefore in the increased potential for erosion and scour of the stream beds . The proposed XTRA Landfill will not result in increased runoff (as shown in the calculations above ) or produce erosional or scouring effects in St . Vrain Creek . The access road will be a total of 32 feet in width consisting of two 12 foot lanes and an additional 4 foot shoulder alongside each lane. Triangular drainage ditches will be excavated next to the shoulders to carry any runoff. It should be noted that road maintenance and dust abatement is the responsibility of the owner/operator and as such, will be done on his/her direction. The equipment used to operate the landfill will also be used to maintain the access road to the site . This will allow the owner/operator to immediately work on the road if maintenance is necessary. The City's current landfill is nearly full. They will use some of the topsoil from this area to reclaim their existing landfill and make it into a recreation and park area. He explained Longmont's trash pickup and recycling policies. The City has a contract with Mr. Hays for dumping its trash at this site. The expected length of operation at this site is three to four years. They, too, would like to see the hours of operation changed because they pickup trash every day except Sunday, Thanksgiving, Christmas, and New Year's. Saturday is their peak day with approximately 400 individual vehicles entering the site. Closure Data: The engineering design and operations report shall include, as a minimum, the following closure data: 4.8.1 Provisions for the maintenance of the facility after closure, to prevent or minimize nuisance conditions. 4.8.2 Provisions for the monitoring of explosive gas and groundwater wells or surface water after closure. 4.8.3 Plans for final closure of the facility, including planned final contours of fill surface after closure. 5.1 Issuance of certificates of designation for new facilities for solid waste disposal : Certificates of- designation are issued by Boards of -County -Commissioners in accordance with the requirements for the consideration of applications contained in Sections 30-20-104 and 30-20-105, of the Act. 5.1.1 Factors to be considered (1 ) In considering an application for a certificate of designation, the board of county commissioners shall take into account: (a)- The effect that the solid wastes disposal site and . facility will -have on the surrounding property, taking into consideration the types of processing to be used, surrounding property uses and values, and wind and climatic conditions; (b) The convenience and accessibility of the solid wastes disposal -site -and facility to potential users; (c) The ability of the applicant to comply with the health standards and operating procedures provided for in the Act and such rules and regulations as may be prescribed by the Department; (d) Recommendations by local health departments. (2) Except as provided in the Act, designation of approved solid wastes disposal sites and facilities shall be discretionary with the board of county commissioners, subject to Judicial review by the district court of appropriate • jurisdiction. (3) Prior to the issuance- of a certificate of designation, the board of county commissioners shall require that the report which shall be submitted by the applicant under section 30-20-103 of the Act be reviewed and a recommendation as to approval of disapproval made by the Department and shall be satlsfed that the proposed solid waste disposal site and `, iik facility conforms to the comprehensive county land use plan, 14 re ii THE CODE OF COLORADO REGULATIONS 6 CCR 1007-2 871323 Page 1. 19 if any. The application, report of the department, comprehensive land use plan, and other pertinent information shall be presented to the board of county commissioners at a public hearing to be held after notice. Such notice shall contain the time and place of the hearing and shall state that the matter to be considered is the applicant's proposal for a solid waste disposal site and facility. The notice shall be published in a newspaper having general circulation in the county in which the proposed solid wastes disposal site and facility is located at least ten but not more than thirty days prior to the date of the hearing. 5.1.2 If the board of county commissioners deems that a certificate or designation should be granted to the applicant, it shall issue the certificate, and such certificate shall be displayed in a prominent place at the site and facility. The board of county commissioner shall not issue a certificate of designation if the department has recommended disppproval pursuant to section 30-20-103 of the Act. 5.1.3 The County Board of Commissioners shall forward a copy of the certificate of designation to the Department 6.0 These regulations apply to waste impoundments that store, treat or dispose of liquid, semisolid or solid wastes, except as provided in 6.0.4 for facilities in operation prior to adoption of these regulations. 