WHEREAS , said property , excepting therefrom the oil , gas and other minerals
therein , has been duly advertised for sale at a public auction held on October 7 , 1946 at the
hour of 1 : 30 o ' clock , P .M . , in the office of the Board of County Commissioners , and :
WHEREAS , at said sale , Walter Bourn , Frederick , bid $25 . 00 as the purchase price
for said property and , being the highest and best bidder , said property was sold to said Walter
Bourn.
NOW, THEREFORE : BE IT RESOLVED , and it iS hereby ordered that Harold H . Seaman,
County Treasurer of Weld County , Colorado , is hereby constituted and appointed as Commissioner of
Weld County, Colorado , to make a conveyance , by quit claim deed , of said property, as aforesaid ,
to said Walter Bourn which property is more particularly described as follows , to-wit :
Lots 1 to 3 , Block 28 , Dacono
except reservations in favor of the Union Pacific Railroad Company and except reservations in
the United States Patent and reserving existing reservoir sites and irrigation ditches , if any ,
existing rights of way for public highways and roads , and to any and all existing easements or
rights of way , however evidenced or acquired , and subject to existing leases and reserving there-
from, to grantor , all oil , gas and other minerals therein or thereunder .
IT IS FURTHER ORDERED , that to such conveyance , the said Harold H . Seaman is
authorized to affix the seal of said County and said conveyance , when executed according to this
order , shall have the effect to transfer to said Walter Bourn all right , title and interest
which Weld County has in and to the aboe described property, except only and subject to the

County , Colorado , and is the owner of Lot 10 , Block 16 , Dacono
WHEREAS , said property , excepting therefrom the oil , gas and other minerals therein ,
has been duly advertised for sale at a public auction held on October 7 , 1946 at the hour of 1 : 30
o ' clock , P.M , in the office of the Board of County Commissioners, and :
WHEREAS , at said sale , Victor Warembourg , Dacono , bid $10. 00 as the purchase price
for said property and , being the highest and best bidder , said property was sold to said

January 1 , 191+7 , for extra "Specialized" clerks and overtime for regular clerks shall be 750
per hour when necessary to hire "Specialized" clerks to do work in overtime that cannot be done

Thereupon , the following proceedings , among others , were had and taken , to-wit :
Commissioner Warren introduced the following resolution:
WHEREAS , Weld County , Colorado has outstanding a valid and unpaid bonded indebt-
edness in the aggregate principal amount of 3420 , 000 bearing date December 1 , 1944 and maturing
serially 3140 , 000 on the first day of December in each of the years from 1947 to 1949 , both
inclusive ; and
WHEREAS , there are and will be no funds in the Treasury of said County available
for the payment and redemption of all or any part of said bonded indebtedness as the same becomes
due , but the same may be refunded with the consent of the owners of said outstanding bonds under
the laws of the state of Colorado ; and
WHEREAS , the Board of County Commissioners of Weld County is of the opinion and so
finds , orders , certifies , and determines that said indebtedness may and should be refunded by the
issuance of the refunding bonds of said County pursuant to the provisions of an act of the
General Assembly of the State of Colorado entitled : "An Act to enable the several counties of
the State to refund the bonded indebtedness and to repeal Chapter sixty-two ( 62 ) of the Session
Laws of Colorado of 1915" approved March 30 , 1917 , and appearing as Chapter 52 of the Session
Laws of Colorado , 1917 .
NOW , THEREFORE , BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY ,
COLORADO :
That said Weld County Issue and cause to be exchanged for the bonds to be refunded
under the provisions of the act hereinbefore referred to , new bonds of the County to be denomin-
ated "Refunding Bonds" in the aggregate principal amount of 3420 ,000 bearing date December 1 , 1946
bearing interest from and after date at the rate of one percentum per annum , payable semi-annually
on the first days of June and December in each year and maturing serially 3140 ,000 on the first
day of December in each of the years from 1950 to 1952 , both inclusive , said refunding bonds to
be exchanged dollar for dollar for the bonds to be refunded as provided by this act authorizing
the issuance of the same .
AND BE IT FURTHER RESOLVED that said Board of County Commissioners of Weld County
determine and it does hereby determine that the amount of said refunding bonds to be issued as
aforesaid shall be 3420 . 000 , and that a certificate of such determination be made and entered
upon the records of the County prior to the issuance of said refunding bonds as provided by law
in the following form, to-wit :

and to pay which there are and will be no funds in the treasury of said County available , con-

