HomeMy WebLinkAbout891353.tiff RESOLUTION RE : APPROVE SPONSORSHIP AGREEMENT WITH PROVIDENT GENERAL INSURANCE COMPANY AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Sponsorship Agreement with Provident General Insurance Company for the purpose of providing automobile and homeowners insurance for the benefit of Weld County employees, and WHEREAS, the terms and conditions of said Agreement are as stated in the copy being attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board deems it advisable to approve said Agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Sponsorship Agreement with Provident General Insurance Company be , and hereby is , approved. BE IT FURTHER RESOLVED by the Board that the Chairman be , and hereby is, authorized to sign said Agreement. County of Weld (hereinafter called the Sponsor) enters into this Sponsorship Agreement with Provident General Insurance Company (hereinafter called the Company) for the purposes of providing automobile and homeowners insurance, and safety awareness program for the benefit of its employees or members to commence on the lst day of January , 19 9n 2. It is agreed that Fred S . James & Co . of Colorado will be the Agent of Record. 3. The Sponsor agrees to: a. Offer Provident General automobile and homeowner insurance programs as an employee benefit or service. b. Administer premium collection through payroll deduction for the insurance coverage issued by the Company to eligible employees/members of the Sponsor. c. The monthly payment must be received no later than the last day of each billing month. d. Provide a monthly contribution of $ (1 for each insured employee/member. e. Provide time and facilities for separate "Safe and Sound" presentations to management and supervisory personnel. f. Provide adequate facilities to be used by the Company for "Safe and Sound" presentations during normal office hours on specific dates to be agreed upon by the parties. g. Allow the reasonable use of internal communication and distribution facilities to inform employees/members of the "Safe and Sound" presentations and insurance programs. h. Allow employees, who request insurance or those who call with questions, to be contacted by telephone, at the work place. i. Allow employees, who request insurance, to be contacted by mail to remind them of the availability of sponsored programs. j. Report the termination or layoff of all employees/members insured by the Company within 10 working days of date of termination or layoff of employment or membership. 4. Eligible employees/members will be defined as follows: All active full-time employees and per- manent part-time employees including sole proprietors, partners, and corporation officers. A full-time employee is one who works at least 30 hours per week, at least 48 weeks of the year. A permanent, part-time employee is one who works at least 20 hours per week, at least 48 weeks of the year. 891353 5. The number of eligible employees: 778 6. The waiting period for eligible employees/members is defined as follows: None Waiting period is to be monitored solely by Sponsor. 7. Termination of the Sponsorship Agreement may be done as follows: a. The Sponsor may, upon giving not less than ninety (90) days written notice to its employees/members and the Company, terminate this Sponsorship Agreement. b. The Company may, upon giving not less than ninety (90) days written notice to the Sponsor and to all employees/members insured with the Company, terminate this Sponsorship Agreement. 8. The Company shall hold the Sponsor harmless as follows: a. The Sponsor assumes no responsibility as to the payment of premium by any individual after termination of his or her employment or membership, except for eligible retirees on payroll deduction, provided that proper notification of the termination has been reported to the Company. b. The Sponsor assumes no responsibility with respect to the insurance program(s) except as stated in this Sponsorship Agreement. c. The Sponsor assumes no liability to others arising out of any act, error, or omission of the Company, or any act, error, or omission of the Sponsor in the performance of its authorized undertaking in connection with the carrying out of this Sponsorship Agreement, EXCEPT: the Sponsor shall be solely responsible for expenses incurred by the Sponsor and for premium collected in connection with the carrying out of this Sponsorship Agreement. 9. The conditions of this Sponsorship Agreement do not in any way modify or control the provisions of any contract of insurance between any employee/member and the Company.