6.0.1 These _regulations do not apply to wastes which; A. Sketch Plan and have the following comments: 1 . As indicated in the application document, the project consultant has contacted this office regarding access to this development from State Highway 119. The proposed sketch plan reflects this discussion in that only two accesses to S.H. 119 are proposed, one at each end of the property spaced one-half mi -.e apart. These are the only reasonable access locations for this property given the existing 30-foot City of Longmont access easement along the Past property boundary and the County Road 3%2 intersection at the west end of the property. We do ask that the access at the west end of the property align directly with C.R. 3' on the north side of the highway rather than be slightly offset as shown. Since this is an access-controlled highway, any changes in access must be approved by the Federal Highway Administration (FHWA) before we can process an Access Permit. We will recommend approval of these accesses to the FHWA once the developer submits a formal request to this office. There are two 24-foot accesses in between the subject accesses which will need to be abandoned as part of the approval process. 2. The traffic impact of this development will require the installation of turn lanes on S.H. 119 in conjunction with the two accesses. Right-turn acceleration and deceleration lanes , and left-turn deceleration lanes, and, possibly, left-turn acceleration lanes will be required. The construction of these lanes may impact the width of the access openings at the highway right of way line. Therefore, the developer will need to develop construction plans for these accesses to ensure that the request to the FHWA provides for the necessary access width at the right of way line. Manning commission Gentlemen: The Hazardous Materials and Waste Management Division of the Colorado Department of Health has completed it review of the Design and Operations Plan for the Proposed XTRA Corporation Landfill submitted February 24, 1987 by Industrial Compliance, Inc. The proposed site is located approximately 4 miles east of Longmont and encompasses 40 acres. The application was reviewed to determine if the proposed facility could comply with the minimum standards of the Solid Wastes Disposal Sites and Facilities Act, Sections 30-20-100 to 116, C.R.S. 1973 ("Solid Wastes Act") and with the regulations promulgated thereunder, 6 CCR 1007-2 ("the Regulations") . Contained within the Design and Operations Plan and March 27, 1987 and June 2, 1987 letters submitted to the Division by Industrial Compliance, Inc. are the following major commitments agreed to by the applicant, XTRA Corporation: 1, Nineteen of the 40 available acres at the landfill site will be used for refuse filling. The remainder of the site will largely be unaffected by operational activities. Refuse filling will occur in three phases. Generally, filling will be accomplished by excavating and lining the active area, placing compacted refuse in controlled lifts, and covering them on a daily basis. 2. The landfill has a total airspace capacity of 933,000 cubic yards and an estimated life of 4 years. The landfill will accept about 1, 100 gate yards of trash per day. 3. Only solid waste of a non-liquid nature will be accepted at this facility. This includes all types of non-hazardous, non-radioactive garbage and other refuse generated from industrial, commercial and residential activities. No liquid waste of any nature, including semi-solid sludges and septic tank pumpage, will be accepted. No hazardous waste, whether or not detoxified or treated, will be knowingly accepted from small quantity genejators or any other sources. 871323 4. A minimum of about 285,000 cubic yards of material will be needed to fulfill the soil requirements of the existing and proposed landfills. The City of Longmont has contracted with XTRA Corporation to remove 50,000 cubic yards of clay for the closure of the existing Longmont Landfill. This material will come from an average 10-foot deep excavation over the entire site. To ensure that excavations in the landfilling area are constructed in accordance with the landfill design, and that the conditions are consistent with those described in the Design and Operations Plan, excavation inspections will be -made in each new excavated area. Inspections will be made by an independent consultant who will then produce a written report that includes observations made in the newly excavated area and a map showing the inspected areas. Copies of the excavation inspection reports will be supplied to both Weld County and the Colorado Department of Health. 5. Filling in the three phases will be accomplished by a combination of ramp and area-fill methods. The ramp method will be used to construct the first two lifts in each phase. The area-fill method will be used to construct subsequent lifts. 6. Surface water will be controlled to ensure that runon is not allowed to enter the active disposal area, and that any surface water which falls on the working face is not allowed to leave the site. Intermittent historic flows from the site should not be changed due to construction of the landfill. No significant changes in the amount or quality of water flowing from the site are expected. Three temporary drainages will be constructed to divert natural flows away from the active filling areas. As landfilling progresses, and the lifts and phases are completed, the temporary diversions will be abandoned and new permanent diversions will be constructed at higher elevations on natural slopes, continually routing runoff from undisturbed natural areas around the landfill. 