WHEREAS , the law under which said refunding bonds must be issued requires the
Board of County Commissioners to determine the amount of refunding bonds to be issued , and to

issuance of said bonds :

Thereupon Commissioner Warren introduced the following resolution :
WHEREAS , the County of Weld , in the State of Colorado , has now outstanding a
bonded indebtedness payable by consent of the holder thereof ; and
WHEREAS , there are now and will be no funds in the treasury of said county
available for the redemption of said bonded indebtedness , or any part thereof ; and
WHEREAS , by a resolution duly adopted on the 6th day of November A .D . 1946 , the
Board of County Commissioners of Weld County determined to issue , in accordance with the laws
of the State of Colorado , new bonds to be denominated Refunding Bonds , the same to be exchanged
dollar for dollar for the bonds to be refunded , the amount of bonds so determined to be issued
as aforesaid being the sum of $420 , 000 . 00 , the certificate of such determination having been
heretofore duly made and entered in and upon the records of said County as required by law; and
WHEREAS , the Board of County Commissioners has heretofore determined that said .
refunding bonds so to be issued in the aggregate amount of $420 , 000 . 00 , shall be exchanged
dollar for dollar for the bonds to be refunded , and said Board of County Commissioners believes
it tb be its duty to issue said refunding bonds and cause the same to be exchanged for the

Section 1 . That by virtue and in pursuance of an Act of the General Assembly of
the State of Colorado , entitled : "An Act to enable the several counties of the State to refund
their bonded indebtedness , and to repeal Chapter sixty-two (62 ) of the Session Laws of Colorado
of 1915 , " approved March 30 , 1917 , and appearing as Chapter 52 of the Session Laws of Colorado ,

The full faith and credit of the County of Weld are hereby pledged for the
punctual payment of the principal of and the interest upon this bond .

lution , principal and interest , shall have been fully paid , satisfied and discharged , but
nothing herein contained shall be so construed as to prevent said county from applying any
other funds that may be in the treasury of the county and available for that purpose to the
payment of the said interest or principal as the same respectively mature , and the levy or
levies herein provided for may thereupon to that extent be diminished .
Section 7 . That the provisions of this resolution and each of the bonds and the
interest coupons issued pursuant thereto shall constitute , and the same are hereby declared to
be a binding and irrevocable contract between said county and the holder from time to time of
each of said bonds and the interest coupons thereto appertaining .
Section 8 . That after said bonds are issued this resolution shall not be altered
or repealed until the bonds hereby authorized shall have been fully paid , both principal and
interest .
Section 9 . All resolutions or parts thereof , heretofore adopted , in conflict
with the provisions hereof , be , and the same hereby are repealed .
Section 10 . That this resolution immediately upon its passage , shall be recorded
in the book of resolution of said county kept for that purpose , and shall be authenticated by

WHEREAS , County Warrant , Series P No . 35507 , dated August 14 , 1946 drawn on the
Pauper Fund in the amount of Thirty-seven and 99/100 Dollars ($37 . 99 ) payable to the Greeley
Creamery Co . , has been lost by the said The Greeley Creamery Company and has not been presented
for payment in the office of the County Treasurer of Weld County , Colorado , and
WHEREAS , satisfactory affidavit and bond necessary indemnify and save the County
harmless on account of alleged loss of original warrant , have been filed with the Board of
County Commissioners .
NOW , THEREFORE , BE IT RESOLVED , that the Clerk of the Board of County Commissioners
be and he is hereby ordered to cause a duplicate warrant to be issued in favor of the said The
Greeley Creamery Company in the amount of $37.99 .

