RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 976 - SHANNON, ET AL. , TRUSTEES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County , Colorado, and WHEREAS, the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended , did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 976, does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 976 was submitted by Margaret C. Shannon , Richard S. Shannon , III, and Robert S. Brown, Trustees , for property which is located in part of the SW4, Section 30 , Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicants and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 142 acres and 4 acres , and WHEREAS, the Board deems it advisable to approve Recorded Exemption No. 976 for Shannon, et al. , subject to the following conditions: 1) The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. 4. of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms , "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is subject to the hereinabove mentioned conditions. The owners of the property do not reside on the property and the purpose of this recorded exemption is to separate the residence on the property from the rest of the farm so that the residence may be sold as a separate parcel . Proposal is Consistent with Weld County Comprehensive Plan. This proposal is consistent with the policies of the Weld County Comprehensive Plan . None of the historical land uses of the two lots will be changed . Lot A will continue to be a residence . Lot B , containing the vast majority of the property , will continue to be used for agricultural purposes . Proposal is Consistent with Intent of the Zoning District . This proposal is consistent with the intent of the agricultural zoning district in which the subject property is located . Under the proposal the uses of the property will not change with more than 97 percent of the property continuing to be used for agricultural purposes . The only difference is that the residence will be separated from the rest of the property . • Compatability of Uses . The property will continue to be used for agriculture with the raising of corn and alfalfa being the most predominant . These uses of the land are just like the uses of the land surrounding the subject property. Compatability with Future Development. As stated before , the property is currently zoned agricultural . The property will continue to be used primarily for agricultural purposes . The property is within a mile or so of the northern and western boundaries of Fort Lupton, however , from reviewing the Weld County Future Land Use Map in the Weld County Comprehensive Plan , it does not appear that the property is within the future growth area of Fort Lupton. In addition , due to the property ' s proximity to the South Platte River , much of it would be unsuitable for development . Also , Fort Lupton has not grown to the West to any extent across U .S . Highway 85 . It is anticipated that the current uses of the property will be compatable with all future development . Proposal Consistent with Efficient and Orderly Development . This proposal would not change the current uses of the subject property , rather it would only separate the house from the portions of the property used for farming . It would not create any problem for the efficient and orderly development of the area in the future . Water and Sewage Disposal . Currently the residence is served by a private well . There is no reason to think that a well could not be forthcoming on the balance of the property should that become necessary , however , one is not planned for the immediate future . The residence: is 870133 currently served by a private septic system. Again , a septic system could be installed on the balance of the property should that become necessary , however , this is not anticipated in the near future . Compliance with Overlay District Regulations . The subject property is not located in a geologic hazard district or the Weld County Airport overlay district . All of Lot A and all of Lot B are located in the South Platte River flood plain .