7. A clay liner will be installed following excavation to final depth. Once a section of the liner is _constructed and approved, refuse placement can begin. Refuse will be placed and compacted in loose layers approximately 2 feet thick. Incoming waste will be unloaded at the top of the working face, where it will be pushed downslope and compacted. A minimum of three passes of the trash compactor at an approximate slope angle of 6: 1 should result in refuse densities of at least 1000 pounds per cubic yard. Refuse material will be placed in this fashion until a lift thickness of approximately 10 feet is attained. The lift will be advanced upslope to near the end of the active phase. A minimum soil cover of 6 inches will be placed over all exposed refuse each working day. When a lift is completed, the next lift will be started at the low phase boundary and advanced over the top of the previous lift. Lifts will be -placed in this fashion until the phase is completed. t 871323 8. The completed portion of each phase segment will be covered with topsoil and seeded as soon as practically possible. The cover will be a minimum of 3.5 feet thick, with the bottom 2.0 feet consisting of compacted clay and the top 1.5 feet consisting of 6 to 12 inches of uncompacted soil overlain by a minimum of 6 inches of topsoil. All but the topsoil will be placed as soon as possible over areas in which refuse placement has been completed. 9. The final top of the landfill will have a two percent slope and will have a northeast trending crown approximately 225 feet from the western boundary. The northern, western and west half of the southern boundaries will meld into the natural topography. The eastern half of the southern boundary and the eastern boundary will have a 4: 1 slope. 10. The construction of the clay liner is a very important aspect of the landfill operation. The clay will be placed in six inch lifts and compacted with a sheeps foot compactor until it reaches a compacted dry density equal to or greater than 95 percent of the standard Proctor density (ASTM-D-698) . The moisture content of the material shall be maintained within 2 percent of optimum moisture content using the same testing criteria. Not less than two feet of material will be compacted to these specifications. 11. To ensure that the clay liner and final cover are constructed in accordance with the specifications outlined in the Design and Operations Plan, an independent soils and materials testing firm will be retained to observe and test liner and cover materials. The program will consist of material classification tests conducted for every 3,000 cubic yards of clay material placed in the liner and for every 3,00 cubic yards placed in the cover. This type of testing will ensure that materials placed are suitable for their intended use. In addition, compaction and moisture content testing will be conducted on the compacted clay liners and covers. Moisture density testing will be conducted at no less than 100 foot spacing interval for the liner and 300 foot spacing for the cover. 12. The proposed facility will generally operate between the hours of 7:00 a.m. and 5:30 p.m. six days a week. Winter hours may be changed depending on available sunlight. The facility will be closed on the major legal holi$ays. 13. Unauthorized access to the landfill facility will be prevented by permanent site fencing around the landfill entrance area and the final active filling area. A six foot high chain link fence with a w 2 foot canopy will be used around the entrance area in the northeast corner to secure the gatehouse and equipment areas. The filling area perimeter will be fenced with 6 foot non-climbable fence topped with three strands of barbed wire. 14. The following ope tional measures will be employed to control blowing litter at -the site: i) Application of soil cover during refuse placement and at the end of each day. 871323 ii) Limiting the size of the working face during windy periods. iii) Permanent and moveable site fencing. iv) Litter pick up activities. v) Ceasing operations during periods when high winds are present. 15. The following personnel and equipment are expected to be utilized at the site: Personnel: 1 supervisor 1 gate and record keeper 2 heavy equipment operators 1 labor/spotter (as needed) Equipment: 1 trash compactor 1 scraper 1 dozer 1 motor pool (grader) 1 2,000 gallon water truck Facilities: 1 gatehouse 16. Operational inspections of the entire facility will he made on a quarterly basis for the life of the landfill operation. The inspections will he made by an independent contractor experienced with landfill operations. The inspections will be made to ensure that the landfill operation is progressing in accordance with all aspects of the approved landfill plan. Inspection reports will be prepared and submitted to both Weld County and the Colorado Department of Health. 