DISTRICT LEVY FOR THE YEAR 1946
TO BE COLLECTED IN 1947 : , , .--
WHEREAS , there has been certified to the Board of County Commissioners of Weld
County , Colorado , a resolution ' and order of the Board of Directors of the Northern Colorado
Water Conservatory District , as follows :
WHEREAS , it is the duty of said Board of Directors ( Section 16 of the said Water
Conservatory Act of Colorado ) in each year to determine the amount of money necessary to be
raised by taxation , taking into consideration other sources of revenue of the District , and to
fix a rate of levy , which , when levied upon every dollar of assessed valuation of property within
the District , and with other revenue will raise the amount required for the District to supply
funds for paying expenses of organization , for surveys and plans , paying the cost of construction ,
operating and maintaining the works of the District , not exceeding one half mill on the dollar
prior to the delivery of water from the works of said District ;
NOW , THEREFORE , BE IT RESOLVED , That the Board of Directors of Northern Colorado
Water Conservancy District does now determine that the amount of money to be raised by taxation
for said purposes for the year 1946 , to be collected in the year 1947 , is Thirty-nine Thousand
Six Hundred Dollars ; and said Board of Directors does hereby fix the rate of levy of three-
tenthsi►of-one-mill to be levied upon every dollar of assessed valuation of property , both real
and personal , within Northern Colorado Water Conservancy District for the year 1947 ; and
BE IT FURTHER RESORT ED , That the Board of Directors of said District does now
certify to the Board of County Commissioners of Weld County , in the State of Colorado , said
rate of three-tenths-of-one-mill , so fixed for said purposes of said District to be levied
upon every dollar of assessed value on all property within said District in said County as afore-
said ; and does now direct that at the time and in the manner required by law for levying of taxes
for County purposes , said Boards of County Commissioners shall levy said tax of three-tenths-
of-one-mill upon each dollar of assessed valuation of all property , real and personal , within
the District , in their respective County , in addition to such other taxes as may be levied by
II such Board of County Commissioners ; and
BE IT FURTHER RESOLVED , that all officers having authority to levy and collect
taxes within said County , levy and collect such taxes in the manner and form as County taxes
are collected and when collected to pay same to Northern Colorado Water Conservancy District ,
all as provided by said "Water Conservancy Act" .
NOW, THEREFORE , BE IT RESOLVED , by the Board of County Commissioners of Weld

The valuation of your county for the year 1946 as certified by the Colorado Tax
Commission is $71 , 987 , 810 . 00 and your county has been charged with state taxes on that valuation.
The above information is furnished as required by Section 21 , Chapter 158 , Session
Laws of 1943 .
Your attention is directed to the Session Laws of Colorado , 1945 , House Bill No . 50 ,
which provides for a tax levy of six ( 6 ) mills on each dollar of assessed valuation on all sheep
and goats , except those in feed lots , to be credited to the Predatory Animal Fund .
Also to Colorado Statutes Annotated , 1935 , Chapter 110, Section 325 , which provides
that there shall be levied and collected a tax equal to one-tenth of one per cent upon the
assessed valuation of all producing and non-producing metalliferous mining property , including
lode claims , placer and mill sites , together with all improvements thereon , to be credited to the
Metal Mining Fund .
In connection with making up your tax levy , the amounts each county will receive from
the apportionment of the 35% of the income tax which goes to the General County School Funds
will not be available until October 20th , at which time the State Treasurer will notify you the
amount your county is entitled to receive .

