RE: APPROVE AGREEMENT WITH THE UNITED STATES FOREST SERVICE FOR
GRADING OF CERTAIN ROADWAYS WITHIN THE PAWNEE NATIONAL
GRASSLANDS AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement with
the United States Forest Service concerning the grading of certain
roadways within the Pawnee National Grasslands , and
WHEREAS , Weld County is to grade roadways located in Section
20 , Township 10 No

Colorado, and
WHEREAS, the terms and conditions are as stated in the
Agreement, a copy of which is attached hereto and incorporated
herein by reference, and
WHEREAS, after study and review, the Board deems it advisable
to approve said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Agreement with
the United States Forest Service for the grading by Weld County of
certain roadways within the Pawnee National Grasslands be , and
hereby is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.

The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 31st day of

AGREEMENT FOR GRADING OF CERTAIN
ROADWAYS WITHIN THE PAWNEF NATIONAL GRASSLANDS
THIS AGREEMENT, made and entered into this 31st day of
August , 1987 , by and between THE UNITED STATES FOREST
SERVICE, hereinafter referred to as "Forest Service , " and THE
COUNTY OF WELD, STATE OF COLORADO, by and through the Board of
County Commissioners of the County of Weld, Colorado, hereinafter
referred to as "County. "
WHEREAS, Forest Service wishes to have County perform grading
on the following roadways located within the Pawnee National
Grassland:
1 . 3 . 2 miles of Butte Road, United States Forest Service
Road #685 , located in Section 20 , Township 10 North,
Range 59 West of the 6th P.M. , Weld County, Colorado;
and
2 . 1 .3 miles of the Crow Valley Park picnic area, also
known as United States Forest Service Road #702 , in
Section 20 , Township 8 North, Range 62 West of the 6th
P.M. , Weld County, Colorado, and
WHEREAS, County is agreeable to rendering such services
pursuant to the terms and conditions hereinafter set forth, and
WHEREAS, Agreements between County and other governmental
entities are authorized and provided for by the provisions of
Section 29-1-203 , C.R.S. , and so provided for by Section 2-3 of
the Weld County Home Rule Charter.
NOW, THEREFORE, County agrees to provide grading according to
the following terms and conditions:
1 . County shall furnish and supply all labor, supervision,
and equipment for said services.
2 . County shall grade those portions of the following
roadways located in the Pawnee National Grassland:
a. 3 . 2 miles of Butte Road, United States Forest
Service Road #685 , located in Section 20 , Township
10 North, Range 59 West of the 6th P.M. , Weld
County, Colorado; and
b. 1 . 3 miles of the Crow Valley Park picnic area, also
known as United States Forest Service Road #702 , in
Section 20 , Township 8 North, Range 62 West of the
6th P.M. , Weld County, Colorado, and

3 . Forest Service agrees to pay County for the services
rendered under this Agreement at the cost incurred by County.
Forest Service understands that this cost will vary in accordance
with the salary of the personnel completing such services and the
equipment used , but the average cost will be approximately $35 . 00
per hour as of the date of this Agreement. County reserves the
right to raise said average cost at any time without prior
approval of Forest Service. County shall bill Forest Service on a
periodic basis for those services which have been performed in
said period.
4 . Forest Service shall hold County harmless from any and
all loss occasioned by Forest Service as a result of the
performance of the services pursuant to this Agreement.
5 . This Agreement shall run from year-to-year from the date
of the signing of this Agreement unless terminated by either
County or Forest Service , providing the party seeking to terminate
this Agreement gives the other party ten (10) days written notice
prior to the date of said termination.
IN WITNESS WHEREOF, the parties hereto agree to the terms and
conditions stated forth herein as of this 31st day of
August , 1987 .