17. To ensure that fill, excavation volumes, and material balances are being achieved as landfilling progresses, the landfill area topography will be mapped on an annual basis. Annual mapping will be used to determine actual annual air space and soil borrow used. An annual material balance retort will be prepared and will be available for inspection by Weld County and the Colorado Department of Health. 18. The site operator will keep the following records on site and available for county and state review: i) Reports of construction quality control. ii) Litter policing reports. iii) Volume and types of incoming refuse. iv) results of gas and water quality monitoring. v) Any specialtwaste accepted. 19a. A total of five ground water monitoring wells will be installed upon issuance of the Certificate of Designation. Four wells will be installed at two locations along the southeastern property boundary. Two of the wells will be installed at one location €0713 3 in the invert of the existing gully where it exits the site along the southeastern boundary. The other two wells will be installed near the intersections of the southeastern and eastern fill boundaries. At each location, one well will be installed in the saturated zone while the other is installed in the overlying unsaturated materials. XTRA Corporation anticipates a 6 month construction period prior to the onset of filling. The wells would be sampled four separate times in that period to provide a good data base to calculate baseline means and standard deviations for Each parameter. Upon commencement of the landfill operations, results from routine ground water monitoring events can then be statistically compared to this base line data. Significant changes in the parameter values would then trigger resampling and, if necessary, a more extensive contaminant characterization effort. 19b. All water samples will be analyzed for the following parameters twice a year: Calcium Magnesium Lead Sodium Potassium Iron Chloride* Sulfate Alkalinity Ammonia* Total Dissolved Nitrate Solids Specific Conductance (field)* Chemical Oxygen Demand pH (field)* Total Organic Halogen* Total Organic Carbon* Phenols *Indicates parameters to be analyzed quarterly 19c. The operator will make justifiable changes as needed if the Weld County Health Department or the Colorado Department of Health would like to amend the ground water sampling parameter list at some later date. 20 Methane gas monitoring will be performed simultaneously with ground water sampling episodes. Methane monitoring wells will be constructed, or existing wells utilized, around the perimeter of the final landfill boundary to depths equal to the depth of excavation adjacent of the well. New wells will be placed 500 feet on center on all final landfill boundaries. Wells will be constructed using 2 inch diameter glue-joint PVC casing placed in 4 inch diameter borings. The PVC will be slotted and gravel packed to within 10 feet of the ground surface. The annular space above the gravel pack will be backfilled with dry bentonite. 21. A manhole and gravel leachate detection structure will be constructed between the edge of the excavation and the downstream toe of the first lift in the lowest part of the excavation. The leachate detection system will also include four monitor wells that are inside the fill area and are spaced 50 feet on center along the southeast facing boundary of Phase Three. The wells will be drilled into the refuse between the excavation cut and the first lift berms. Well depths will be determined by the depth of refuse, and in no case will penetrate the clay liner. 871323 22. If at any time negative ground water, methane -or monitoring results are obtained, the State and County will be notified of the results within five -working days. The operator will request a meeting with Weld County and the Colorado Department of Health to discuss the monitoring results. If necessary, confirmation sampling and testing will be conducted. If an environmental problem is confirmed, the operator will have an additional 30 days to evaluate the data and present a specific plan of action to both the County and the State. 23. Post-closure inspections will include documentation of surface cracking, erosion, slope angles, drainage, and condition of vegetation. One of the inspections each year will be made in late spring, when damage would most likely occur due to thaw and runoff. Any damage or other deficiencies will be promptly repaired. It is this Department's assessment that if the proposed facility is constructed and operated as summarized above and the construction and operation were to include the Division's recommendations listed herein, the facility can comply with the minimum standards of the Solid Wastes Act and with the Department regulations adopted pursuant thereto. The Department's approval is contingent upon the inclusion of the following recommendations as part of the Certificate of Designation, if issued. i) No ash from any commercial coal burning activities be accepted at the site. ii) Turing excavation procedures prior to construction of the liner, if wet spots or seeps are encountered, this Zlivision be notified before emplacement of the liner. iii) A base grade plan be developed and submitted to Weld County and to the Division as the clay liner is being placed at the landfill. iv) This Division be notified if any portion of the clay liner is left exposed for more than two months and what type of moist miscellaneous fill will be placed to protect the liner. v) A one foot intermediate cover be placed over any lift which will be exposed for more than one month. vi) Copies of the annual landfill topography mapping and imaterial balance report be submitted to Weld County and the Department. vii) The applicant obtain a fugitive dust control permit from the Department's Air Pollution Control Division. 