Box 5 Omaha, Nebraska 68101 Re: CO-2SB-OXT-2-007107 CO-2S6-OXT-2-007108 CO-2S6-OXT-2-007109 Weld County Dear Mr. Morton: We have reviewed the referenced Public Notices for the retention of unauthorized fill material which was placed in the South Platte River in conjunction with three channel cleanout projects in Weld County, Colorado. As a result of our review, we feel that these projects have resulted in minimal improvement of the flood problems in Weld County, while resulting in significant adverse impacts to the aquatic ecosystem of the South Platte River. These projects have increased the turbidity levels within the waters of the United States during the period of construction and during the subsequent high flow periods, reduced or eliminated the aquatic habitat for variable periods for all aquatic biota, and it appears as if there has been no long-term reduction in the flood hazard or erosion potential of the areas as a result of the projects. After a review of these impacts and the apparent lack of long-term solution of the flooding and erosion problems, we feel that a permanent solution is desirable and would represent a less damaging alternative to these kinds of projects. We feel that, as a minimum restorative measure, all material which was removed from the channel and placed along the banks of the South Platte River should be removed and deposited in upland sites. The removal should restore the channel to the bankline which existed immediately before the unauthorized work was performed. The reconstructed channel banks should be stabilized using native grasses, shrubs, and trees in densities which are not less than those which existed. A mitigation plan should be developed which addresses these issues and any others which are felt to be necessary for the long-term stability of the area. -2- After review of these and other similar projects in Weld County, we suggest that the Corps of Engineers reconsider the existing general permit for Weld County for the removal of gravel from the vicinity of bridges. It appears as if the County has had difficulty determining the applicability of the General Permit and the necessity for individual permits. In view of these problems, closer review procedures involved with individual permitting should he considered.