Gentlemen :
I am enclosing with this letter the amounts necessary for the various school districts
of Weld County for the general fund for the school year 1946-47 .
A few explanations maybe in order . In the second column headed "No . Teachers" you
will notice several districts have merely an asterisk instead of a number . This indicates that
this particular district is not employing a teacher for this school year but is obtaining money
from the general fund under House Bill 123 of the 1945 General Assembly.

Some of the districts , Nos . 7 , 10 16 , 26 , 30 , 42 , 49 , 122 , 126 , 127 , and 131 are
receiving the proportionate amount of the $675 of the general fund that their census is of fifteen .
This also is by authority of House Bill 123 .
Districts 35 , 47 , 61 , 69 , 71 , 75 , 77 , 78 , 116 , 123 , 133 and 136 are receiving full
apportionments of $675 because there is on file in this office a petition authorized by House
Bill 123 requesting that amount .
Districts 2 , 28 , 32 and 100 are receiving more general fund apportionment than they
have teachers certified . However , the additional amount is not in excess of the census and we
have petitions on file in accordance with House Bill 123 requesting this additional amount .
District #106 is receiving one extra apportionment by authority of House Bill 141 which grants
any district consolidating the total apportionments of both districts for a period of five years .

SALE OF HORSE TO FRANK SIMPSON:
WHEREAS , Frank Simpson , Greeley , Colorado has offered $15 . 00 for one horse which
has been used on garden project , and
WHEREAS , it is believed to be to the best interests to accept said offer .
NOW , THEREFORE , BE IT RESOLVED , that one horse described as a buckskin mare
be and is hereby sold to said Frank Simpson upon payment of the bid price of $15 .00.
The above and foregoing resolution was , on motion duly made and seconded ,

IN THE MATTER OF RESOLUTION RE :
TRANSFER OF FUNDS : / /
WHEREAS , the Board of County Commissioners of Weld County , Colorado have made an
additional appropriation to the Coroner Budget for the year 1946 in the amount of $200.00 , and
WHEREAS , the Board of County Commissioners of Weld County , Colorado have made an
additional appropriation of $500.00 to the Jail budget for the year 1946 , and
WHEREAS , the Board of County Commissioners of Weld County Colorado have made
additional appropriations for Budgets in the Pauper Fund amounting to $33 , 000.00 .
NOW, THEREFORE , BE IT RESOLVED , that the County Treasurer of Weld County , Colorado ,
be and he is hereby authorized and directed to transfer from the Contingent Fund to the County
Fund , the sum of $700 . 00.
BE IT FURTHER RESOLVED , that the County Treasurer of Weld County , Colorado be and
he is hereby authorized and directed to transfer from the Contingent Fund to the Pauper Fund
the sum of $33 ,000.00.

IN THE MATTER OF RESOLUTION RE :
BUDGET TRANSFERS :
WHEREAS The Board of County Commissioners of Weld County , Colorado , made an
appropriation of $3 , 500.00 for expenses of County Jail for the year 1946 , and
WHEREAS , the Board of County Commissioners of Weld County , Colorado made an
appropriation of $1 ,400.00 for expenses of Coroner for the year 1946 , and
WHEREAS both of the above appropriations were in excess of the amounts provided
for the year 1945 and would ordinarily have been adequate amounts for the Jail and Coroner
Budgets , and
WHEREAS , the increased cost of provisions and supplies for the operation of the
ll Jail could not reasonably have been foreseen and it is now determined that the amount of
$3 , 500.00 is inadequate to meet the expenses of the Jail for the year 1946 , and
WHEREAS , the cost of Autopsies , Jurors fees and Jurors mileage exceeds the
amounts appropriated therefor and could not have been reasonably forseen, the sum of $1,400.00
is now determined to be inadequate to meet the expenses of the Coroner for the year 1946 .
NOW , THEREFORE , BE IT RESOLVED , that the Board of County Commissioners of Weld
County , Colorado declares an emergency to exist and orders an amount of $700.00 transferred
from the Contingent Fund to the County Fund and hereby makes an emergency appropriation and
authorized the expenditure of $500.00 in the Jail budget and $200.00 in Coroner budget.
WHEREAS , the Board of County Commissioners of Weld County , Colorado budgeted
$90,150.00 for the Pauper Fund for the year 1946 which amount was in excess of the amount
budgeted in 1945 and would ordinarily have been adequate , and
• WHEREAS , the cost of Medical & Dental care , cost of drugs and provisions ,
cost of operating County projects and cash relief have far exceeded what was reasonably es-
timated but could not have been forseen, and it is now determined that the sum of $90 ,150. 00
is inadequate to meet expenses of the Pauper Fund .