871323 Although the Department of Health does not specifically require closure and post-closure financial assurances and off site access road litter -control measures, the Department recommends that Weld County explore developing commitments from the applicant. Explain proposed use. XTRA Corporation proposes to construct and operate a sanitary solid-waste landfill in Southwestern Weld County. The XTRA Landfill will be located immediately west of the existing Longmont Landfill . The owner and operation will be independent of the current operation. The landfill will serve eastern Weld and western Boulder Counties , areas now served by the existing landfill . The landfill will accept only dry, non-hazardous solid waste from private, commercial and industrial sources . The XTRA Landfill will be developed, operated and closed in an environmentally safe manner according to standards set forth by Weld County and the Colorado Department of Health. More detailed information can be found in the Design and Operations Plan. 2 . Explain need for use . The existing landfill is located in southwestern Weld County on Highway 119 , approximately 4 miles east of Longmont . As of October, 1986 , the projected life for the current operation was 14 months . Upon completion of filling at this site , Longmont, western Boulder County and eastern Weld County be left without an approved solid waste disposal site unless an alternative site is permitted and preoperational activities are completed within this time frame . The proposed site described in this report will satisfy the region' s solid waste disposal needs for an approximate 4-year period and, provided preconstruction activities can begin in early summer of 1987 , will be available for use when the existing site is closed. 3 . Explain the types of existing uses on surrounding properties . With the exception of the adjacent landfilling operations , the land surrounding the proposed landfill site is currently used for livestock grazing or lies fallow. 2 071323 4 . The distance of the proposed use to residential structures in each direction. The distance of the proposed landfill site to the nearest residential site is approximately 1200 ft . The vicinity map accompanying this report shows the site location in reference to residential buildings . 5 . The maximum number of users , patrons, members, and buyers . As previously stated, the sources of solid waste to be landfilled at the XTRA site are private , commercial and industrial customers serviced by haulers that utilize the existing landfill . Therefore , the maximum number of users expected is the same as the maximum number using the existing landfill . 6 . The number of employees , number of shifts , and hours of operation. The XTRA Landfill expects to employ 5 people , including : 1 supervisor 1 gate and record keeper 2 heavy equipment operators 1 labor/spotter (as needed ) The landfill will generally operate between the hours of 7 : 00 A.M. and 5 : 30 P .M. six days per week . Hours during the winter months may vary depending on weather conditions and available sunlight . The facility will also be closed on the major legal holidays . A gatehouse will be erected on-site and used as shelter for the gatekeeper and an employee break room. This building will be a temporary structure and will be removed from the site following completion of landfilling activities . The equipment used on-site will be stored outside and repairs will be done by employees on-site . A separate building is not expected to be necessary to complete equipment repairs and maintenance . 7 . The type of water source for the proposed use. Both potable and ncn-potable water will be required during site operation. Potable water will be supplied by a bottled water service and will be available on site at all times . 3 071323 Non-potable water may be required for compaction of clay liners and covers and, occasionally for dust control . The quantity of non-potable water required will be variable depending upon the type of activity being conducted at the site . Non-potable water will be purchased off-site , transported to the facility, and stored and utilized on an as-needed basis . 8 . Explain the access route( s ) to be utilized for the proposed use . Access to the site will initially be via the existing landfill road. This road will be extended westward along the northern perimeter of the current landfill until it intersects the eastern boundary of the proposed landfill ; the ingress/egress point ( see Vicinity Map) . Eventually, access to the site may be provided by a new road from State Highway 119 . The road will run due south and will intersect the site at its ' northeastern corner. The road will be constructed once right-of-way and easements are obtained over the land between the site and the highway. If the XTRA Corporation should decide to construct the road in the future , all applicable Weld County zoning regulations and engineering requirements will be adhered to . Weld County will be contacted prior to beginning any optional access road construction activities . 9 . Explain type, size, weight and frequency of vehicular traffic associated with the proposed use. The vehicular traffic utilizing the XTRA Landfill will be divided between private cars and trucks and commercial compactors and roll-offs . The frequency of traffic to the site will be unchanged from the existing conditions because the service area is expected to remain the same . Dust on the access road will be controlled by applying water or calcium chloride during dry periods and gravel during periods of inclement weather. 10 . The type of sewage facilities for the proposed use . There will not be sewage facilities at the site . A portable sanolet is currently utilized for sanitatiin facilities at the existing landfill and will bs used at the XTRA Landfill as well . This type of facility has been proven adequate for the needs of the landfill . 4 071323 11 . A description of the proposed fire protection measures associated with the proposed use. Potential fire hazards associated with landfills are minimal . The site will not accept any burning refuse. Fire extinguishers will be kept at the gatehouse in the event a small fire occurs . Extinguishers will also be placed on each piece of equipment used at the site . In the case of larger fire , the burning materials will immediately be segregated and the on-site equipment will be used to extinguish it by smothering it with soil . The generation of methane gas and therefore , the possibility of a methane fire, is expected to be minimal because of the following reasons : * Relatively small area of the site and refuse volumes to be placed in the landfill . * Minimization of refuse moisture by banning the acceptance of saturated wastes and the placement of refuse below the water table . Methane will , however , be monitored during the life of the site and during the 5-year post-closure period as outlined in the Design and Operations Plan. 12 . The types and maximum number of animals to be concentrated on the Use by Special Review area at any one time. The only types of animals expected to be on-site are those that may be considered a nuisance . These disease and nuisance vectors will be controlled through the expeditious application of cover soil to minimize food and harborage availability. If additional control is required, the supervisor will obtain a professional exterminator . 13 . The type and size of any waste, stockpile or storage areas associated with the proposed use. During landfilling activities , a minimum of 6 inches of topsoil will be stockpiled on the undisturbed area at the northwest corner of the landfill operation as shown on the Plot Plan map. This soil will be temporarily revegetated to minimize erosion and will be posted with signs so it is not mistakenly used for daily cover soil . Refuse will not be stockpiled but compacted and covered with soil on a daily basis . 5 ne,t, A minimum of 50 , 000 cubic yards of soil will be moved to the existing landfill to complete closure activities . Filling in the proposed XTRA Landfill will begin in the previously excavated area, and cover material will typically be excavated and directly utilized. Any cover stockpiles will be small , temporary and located and placed in a fashion that will minimize potential impacts . 14 . Type of storm water retention facilities associated with the proposed use. Item 14 is not applicable to the operation of the XTRA Landfill as the flows of runoff to the St . Vrain Creek will not exceed historic flows . This amount of water will not cause excessive erosion or scour at the point of entry or downstream from the point of entry and therefore will not reduce the effectiveness of the St . Vrain. 15 . The time schedule and method of removal and disposal of debris, junk and other wastes associated with the proposed use. The gatekeeper will be trained to verify the types of incoming wastes to be accepted at the XTRA Landfill . Wastes that do not conform with those types accepted will be denied. The landfill will receive only dry household and commercial refuse and construction demolition debris . It is possible that an unacceptable refuse type will be left on the landfill . If this happens , that waste will be characterized and disposed of according to accepted regulatory guidelines . 16 . Explain proposed landscaping plans and erosion control measures associated with the proposed use. Erosion at the site will be controlled by minimizing areas of disturbance during excavation of soil for cover . Erosion will also be minimized by revegetating areas of the landfill immediately following completion of filling activities to final contours . 