NOW, THEREFORE , BE IT RESOLVED , that the Board of County Commissioners of Weld
County , Colorado hereby declares an emergency to exist and orders an: amount of t33 ,000 .00
transferred from the Contingent Fund to the Pauper Fund and hereby makes an emergency appro-
priation and authorizes expenditures for Island Grove Hospital of $1 , 500.00 for County Projects
$1 ,000 .00 and for Poor Out Budget the sum of $30, 500.00.
WHEREAS , the Board of County Commissioners of Weld County , Colorado did appropriate
for the Weld County Public Hospital the sum of $300,150. 00 for expenses during the year 19 ++6 , and
WHEREAS , as a part of this appropriation, the estimated income , other than taxes
was estimated as $210 ,000.00 and collections will far exceed this amount , and
WHEREAS , nearly all items of expense have greatly exceeded in cost , estimates made
at time of adoption of budget in 1945 and the extent to which they have increased , could not have
reasonably been forseen at the time of adoption of the budget , and
WHEREAS , because of the higher cost of supplies and services than estimated for the
1946 budget , it is now determined that the sum of $300 ,150.00 is inadequate to meet the expenses
of the Weld County Public Hospital for the year 1946 .
NOW, THEREFORE , BE IT RESOLVED , that the Board of County Commissioners of Weld County ,
Colorado hereby declares that an emergency exists and authorized the expenditure of $35,000.00
in excess of said budget for the year 1946 by the Weld County Public Hospital and hereby appro-
priates for the expenses of the Weld County Hospital for the year 1946 the sum of $35,000.00
over and above the amount specified in original budget, out of the money of said Weld County
Public Hospital collected from unanticipated earnings and now in said Weld County Hospital Fund .

AUTHORIZING COUNTY TREASURER
TO INVEST FUNDS :
WHEREAS , it is provided by Chapter 45 , Section 143 , 1935 Colorado Statutes Annotated
and acts amendatory thereof , and by Chapter 176 , Section 126 , 1935 Statutes Annotated and acts
amendatory thereof , that the Board of County Commissioners , by written resolution, may authorize
the County Treasurer to invest all or a part of the funds and moneys coming into his possession
by virtue of his office as County Treasurer in certain securities therein designated , and
WHEREAS , Harold H . Seaman, as County Treasurer of Weld County Colorado , has in
his hands as part of the "Hospital Building Fund" a sum in excess of $100 ,000.00 .
NOW , THER7ORE , BE IT RESOLVED , that Harold H. Seaman, as County Treasurer of Weld
County , Colorado , be and he is hereby authorized to invest and retain for the benefit of the
said "Hospital Building Fund" a part of said funds in his hands as said County Treasurer by the
purchase of securities in the amount and in the prices as follows , to-wit :
UNITED STATES TREASURY BILL dated November 29 , 1946 AND MATURING February 27 , 1947
in the amount of $99 ,905.00 , maturity value to be $100,000.00 .
BE IT FURTHER RESOLVED , that the United States Treasury Bill herein authorized to be
purchased shall be immediately delivered to the Trust Department of The Colorado. National Bank
of Denver , Colorado Trust No . 6393 for safekeeping for Harold H. Seaman, County Treasurer of Weld
County, Colorado .