6 {{' +ryy C 1323 17 . Reclamation procedures to be employed upon cessation of the Use by Special Review activity. During landfill excavation, a minimum of 6 inches of topsoil will be removed and stockpiled outside of the filling area. This will be done for any disturbed area of the site . Only that area required for operation of each subsequent refuse lift will be stripped of topsoil , so as to minimize disturbance and exposure of the topsoil . Topsoil stockpiles will be revegetated as necessary to minimize erosion and to increase the organic matter in the topsoil . Signs will also be posted on the topsoil stock piles so that they are not mistakenly used for cover . The completed portion of each phase segment will be covered with topsoil and seeded as soon as practically possible . The cover will be a minimum of 3 . 5 feet thick , with the bottom 2 . 0 feet consisting of compacted clay and the top 1 . 5 feet consisting of 6 to 12 inches of uncompacted soil overlain by a minimum of 6 inches of topsoil . All but the topsoil will be placed as soon as possible over areas in which refuse placement has been completed. The subsoil surface will be roughed with a disc plow scraper or similar equipment to ensure proper binding of topsoil to subsoil , and all large rocks and debris will be removed from the topsoil . The topsoil will be placed immediately prior to seeding . Analyses will be performed on all topsoils to determine fertilizer requirements for supporting the species to be planted. When fertilizers and/or soil amendments are necessary, they shall be applied immediately before or after seeding . Prior to the establishment of grass , the seed bed will be protected from wind and water erosion by application of a straw mulch or biodegradable jute, or by planting a cover crop. Seed species , and planting times and rates will be determined through experimentation with revegetation test plots . The Weld County Soil Conservation Service will be contacted to provide input as necessary. The mix will be selected for compatibility with the climate , surrounding vegetation , wildlife , and site-specific soil conditions as well as landfill reclamation potential . 7 671.323 18 . A time table showing the periods of time required for construction and start-up of the proposed use. Completion of filling activities at the existing landfill will require the XTRA site to be in operation as early as February, 1988 . Pre-construction activities at the site will be started 6 months prior to landfill operation start-up. PART 3 - WRITTEN MATERIALS AND SUPPORTING DOCUMENTS 1 . A statement explaining how the proposal is consistent with the Weld County Comprehensive Plan. The proposed development is in the I-25 Mixed Use Development Area and outside of any Urban Growth Boundary as shown in the 13 January 1987 , Weld County Comprehensive Plan. The site is in an area that is proposed for utilization as industrial and open space , with the filling area ( the only part that will actually be disturbed) located entirely in the area with a proposed open-space designation ( Figure 1 ) . As landfills are not considered development properties , the PUD Plan requirements are not in effect at the XTRA site . The Comprehensive Plan states that landfills -are encouraged to locate in the areas where they can be visually screened and can conform to health and safety policies as well as to not remove acceptable agricultural land from use. The XTRA landfill is situated in an area that is both visually screened from the nearest major highway (-Hwy 119 ) and will not cause the removal of prime agricultural land from use . The soil type found at the area to be disturbed is SCS capability class VIIIs . This class of soil severely limits uses of the land for anything other than recreation, wildlife or esthetic purposes . Following closure -of the landfill , the land uses possible will remain the same . Conformance to health and safety regulations will be ensured through reviews of the documents by the Weld County Health Department and the Colorado Department of Health and the issuance of the Certificate of Designation. 2 . A statement explaining how the proposal is consistent with the intent of the district in which the use is located. The site currently lies in an Agricultural district . Section 31 . 4 of the Weld County Zoning Ordinance states that a Solid Waste Disposal site can be constructed occupied, operated and maintained provided Use By Special Review requirements are met and a Certificate of Designation is obtained. If applicable, a statement explaining what efforts have been made, in the location decision for the proposed use, to conserve productive agricultural land in the agricultural zone district. The proposed filling area for the XTRA Landfill is physically unsuitable for any type of agricultural use , with the exception of livestock grazing , because of the steep topographic grades . Following completion of landfilling activities , the site could still be used for livestock grazing . 4 . A statement explaining there is adequate provision for the protection of health, safety and welfare of inhabitants of the neighborhood and the county. A detailed Design and Operations Plan has been prepared for this site , and a Certificate of Designation cannot be obtained for the facility until the Weld County Health Department and the Colorado State Department of Health reviews the plan and approves it as meeting the requirements of the Colorado Solid-Waste Regulations . The proposed landfill design and operations scheme represents state-of- the-art technology as it currently exists in Colorado. The proper implementation of all aspects of this plan will ensure the protection of the health , safety, and welfare of potentially-impacted neighbors . 5 . A statement explaining the uses permitted will be compatible with the existing surrounding land uses ( include a description of existing land uses of all properties adjacent to the property) . The proposed land use of the site as a solid waste landfill is compatible with the surrounding land use as evidenced by the existence of the Longmont Landfill along the east boundary. The land uses along the other boundaries include the following : * North boundary - Agricultural - grazing or fallow * South boundary - Agricultural - grazing or fallow * West boundary - Agricultural - grazing or fallow 9 871323 6 . A statement explaining the proposed use will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the comprehensive plan of the county or the adopted master plans of affected municipalities. As discussed in responses one and two above, the proposed landfill is compatible with both the existing Agricultural District , provided specific requirements are met , and the future open-space designation for the proposed I-25 Mixed Use Development Area. The soil capability classification at the area of the site that will be disturbed is VIIIs (as previously stated) . This classification shows the soils to have limitations with the types of land uses possible being recreation, wildlife or esthetic uses . These are in keeping with the open-space designation of the Comprehensive Plan. 7 . A statement explaining the use by special review area is not located in a flood plain, geologic hazard and Weld County Airport overlay district area; or that the application complies with section fifty ( 50) , overlay district regulation as outlined in the Weld County Zoning Ordinance. The use by special review area is not located in a flood plain , geologic hazard area or Weld County Airport overlay district . 8 . Proof that a water supply will be available which is adequate in terms of quantity, quality, and dependability (e.g . , a well permit or letter from a water district ) . Both potable and non-potable water will be required during site operation . Potable water will be supplied by a bottled water service and will be available on site at all times for use by employees and customers as drinking water and wash water. Bottled water has proven to be more than adequate for use at landfills . Non-potable water may be required for compaction of clay liners and covers and occasionally for dust control . The quantity of non-potable water required will be variable depending upon the type of activity being conducted at the site . Non-potable water will be purchased off-site, transported to the facility, and stored and utilized on an as-needed basis . 10 871323 9 . A copy of the deed or legal instrument identifying the applicant(s) interest in the property under consideration. If an authorized agent signs the application for the fee owner( s) , a letter granting power of attorney to the agent from the property owner(s) shall be provided. A copy of the ownership deed is included as Appendix A. 10 . A noise report, unless waived by the Department of Planning Services, documenting the methods to be utilized to meet the applicable noise standards . The noise requirement has been waived by the Weld County Planning Department for the purposes of this report. 11 . A soil report of the site prepared by the Soil Conservation Service or by a soils engineer or scientist. In those instances when the soil report indicates the existence of moderate or severe soil limitations for the uses proposed, the applicant shall detail the methods to be employed to mitigate the limitations . A complete discussion of the soils present, their restrictions in regards to the projected land use, and the proposed mitigation factors is in the Design and Operations Plan . 12 . A certified list of the names , address and the corresponding parcel identification number assigned by the Weld County Assessor of the owners of property (the surface estate) with in five hundred ( 500) feet of the property subject to the application. The source of such list shall be records of the Weld County Assessor, or an ownership update from a title or abstract company or attorney, derived from such records, or from the records of the Weld County Clerk and Recorder. A list of owners within a 500 foot radius of the XTRA site is included as Appendix B. 11 C71.323 13 . A certified list of the names and addresses of mineral owners and lessees of mineral owners on or under the parcel of land being considered. The Source of such list shall be assembled from the records of the Weld County Clerk and Recorder, or from an ownership update from a title or abstract company or an attorney, derived from such records . (A certification form is attached. ) The mineral rights on and beneath the proposed XTRA Landfill site are owned by Mr . Charles Hayes , owner of the site . Mr .
